SUBJECT: RESCISSION OF NOTICE OF VIOLATION (NOV-2021-CV-0020)

Sewer Extension Permit No. WQ0042608 – Buckhorn Branch Park sewer extension
Johnston County

Dear Permittee:

A Notice of Violation (NOV) was sent to the Town of Clayton dated August 5, 2021 for construction of a sewerline without
a permit of the referenced sewer extension. This NOV was sent based on a conversation with the engineer involved with
the sewer extension. However, it has been determined that the NOV that was sent was the result of a misunderstanding.
After the Town of Clayton received the NOV, DWR staff was contacted by both the engineer and the Town, explaining that
construction had not begun on this project. Based on the information provided by the engineer and the Town, it has
been determined that there was no violation and the NOV should have not been issued. The NOV will be deleted from
DWR’s database. This letter serves as a formal notice that this NOV has been rescinded. We apologize for any
