3i. Comments: NCDOT requests a waiver to widen the existing stream channel to match the width of the proposed culvert.
The width of the culvert was chosen because it is the only size that comes closest to meeting the channel dimensions along
with hydraulic requirements for conveyance of water.

The length of the culvert was chosen to provide enough shoulder to not require guardrail and to increase the safety at this
location.
A culvert was also chosen to expedite construction at this location due to the heavy truck traffic from Fountain Quarry.
The project is being completed to alleviate safety concerns of truck traffic going through the Town of Fountain due to the
current posting on the bridge that does not allow loaded trucks to cross.
The proposed culvert is more hydraulically efficient than a bridge at this location and water surface elevations are less for the
proposed culvert than the existing and natural water surface elevations for the 10 and 25 year storms, see CSR for quantities.
Over the life of the structure, culvert crossings require less maintenance than bridge crossings which translate to the overall
cost of the project.

The Wiggins Mill Mitigation Site is located in Wilson County, south of the Wiggins Mill
Reservoir and southwest of the City of Wilson. It encompasses approximately 89 acres.
The site grading was completed in October 2000 and planting in March 2001. The site
provided 84 acres of small stream swamp hardwood (1St and 2 ❑d order streams),
bottomland hardwood, swamp hardwood, and headwater forest/low elevation seep
wetland communities restoration, 5.3 acres of bottomland hardwood enhancement, 7,020
linear feet of stream restoration, and 11.31 acres of buffer restoration. The site
successfully completed five years of monitoring in 2005.
As shown below, NCDOT has debited 125 linear feet of stream restoration from the
Wiggins Mill Mitigation Site to provide compensatory mitigation to offset the 125 linear
feet of unavoidable stream impacts associated with the culvert channel improvements
over Lang's Mill Run on SR 1232(Allen Gay Road).

1. The Corps of Engineers believes that there may be jurisdictional waters of the United States
on the subject site, and the permit applicant or other affected party who requested this
preliminary JD is hereby advised of his or her option to request and obtain an approved
jurisdictional determination (JD) for that site. Nevertheless, the permit applicant or other person
who requested this preliminary JD has declined to exercise the option to obtain an approved JD
in this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non - reporting NWP or other general permit,
and the permit applicant has not requested an approved JD for the activity, the permit applicant is
hereby made aware of the following: (1) the permit applicant has elected to seek a permit
authorization based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved JD before
accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an approved JD could possibly result in less compensatory mitigation being
required or different special conditions; (3) that the applicant has the right to request an
individual permit rather than accepting the terms and conditions of the NWP or other general
permit authorization; (4) that the applicant can accept a permit authorization and thereby agree to
comply with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking any activity in
reliance upon the subject permit authorization without requesting an approved JD constitutes the
applicant's acceptance of the use of the preliminary JD, but that either form of JD will be
processed as soon as is practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a preliminary JD constitutes agreement that all wetlands and other water
bodies on the site affected in any way by that activity are jurisdictional waters of the United
States, and precludes any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court; and
(7) whether the applicant elects to use either an approved JD or a preliminary JD, that JD will be
processed as soon as is practicable. Further, an approved JD, a proffered individual permit (and
all terms and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional
issues can be raised (see 33 C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes
necessary to make an official determination whether CWA jurisdiction exists over a site, or to
provide an official delineation of jurisdictional waters on the site, the Corps will provide an
approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the subject project
site, and identifies all aquatic features on the site that could be affected by the proposed activity,

This letter is in response to your letter of January 31, 2013 which provided the U.S. Fish and Wildlife
Service (Service) with the biological conclusion of the North Carolina Department of Transportation that
the replacement of Bridge No. 233 on SR 1232 over Langs Mill Run in Pitt County will have no effect on
the federally listed American sturgeon (Acipenser oxyrinchus oxyrinchus), red - cockaded woodpecker
(Picoides borealis), West Indian manatee (Trichechus manatus), Tar River spinymussel (Elliptio
steinstansana) and the federally protected bald eagle (Haliaeetus leucocephalus). Due to the need for a
Conditional Letter of Map Revision (CLOMR) from the Federal Emergency Management Agency for this
project, you have requested concurrence with these biological conclusions. These comments are provided
in accordance with Section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C.
1531 -1543) and the Bald and Golden Eagle Protection Act (16 U.S.C. 668- 668d).
Based on available information, it appears that no suitable habitat occurs in the project vicinity for the
American sturgeon, red - cockaded woodpecker, West Indian manatee, and Tar River spinymussel. With
the exception of the American sturgeon, we concur with your biological conclusion that the project will
have no effect on these species. Since the American sturgeon is under the purview of the National Marine
Fisheries Service, that agency must be contacted for concurrence. Also, based on your survey of the
project area, no bald eagle nests occur near the project vicinity, and therefore that species will not be
affected.
The Service does not have any concerns or objections to this project. We believe that the requirements of
Section 7(a)(2) of the ESA have been satisfied for those species under our purview. We remind you that
obligations under Section 7 consultation must be reconsidered if: (1) new information reveals impacts of
this identified action that may affect listed species or critical habitat in a manner not previously
considered in this review; (2) this action is subsequently modified in a manner that was not considered in
this review; or (3) a new species is listed or critical habitat determined that may be affected by this

Description of review activities, results, and conclusions:
Review of HPO quad maps, historic designations roster, and indexes was undertaken on May 7, 2013.
Based on this review, there are no existing NR, SL, LD, or DE properties in the Area of Potential Effects.
The tax parcel for PT 454, the R.L. Bell House is within the APE but the house and associated
outbuildings are located more than 1,400 feet from the project area. The bridge replacement will have no
effect to the house, outbuildings or viewshed of the identified historic property. There are no other
structures in the APE of this project.
