Based on comments provided by you via email, the proposed retaining wall has been redesigned to reduce stream impacts on the Site. Proposed stream impacts have been reduced from 521 linear feet (0.034 acre) to 452 linear feet (0.029 acre). The Site Plan submitted in the original PCN application dated July 23, 2021 included an error in the impact table. The original table listed 443 linear feet of stream impact, which was the total presented in the original PCN submittal and was also used for proposed mitigation. This number was incorrect and is inconsistent with the actual calculated length and acreage of stream impact on the original Site Plan. The incorrect original Site Plan, the updated original Site Plan with the corrected table, and the final Site Plan are included in Appendix B. Due to the NWP #39 and Corps’ Wilmington District mitigation thresholds of 0.1 acre for wetland impacts and 0.02 acre for stream impacts, mitigation is proposed via the NC Division of Mitigation Services In-Lieu Fee Program (for wetland impacts) and RES Catawba Umbrella Mitigation Bank (for stream impacts). Based on the North Carolina Wetland Assessment Method (NC WAM), the wetland quality of WAA is medium. Based on the overall results of the NC WAM, the proposed mitigation ratio for wetland impacts is 2:1. Based on the North Carolina Stream Assessment Method (NC SAM), the stream quality of SCA is medium. Based on the overall results of the NC SAM, the proposed mitigation ratio for the stream impacts is 2:1. The Site consists of one parcel (Mecklenburg County Parcel Number 01740104) that contains approximately 23.14 acres. H&H reviewed State and Federal Threatened and Endangered Species databases for the Site and conducted a screening survey of the Site and surrounding area in November of 2020 for Federal Threatened and Endangered Species, and none were identified. Although the survey was conducted after the growing season, only one freeze event occurred prior to the survey on November 3, 2020. On-Site herbs, grasses and shrubs were still present during the screening survey. H&H also reviewed the National Registry of Historic Places (NRHP) for Sites located in Mecklenburg County, North Carolina; the North Carolina State Historic Preservation Office (NC SHPO) GIS viewer; and the Site and surrounding area via visual reconnaissance for the potential presence of historic, cultural, and/or archeological sites. No recorded sites were noted on or adjacent to the Site. No significant structures were observed on-Site. H&H requested comment on the Site from the United States Fish and Wildlife Service (FWS), NC Wildlife Resources Commission (WRC), and NC SHPO in March 2021. Agency responses were included in the original submittal dated July 23, 2021 and indicated no comments on the proposed project. The Town of Huntersville Development Ordinance mandates an 80-ft landscape street buffer along the frontage of proposed buildings. The developer has reduced the required buffer to 40-ft along Hambright Road through conversations with the Town to further shift the building to the southwest toward the road and away from on-Site aquatic resources, thus reducing impacts to the on-Site stream. In addition, the sanitary sewer along the southern and western portions of the Site is being 2 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Trinity Partners (TRI)/TRI-003/Permitting/PCN Application/Hambright/PCN Update/C - Avoid and Minimize.docx realigned, and the proposed retaining wall has been redesigned to further avoid grading in Waters of the U.S. In order to prevent dewatering of the remaining on-Site stream and other Waters of the U.S. located downgradient of the Site, the developer is proposing the installation of a French drain along the northern boundary of the truck court. The French drain will extend to the unimpacted upgradient portion of Wetland Area ‘A’ (WAA) in an attempt to maintain flow through the Site. The upgradient portion of WAA will still be considered an indirect impact, and mitigation is proposed for the entirety of the wetland area. In addition, the stormwater management pond located in the western portion of the Site will discharge into the stream channel. An appropriate stormwater dissipation structure will be implemented at the terminus of the stormwater pond outlet prior to discharging into the stream. A previously designed Concept Site Plan prepared by D&A Wolverine indicates that the developer originally proposed a significantly larger area of disturbance, which included additional parking areas. The proposed Site building has been reduced from the desired 285,000 square feet to 225,000 square feet, which is the industry minimum required for the current market, to facilitate a reduction of impacts to on-Site aquatic resources. Industrial spec multi-tenant warehouse/distribution buildings have certain industry standard requirements for buildings that consist of specific building and parking dimensions. The required dimensions include a 240-ft depth of building and 130-ft depth of truck court located in the rear of the building to allow 54-ft tractor trailers to maneuver in and out of the loading docks. The market demand in the Charlotte area, including Huntersville, has a strong need for industrial warehouse/distribution space, and there is not an abundance of vacant or undeveloped land available to support the demand. Duke Energy high tension powerlines and poles exist in the eastern portion of the Site. These lines prohibit building a structure in that area, and parking is the only possible use below and in the vicinity of the powerlines. The developer has reviewed all options to place a 225,000-square foot building on the Site, and the presented option is the least impactful to existing Waters of the U.S. Further manipulation of the proposed building and infrastructure, while continuing to maintain 3 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Trinity Partners (TRI)/TRI-003/Permitting/PCN Application/Hambright/PCN Update/C - Avoid and Minimize.docx industry standard requirements, is not possible. The updated Site Plan with stream impact reduction and the prior Concept Site Plan are included in Appendix B. To minimize Site impacts, the proposed Site plan was designed to avoid Waters of the US to the maximum extent practicable. The Site building, parking areas, loading docks, and stormwater management areas have been designed to primarily occupy upland areas. Because of the Town roadside buffer reduction, building size reduction, sewer realignment, and redesign of the retaining wall, the developer has reduced the overall stream impact by 69 linear feet from the originally submitted Site Plan and 171 linear feet from the Concept Site Plan. Additionally, the developer is proposing the installation of a French drain and a stormwater discharge outlet to facilitate maintained hydrology to Waters of the U.S. During Site development, good erosion and sediment control practices will be followed. Extensive silt fencing will be used on the construction Site perimeter and along stream and wetland boundaries. Mitigation Mitigation is typically required by the USACE Nationwide Permit 39 for impacts greater than 0.1- acre of wetlands and 0.02-acre of stream. Due to the proposed impacts to 0.355 acre of on-Site wetlands and 0.029 acre (452 linear feet) of on-Site streams, compensatory mitigation is proposed in the form of purchasing wetland mitigation credits from the Division of Mitigation Service In- Lieu Fee Program and stream mitigation credits from the RES Catawba Umbrella Mitigation Bank. The mitigation acceptance letters are included in Appendix D. A North Carolina Wetland Assessment Method (WAM) form and North Carolina Stream Assessment (SAM) forms have been conducted for the on-Site wetland (Wetland Area ‘A’) and on-Site stream (Stream Channel ‘A’), respectively. The WAM and SAM forms are attached in Appendix E. The overall WAM rating for the wetland is medium quality, and the overall SAM rating for the stream is medium quality. Because the wetland and stream are of medium quality, a mitigation ratio of 2:1 is proposed although we believe a 1.5:1 ratio would also be reasonable if the Corps agrees.
