This follows our discussion this a.m. The US Army Corps of Engineers did not claim this pond as jurisdictional. I was only
asked to assess the stream feature on the northern portion of site. Please see attached our letter assessment that was
done on this site.

Item 1: Per 15A NCAC 02H.1003(1), high density developments are required to treat runoff either by runoff treatment
or runoff volume match as defined in .1002. The runoff conveyed to the primary SCMs, proposed wet ponds in this
instance, is considered untreated until it is discharged or infiltrated from the primary SCM. Vegetated swales or curb
outlets alone do not provide sufficient treatment from a high density development. Please discuss any concerns
regarding the interpretation of the wetland standards with Holley Snider and DWR (cc'ed).
Item 2: This item was intending to obtain further information about the other blue line features shown within the site
on the USGS map that appear to have been omitted or not covered under the provided documentation. Specifically, the
surface waters shown in the yellow oval below are the features we are concerned about.
Regarding your concerns mentioned in tiie final paragraph: These comments are based on a preliminary in-depth
completeness review to the extent allowed by the Fast Track ATC program. The submittal requirements outlined in
.1043(3) are necessary to provide enough information to support that the project, overall, will meet the rules and
requirements. Furthermore, the Division is required to take action within 30 days of receipt of the application and we
are doing our best to review projects as quickly as possible.
In an attempt to obtain a complete application and submittal package, two requests for additional information have
been sent on this project. To date, a complete package has not been submitted and we look forward to receiving more
information about these two outstanding items.

Regarding your item No. 1, as stated previously we are not directing untreated runoff into wetlands, and oversized wet
detention basins are to be installed prior to any site discharge. This is in compliance with the rule as evidenced by the
countless projects we have on file, permitted, and approved. Additionally, I have just now re -read the wetlands
standards documents and see no reason why this would be unacceptable.
Regarding your item No. 2, I have again included the documents received for the blue -line call done for this site. We
have included setbacks on the waters required as per this call.
We would like to know why evidently a "preliminary in-depth review", as stated in your letter, is being undertaken on
this submittal? The rule states that there will be a completeness review on the submitted documents. The Engineer &
Applicant have both certified that the project is in compliance and we have complied with your original request by
submitting more than the required documents as required by the Rule. The project is eligible as per section (1) and
more that the required documents from section (4) have been submitted. As of your latest request, we are 65 days into
a process that should've been within 30 days. So if the burden is on the Engineer & Applicant and the required
documents as per the Fast Track Rule have all been supplied, how have we not complied with the Rule and why do we
continue to receive RFI's on the last possible date?

Dear Bobby:
On February 6, 2020, at your request, Robb Mairs, NC Division of Water Resource (NCDWR) staff, and Creighton
Brown with NC Division of Energy, Mineral and Land Resources (NCDEMLR), conducted an on -site determination of
the existing stream at the proposed Heritage Subdivision Phase II. The enclosed topographic drawing depicts the on -
site feature, which was determined to be a perennial stream. This drawing has been signed and is valid for 5 years.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or other affected
parties that dispute a determination made by DWR or a delegated Local Authority may request a determination
by the Director. An appeal request must be made within sixty (60) calendar days of the date of this letter or
from the date the affected party (including downstream and/or adjacent owners) is notified of this letter. A
request for determination by the Director shall be referred to the Director in writing c/o Paul Wojoski, DWR 401
& Buffer Permitting Unit, 1617 Mail Center, Raleigh, NC 27699-1617.
This determination is final and binding unless you ask for a hearing within 60 days. The owner/future owners should
notify the Division (including any other local, state and federal agencies) of this determination concerning any future
correspondence regarding the subject property. This project may require a Section 404/401 Water Quality Certification
for the proposed activity. Any inquiries should be directed to Robb Mairs of DWR at 910.796.7303 and Tom Charles
