The permanent impacts associated with the road crossings are necessary as the property is bisected by two UTs to Walnut Creek and thus, will provide access to the usable upland portions of the site on the other side of the streams. The proposed sanitary sewer crossings are also necessary in order to provide sewer service to the multi - family unit development. 4. Jurisdictional Determinations 4a. There are two (2) road crossings permanently impacting 223 LF of perennial stream; the USACE considers the other 70 LF of stream impact as temporary due to the fact that the rip rap dissipator will be buried. The applicant understands that the NCDWQ does not make this distinction when calculating stream impact and will therefore consider the 293 LF of stream impacted by culvert and rip rap to be permanently impacted. The other 20 LF of stream impact is temporary for the installation of a sanitary sewer line. 4. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order to determine the extent and location of streams and wetlands in the vicinity of the proposed crossings. The subject site contains isolated wetlands, wetland /linear wetlands and two perennial streams and associated riparian wetlands. The site plan has limited permanent impacts to a two road crossings of perennial /important streams and the temporary impacts associated with a sanitary sewer installation. There is also a minor amount of wetland impact associated with a stormwater BMP device, sanitary sewer crossing and fill. Streams are not crossed multiple times by roads. The proposed road crossings are necessary in order to access useable upland portions of the property for development. The applicant is also aware of the regional conditions associated with the Nationwide Permits 29. With respect to residential development conditions (Regional Conditions section 4.9) the applicant does not anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no proposed single - family recreation facilities and there are no permanent wetland or stream fills proposed within the floodway and the stream classification for this project is C; NSW (i.e. not Outstanding Resource Waters or High Quality Waters). 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Orange protective silt fencing will be placed outside of the impacted wetland corridor to ensure protection of the non - impacted wetland areas. It is the intent of this plan for construction impact to take place during the dryer months of the year. Additionally, headwalls have also been utilized to minimize the footprint of the roadway crossing impacts. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Does the project require Compensatory Mitigation for ® Yes ❑ No impacts to Waters of the U.S. or Waters of the State? 2b. If yes, mitigation is required by (check all that apply): ® DWQ ® Corps ® Mitigation bank 2c. If yes, which mitigation option will be used for this project? El Payment to in -lieu fee program ❑ Permittee Responsible Mitigation 3. Complete if Using a Mitigation Bank 3a. Name of Mitigation Bank: Forest Creek UT -2 Site and Neu -Con Stream Mitigation Bank 3b. Credits Purchased (attach receipt and letter) Type Stream Quantity 446 LF 3c. Comments: Please note that a letter of reservation has been attached from EBX for the above mentioned stream credits. As noted earlier in the application, the USACE does not consider rip rap pads buried below the elevation of the stream to be considered permanent impact. Therefore, the applicant is only proposing to mitigate for the 223LF (at a 2:1 ratio) of permanent stream impact associated with the culvert placed in the stream. The applicant realizes that the NC DWQ does not currently adhere to this policy related to buried dissipator pads being considered as temporary impact; therefore, the applicant is aware that DWQ will require 1:1 mitigation for the 293 LF of stream being impacted by culverts and dissipator pads. It is the applicant's belief that by providing 446 LF of stream mitigation (223 LF at a 2:1 ratio) through EBX, both the USACE and NC DWQ compensatory mitigation requirements for the stream impacts has been met. 4. Complete if Making a Payment to In -lieu Fee Program 4a. Approval letter from in -lieu fee program is attached. ❑ Yes 4b. Stream mitigation requested: linear feet 4c. If using a permittee responsible mitigation plan, provide a description of the proposed mitigation plan. 6. Buffer Mitigation (State Regulated Riparian Buffer Rules) — required by DWQ 6a. Will the project result in an impact within a protected riparian buffer that requires buffer mitigation? ❑ Yes ® No 6b. If yes, then identify the square feet of impact to each zone of the riparian buffer that requires mitigation. Calculate the amount of mitigation required. Zone 6c. Reason for impact 6d. Total impact (square feet) Multiplier 6e. Required mitigation (square feet) Zone 1 3 (2 for Catawba) Zone 2 1.5 6f. Total buffer mitigation required: 6g. Comments: E. Stormwater Management and Diffuse Flow Plan (required by DWQ) 1. Diffuse Flow Plan 1a. Does the project include or is it adjacent to protected riparian buffers identified ® Yes ❑ No within one of the NC Riparian Buffer Protection Rules? 1 b. If yes, then is a diffuse flow plan included? If no, explain why. Comments: There are no direct discharges to the riparian buffer from this subject property. The stormwater drainage will be captured by the two proposed ❑ Yes ® No stormwater BMPs which will be reviewed and approved by the City of Raleigh, a Certified Local Government (CLG). 2. If this project DOES NOT require a Stormwater Management Plan, explain why: 2d. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan: There are two proposed stormwater control devices on the property; both are constructed wetlands. Both these devices will be reviewed and ultimately approved by the City of Raleigh which, as discussed above, is a CLG. If you answered "no," provide a short narrative description. This project is proposed within a primarily developed landscape and is part of an urban in -fill development. The surrounding area is primarily commercially and residentially developed and the utility infrastructure (i.e. water, sewer and electricity) are already in place to service the site. We anticipate that DWQ will advise us if a qualitative or quantitative impact analysis is required. 4. Sewage Disposal (DWQ Requirement) 4a.
