The designation Grantor and Grantee as used herein shall include said parties, their heirs, successors, and assigns,
and shall include singular, plural, masculine, feminine, and neuter as required by context_
WHEREAS, Peter B. Fitzpatrick died, testate, in the State of Virginia, seized and possessed of as undivided
interest is the real property described herein;
WHEREAS, a Renunciation by Anne Lincoln Mdzpatrick, widow of Peter B. Fitzpatrick, appears in Teed
Book 895, Page 529, Henderson County Registry.
WHEREAS, Anne Lincoln Fitzpatrick, as executor of the Estate of Peter B. Fitzpatrick, conveyed the above
described property (along with other property in Henderson County) by Deed dated February 26,1997 (DB
918, Page 600) to Bryan Fitzpatrick and .lames Fitzpatrick as Custodian for Lydia Fitzpatrick pursuant to
the UTMA (Uniform Transfers to Minors Act);
WHEREAS, Peter B. Fitzpatrick was conveyed an interest in the property described herein in Deed Book
621, Page 761, (recorded on December 21, 1982) and in deed Book 628, Page 861 (recorded on July 21, 1983),
WHEREAS, Peter B. Fitzpatrick and his siblings entered into the Bright Star Associates Limited Partnership
(a limited partnership organized under the laws of Virginia) in September 1983, and that the real property
described herein has been supervised and managed by the aforesaid Partnership.
WHEREAS, Bright Star Associates Limited Partnership was converted into Brite Stars, LLC, (A North
Carolina Limited Liability Company) on January 23, 2006.
WHEREAS, Bryan W. Fitzpatrick and Lydia Winslow Collier Fitzpatrick are the children of Peter B.
Fitzpatrick, both of whom are now over the age of 21, and
Whereas, under the UTMA, James Fitzpatrick, the custodian for Lydia Fitzpatrick under the UTMA of the
State of Virginia has transferred the subject custodial property to her by deed dated ` Z 2007,
and recorded in Deed Books Page Henderson County Registry.
WHEREAS, Lydia Winslow Collier Fitzpatrick has appointed Bryan Wallace Westfddt Fitzpatrick as her
attorney in fact by Power of Attorney recorded in Book 1176, Page 108, on March 25, 2004, Henderson
County Regb".
WITNESSETH, that the Grantor, for a valuable consideration paid by the Grantee, the receipt of which is hereby
acknowledged, has and by these presents does grant, bargain, sell, and convey unto the Grantee, its successors,
assigns, forever, all that certain lot or parcel of land situates in 1-IENDERSON COUNTY, North Carolina, and being
mare particularly described as follows:
All of my interest in that property described in Deed Book 621, Page 765, (recorded on December 21,1982)
and in U eed Book 628, Page 867 (recorded on July 21,1983), which is further described as follows,
BEGINNING at a monument which stands in the beginning corner of that tract of land described in that deed
dated 30 March,1962, from George C. Westfeldt; Jr., and Andre C. Lapeyrc, as Executors under the Will of
Martha J. GaMuet Wesdeldt, to Francis James Gasquet Westfeldt Fitzpatrick, and recorded in heed Book
402, Page 13, Henderson County Registry; and running from said beginning point South 20 degrees Fast
1569A feet more or loss to a stake standing in the center of a road (said road formerly being known as the
Buck Shoals Road) (and now being terminated due to the construction of the Asheville Airport), the last
mentioned point standing at the intersection of the centerline of said road and the northeastern boundary line
of that tract of land described in deed recorded in Deed Book 402, Page 13, Henderson County Registry; and
running thence down and with the center of said road as the same runs in a southwesterly direction a distance
of approximately 725 feet, more or less, to the point of intersection of the centerline of said old Buck Shoals
Road as the same runs is Southerly direction a distance of approximately 90t1 feet more or less to the point of
intersection of the centerline of said Old Buck Shoals Road with the centerline of the road leading past the
"Little Green House" and running thence with the centerline of said road leading past the "Little Green
House" as the same runs in a northwesterly direction a distance of approximately 210 feet to a point standing
at a corner of that tract described in Book 402, Page 13, Henderson County Registry; and running thence,
with the boundary of the tract as described in Book 402, Page 13, North 85 deg. 45 min. West 563.1 feet to a
marked line; thence North 4 degrees 12 minutes East 795.5 feet to a stake; thence with an old fence North 85
[leg. 46 minutes West 1267.6 feet to a stake in the Sophia Thompson line; thence with than line North 3 deg.
52 min. East 980 feet to an iron pipe, Thompson's corner; thence in a westerly direction with Thompson's line
(which is shown on a survey prepared by Don hill as hawing a course of North 85 degrees 46 min West) 14
feet to a stake, now or formerly Thomas Westfeldt's corner; thence with the line now or formerly of Thomas
Westfeldt North 29 degrees East 65 feet to a stake; thence North 3 deg. 52 minutes East 640 feet to an Oak
marked at a corner; thence South 88 degrees 38 minutes East 1087.3 feet to a stake; thence North 4 degrees
15 min. East 30 feet to a stake and thence South W degrees 45 minutes 886.1 feet to the point and place of
beginning.

TO IIAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances thereto
belonging to the Grantec in fcc simple. And the Grantor covenants with the Grantee, that the Grantor is sciz;ed of
the premises in fee simple, has the right to convey the same in fee simple, that title is marketable and free and clear
of all encumbrances, and that Grantor will warrant and defend the title against the lawful claims of all persons
whomsoever, other than the following exceptions: Together with any easements and rights of way of record.
