Please see note (d) on the 1st page of the attached Nationwide Permit (NWP) 13. Note (d) states "The activity does not involve discharges of dredged or fill material into special aquatic sites, unless the district engineer waives this criterion by making a written determination concluding that the discharge will result in no more than minimal adverse environmental effects". Based on the attached "Sheet 3" the proposed activities will involve a discharge within a special aquatic site (riffle pool complex). It appears the Corps may be able to authorize the proposed activities under NWP 18 if conditions are met. If you agree to move forward with a combined NWP 13 and NWP 18 for the proposed activities please verify that the quantity of discharged material does not exceed 25 cubic yards below the plane of the ordinary high water mark as specified on page 1 (a) on the attached NWP 18. It appears that no other additional information is required to move forward with a NWP 18 for the fill within the special aquatic site. Please let me know if you have any questions/concerns. I also updated on the online form but it wouldn't let me submit it because the signature line was empty and I didn't know if saving the draft allowed you to see my updates. I am also attaching the updated Impact Map (which is also updated on the online form as well). A quick note about the updates just for clarification on my end: The combined linear feet of the constructed riffles is approximately 60 LF, which occur along side the 83 LF of the rock toe. That adds up to about 143 of permanent impact on the online form but total stream length impacted is 95 LF (as the constructed riffle extends approximately 12 LF past the end of the rock toe). If there are any other updates or concerns you see on the form please let me know and we will address them as soon as we can.
