Dear Mr. Daniel.
In accordance with your application received April 26, 1 9'96 we are forwarding herewith Permit
No. WQ0012343, dated August 5, 1996, to Carolina Water Service of North Carolina, Inc. for the
construction and operation of the subject wastewater collection extension.
Please be advised of condition number 1.4 which states that no flow shall be made tributary to the
subject sewer system until such time as the d.ownstrearn sewer (WQ0002190) has been constructed and the
engineer's certification has been submitted to the Division of Water Quality.
Please be advised of condition number 15 which states that this permit shall become voidable if the
North, Carolina Utilities Commission does not issue a franchise to Carolina Water Service of North
Carolina, Inc. to provide utility service to the Turtle Rock Subdivision.
Please be advised of condition number 16 which states that no flow shall be made tributary to the
subject sewer system until such time as the North Carolina Utilities Commission has issued a franchise to
Carolina Water Service of North Carolina, Inc. to provide utility service to Turtle Rock subdivision. This
permmit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the.
North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.G. Drawer
27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Carolina Water Service of North Carolina, Inc.
Mecklenburg County
FOR THE
construction and operation of approximately 6,755 linear feet of 8 inch gravity sewer, a 256 GPM pump
station with duplex pumps, high water alarms, portable generator connection, a telemetry monitoring
system and approximately 10,850 linear feet of 6 inch force main to serve 99, three bedroom homes in
Turtle Rock Subdivision and the discharge of 35,640 GPD of collected domestic wastewater into the
Carolina Water Service of North Carolina, Inc.'s existing sewerage system, pursuant to the application
received April 26, 1996 and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment, Health and Natural Resources and
considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The facilities must be properly maintained and operated at all times.
4. The sewage and wastewater collected by this system shall be treated in tlie Carolina•Water Service
of North Carolina, Inc.'s Cabarrus Woods Wastewater Treatment Facility prior to being
discharged into the receiving stream.
5. This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Water Quality accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this request will
be considered on its merits and may or may not be approved.
6. Construction of the sewers, pump station(s) and force main shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of
wastewater to the surface waters of the State.
7. Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting materials. Mail the Certification to the Water Quality Permits and Engineering Unit,
P.O. Box 29535, Raleigh, NC 27626-0535.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of five years from the date of the completion of construction.
9. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division of Water Quality, in accordance with North Carolina
General Statute 143-215.6(a) to 143-215.6(c).
10. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
11. The Permittee shall provide for the pump station and force main the following items:
a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in the
pump station,
b. An air relief valve located at all high points along the force main,
c. A screened vent for the wet well,
d. Fillets located in the wet well at the intersection of the flooring and sidewalls,
e. Three feet of cover (minimum) over the force main or the use of ferrous material where three
feet cannot be maintained,
f. Sufficient devices which will protect the pump station from vandals, and
g. Flood protection if the pump station is located below the 100-year flood elevation.
12. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required
by this Division of Water Quality, such as the construction of additional or replacement wastewater
collection facilities.
13. NONCOMPLIANCE NOTIFICATION:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone number
(704)663-1699 as soon as possible, but in no case more than 24 hours or on the next working day
following the occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving
waters without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five (5) days following first knowledge of the occurrence. This .report must outline the actions
taken or proposed to be taken to ensure that the problem does not recur.

14. No flow shall be made tributary to the subject sewer system until such time as the downstream
sewer (WQ0002190) has been constructed and the engineer's certification has been submitted to
the Division of Water Quality.
15. This permit shall become voidable if the North Carolina Utilities Commission does not issue a
franchise to Carolina Water Service of North Carolina, Inc. to provide utility service to the Turtle
Rock Subdivision.
16. No flow shall be made tributary to the subject sewer system until such time as the North Carolina
Utilities Commission has issued a franchise to Carolina Water Service of North Carolina, Inc. to
provide utility service to Turtle Rock subdivision.

The Permits and Engineering Unit has completed a preliminary engineering review of the subject
application. .Additional information is required before we can. continue our review. Please provide the
following by June 17, 1996:
1- Please provide one of the following:
A) Franchise authorizing Carolina Water Service to provide sewer service to Turtle Rock
Subdivision, or
B) Certificate of Convenience and Public Necessity authorizing Carolina Water Service to
provide sewer service to Turtle Rock Subdivision; or
C) Letter from the North Carolina Utilities Commission indicating that Turtle Rock
Subdivision is contiguous to an existing development for which Carolina Water Service. is
authorized to provide sewer service and that Turtle Rock Subdivision is covered under that
authorization.
2- If an on -site standby generator is to be used for this pump station, specifications regarding said
generator should be submitted. To fulfill the alternate power source requirements with an on -site
generators an automatic transfer ,switch shall be provided as well. The on -site generator and automatic
transfer switch should be added to your plans or notes to that effect, The revised plan sheet(s) should be
submitted to my attention, There are two other alternatives for satisfying the alternate power source
requirements which could be used in this case. One would be to provide a portable generator connection,
telemetry monitoring system, and data on the number of generators which. Carolina Water Service owns
and how many pump stations those generators must serve. Or, because the downslope water is a Class C
water, power reliability and adequate storage could be used. This would require a letter from the power
supplier to the site with data on the number of, and duration of all power outages in the area over the past
three years. The wet well would have to have enough storage between the alarm elevation and the invert in
elevation to store the wastewater which would be generated in the time of the longest power outage from
the past three years.

3- The volume of wastewater to be generated, listed on page 2 of 8 of your application, should
reflect only the number of homes that will actually be hooked up to the sewer system by this line. It
appears as though this should reflect 99 homes not 402. The flows from the remaining homes should be
permitted in future permits as their gravity lines are being permitted and constructed. The revised, signed
and sealed, page 2 of 8 of your application should be submitted to my attention.
4- The downstream sewer (WQ0002190) does not appear to have been certified according to our
database. The Division recognizes that Phase 2A of the downstream sewer has been certified but Phase
2B appears as though it is still not certified. By condition of the permit, Phase 2B must be certified prior
to operation of the sewer system. Please either submit the engineer's certifcation for Phase 2B of
WQ0002190 or state that the subject sewer proposes to tie into Phase 2A of WQ0002190. This statement
should be signed, sealed and submitted to my attention.
Please reference the subject permit application number when providing the requested information.
All information should be signed, sealed, and submitted in duplicate to my attention at the address below.
Please note that failure to provide this additional information on or before the above requested date can
result in your application being returned as incomplete.
