On June 20, 2013, the Division of Water Quality (Division) received your application dated June
5, 2013, requesting a Minor Variance from the Neuse Riparian Area Protection Rule for your
project The Division has determined that your application is incomplete and cannot be
processed until we receive information regarding the mitigation of Zone 2 impacts totaling
2,920 square feet
Approval of a Variance is contingent upon mitigation for the impacts that are considered
prohibited by this Rule In this case, the required mitigation is 4,380 square feet (2,920
multiplied by 1 5) This mitigation can be satisfied through payment to a mitigation bank,
payment to the NC Ecosystem Enhancement Program (NC EEP), or mitigation conducted by the
applicant If payment to a mitigation bank or NC EEP is chosen, please provide the approval
letter regarding the availability of the appropriate buffer mitigation credits
Pursuant to Title 15A NCAC 02B 0233 (8), the applicant shall furnish all of the above requested
information for the proper consideration of the application If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee

for this activity and any work done within protected riparian buffers may be a violation of North
Carolina General Statutes and Administrative Code
