application:
The property is currently undisturbed and wooded. The surrounding area includes Interstate 40 (western property
boundary), Western Boulevard (southern boundary) and existing residential properties (to the east and north of the
subject site).

The purpose of the project is to construct the necessary roadway infrastructure and utilities (i.e. sanitary sewer) to serve a
multi - family unit development.

The proposed project includes two road crossings of two separate streams (permanent) and one sanitary sewer crossing
of a stream (temporary), minor wetland impacts associated with a parking lot, stormwater device (permanent) and a
sanitary sewer installation (temporary). The permanent impacts associated with the road crossings are necessary as the
property is bisected by two UTs to Walnut Creek and thus, will provide access to the usable upland portions of the site on
the other side of the streams. The proposed sanitary sewer crossings are also necessary in order to provide sewer
service to the multi - family unit development.

3i. Comments: Permanent impacts to streams have been avoided to the maximum extent practical. There are two (2) road
crossings permanently impacting 223 LF of perennial stream; the USACE considers the other 70 LF of stream impact as
temporary due to the fact that the rip rap dissipator will be buried. The applicant understands that the NCDWQ does not
make this distinction when calculating stream impact and will therefore consider the 293 LF of stream impacted by culvert and
rip rap to be permanently impacted. The other 20 LF of stream impact is temporary for the installation of a sanitary sewer line.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order to
determine the extent and location of streams and wetlands in the vicinity of the proposed crossings. The subject
site contains isolated wetlands, wetland /linear wetlands and two perennial streams and associated riparian
wetlands. The site plan has limited permanent impacts to a two road crossings of perennial /important streams and
the temporary impacts associated with a sanitary sewer installation. There is also a minor amount of wetland
impact associated with a stormwater BMP device, sanitary sewer crossing and fill. Streams are not crossed
multiple times by roads. The proposed road crossings are necessary in order to access useable upland portions of
the property for development.
The applicant is also aware of the regional conditions associated with the Nationwide Permits 29. With respect to
residential development conditions (Regional Conditions section 4.9) the applicant does not anticipate any impacts
to streams or wetlands associated with stormwater facilities, there are no proposed single - family recreation facilities
and there are no permanent wetland or stream fills proposed within the floodway and the stream classification for
this project is C; NSW (i.e. not Outstanding Resource Waters or High Quality Waters).
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Orange protective silt fencing will be placed outside of the impacted wetland corridor to ensure protection of the non -
impacted wetland areas. It is the intent of this plan for construction impact to take place during the dryer months of the
year. Additionally, headwalls have also been utilized to minimize the footprint of the roadway crossing impacts.

As noted earlier in the application, the USACE does not consider rip rap pads buried below the elevation of the stream to be
considered permanent impact. Therefore, the applicant is only proposing to mitigate for the 223LF (at a 2:1 ratio) of
permanent stream impact associated with the culvert placed in the stream. The applicant realizes that the NC DWQ does not
currently adhere to this policy related to buried dissipator pads being considered as temporary impact; therefore, the applicant
is aware that DWQ will require 1:1 mitigation for the 293 LF of stream being impacted by culverts and dissipator pads. It is
the applicant's belief that by providing 446 LF of stream mitigation (223 LF at a 2:1 ratio) through EBX, both the USACE and
NC DWQ compensatory mitigation requirements for the stream impacts has been met.

This project is proposed within a primarily developed landscape and is part of an urban in -fill development. The
surrounding area is primarily commercially and residentially developed and the utility infrastructure (i.e. water, sewer and
electricity) are already in place to service the site. We anticipate that DWQ will advise us if a qualitative or quantitative
impact analysis is required.

the proposed project, or available capacity of the subject facility.
This project will connect to existing sewer lines. The City of Raleigh will insure that the capacity of their treatment facility

"Not Subject" has been determined not to be a stream or is not present on the property. Features that are checked
"Subject" have been located on the property and possess characteristics that qualify it to be a stream. There may be
other streams located on your property that do not show up on the maps referenced above but, still may be
considered jurisdictional according to the US Army Corps of Engineers and/or to the Division of Water Quality.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that
dispute a determination made by the DWQ or Delegated Local Authority may request a determination by the
Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the affected
party (including downstream and/or adjacent owners) is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing do Ian McMillan, DWQ Wetlands/401 Unit, 1650 Mail Service
Center, Raleigh NC 27699 -1650.
If you dispute the Director's determination you may file a petition for an administrative hearing. You must Me the
petition with the Office of Administrative Hearings within sixty (60) days of the receipt of this notice of decision. A
petition is considered Sled when it is received in the Office of Administrative Hearings during normal office hours.
The Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:00 am and 5:00
pm, except for official state holidays. To request a hearing, send the original and one (1) copy of the petition to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699 -6714. The petition may also be
faxed to the attention of the Office of Administrative Hearings at (919) 7333478, provided the original and one (I)
copy of the document is received by the Office of Administrative Hearings within rive (5) days following the date of
the fax transmission. A copy of the petition must also be served to the Department of Natural Resources, do Mary
Penny Thompson, General Counsel, 1601 Mail Service Center, Raleigh, NC 27699 -1601.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner/future owners should notify the Division of Water Quality (including any other Local, State, and Federal
Agencies) of this decision concerning any future correspondences regarding the subject property (stated above). This
project may require a Section 4041401 Permit for the proposed activity. Any inquiries should be directed to the
Division of Water Quality (Central Office) at (919 )-807 -6301, and the US Army Corp of Engineers (Raleigh

This document confirms that Center 205. LLC (Applicant) for the BACARRA DEVELOPMENT has
expressed an interest to utilize 446 Linear Feet of Stream Mitigation Credits from a single site,
or a combination of sites to include EBX Neu -Con Umbrella Mitigation Bank, and the Forrest
Creek Stream Mitigation Bank including the Forrest Creek UT -2 site, located in Neuse HUC
03020201. As the Bank Sponsor for all sites, EBX attests to the fact that mitigation is available
for transfer upon permit issuance.
Banker will notify applicant if the 446 Stream Mitigation Units become considered "At Risk" of
not being available prior to permit issuance. Credits are not considered secured until payment
in full is received from the applicant resulting in the issuance of an Affidavit of Sale by the bank
acknowledging that the applicant has fully secured credits from the bank and the Banker has
accepted full responsibility for the mitigation obligation requiring the credits /units.
The Banker will issue the Affidavit of Sale within ten (10) days of receipt of the balance of the
Purchase Price. Banker shall provide to Applicant with a copy of the Affidavit of Sale and a
documented copy of the debit of credits from the Bank Official Credit Ledger(s) showing the
permit number and the resource type secured by the applicant. A copy of the Affidavit of Sale,
with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
