On May 23, 2013, the Division of Water Quality (Division) received your application dated May
22, 2013, requesting a Buffer Authorization from the Division for your project Your application
and plans fail to depict any measures for stormwater control for the project In a telephone
conversation with your consultants, it was explained to us that it was the intent not to install
stormwater measures, and that the plan was to make a nutrient offset payment to satisfy the
City of Raleigh in terms of nutrient management from the site Nutrient offset payments are
separate from the Neuse Riparian Buffer Rule With respect to the Neuse Riparian Buffer Rule,
it is our understanding that no on -site stormwater controls are planned resulting in the
discharge of over 6 acres of untreated stormwater into Crabtree Creek which is classified
as "nutrient sensitive water" The application is on -hold until the following information is
received
Please provide a plan sheet that indicates the location of proposed stormwater
measures for this project We understand that the City of Raleigh will be reviewing the
details of your stormwater management plan for this project, but we need to see that
stormwater management has been incorporated into this plan
In order to directly discharge stormwater into a stream through a pipe in lieu of
providing diffuse flow (15A NCAC 02B 0233 Protection and Maintenance of Existing

Riparian Buffers), the stormwater best management practices must remove (on their
own or in series) 30% total nitrogen The Table of Uses in item (6) of this rule has a
section on new stormwater outfalls The rule provides that new stormwater outfalls
require a written riparian buffer authorization A requirement of this authorization is
that "a stormwater management facility is installed to control nitrogen and attenuate
flow before the conveyance discharges through the riparian buffer" This requirement is
accomplished by stormwater management that reduces total nitrogen by 30%
Pursuant to Title 15A NCAC 02H 0502(c) and Title 15A NCAC 02B 0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the Wetlands, Buffers, Stormwater — Compliance
and Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650
Please be aware that you have no authorization under the Neuse Riparian Buffer Rules for this
activity
