PROJECT SUMMARY: The applicant proposes to modify the existing pier and construct two (2) additional piers with boatlifts, a boathouse and floating docks to provide mooring for eight (8) vessels. PROJECT DESCRIPTION: The project site is located in The Beach at Bricklanding Subdivision, between 1933 and 1937 Stone Ballast Way SW, adjacent to the Atlantic Intracoastal Waterway (AIWW), on the mainland side of Ocean Isle Beach, in Brunswick County. To find the property from Shallotte, travel south on NC Highway 179 approximately 4 miles to Bricklanding Road. Turn left onto Bricklanding Road (NCSR 1143) and travel approximately 1.2 miles to Goose Creek Road SW. Turn right onto Goose Creek Road SW and travel <0.1 miles to The Beach at Bricklanding Subdivision. Turn left onto Stone Ballast Way SW and travel approximately <0.1 miles to the project site, which is located on the left between 1933 and 1937 Stone Ballast Way SW. The project site is located within an existing 16 -lot subdivision and consists of a vacant parcel, which is designated as common area, totaling approximately 2.22 acres. The project site is bordered by residential property to the north, east and west and the AIWW to the south. The property measures approximately 240 feet deep (measured from NHW) by approximately 576 feet in width, with approximately 576 feet of shoreline frontage. The property has an average elevation of approximately 8 feet above Mean Sea Level. Upland vegetation consists of lawn grasses, landscape shrubs and Southern Wax Myrtle (Myrica cerifera). Waterward of the upland vegetation is an area of high marsh, which ranges in width from approximately 10 feet to 15 feet, consisting of mixed coastal wetlands, and "404 type" vegetation, including Wax Myrtle (Myrica cerifera), Salt Meadow Grass (Spartina patens), Glasswort (Salicornia spp) and Spike Grass (Distichlis spicata). Located waterward of the mixed vegetation is a band of low marsh measuring approximately 30 feet to 40 feet in width, which consists primarily of Smooth Cordgrass (Spartina alterniflora). The applicant received a CAMA Major Permit (No. 49 -89) on March 3, 1989 for the development of the subdivision. It appears that a modification to State Permit No. 49 -89 was issued in October 1992 for the construction the existing pier and "T- head ". A proposal to install a floating dock adjacent to the existing pier and T -head was withdrawn when ownership issues arose over a parcel that subdivided the common property. According to the applicant the issues have been resolved and the POA maintains ownership of a single tract of land located between the AIWW and the constructed homes within the subdivision. The existing pier measures approximately 6 feet in width by 90 feet in length (as measured from the MHW) and extends in a southerly direction into the AIWW. The existing pier terminates at a "T- head" measuring approximately 10 feet in width by 38 feet in length. The Brunswick County Land Use Plan classifies adjacent waters as Conservation and the adjacent high ground portion of the project area as Residential. The waters of the Atlantic Intracoastal Waterway are classified as SA, HQW by the NC Division of Water Quality. These waters are NOT designated as Primary Nursery Area (PNA) by the NC Division of Marine Fisheries and they are OPEN to the harvest of shellfish. There are two (2) known archaeological sites located within a mile of the project site, Bw 179 and Bw 180. The Beach at Bricklanding Property Owners Association Page 3 10. PROPOSED PROJECT: The applicant proposes to modify the existing pier and construct two (2) additional piers with boatlifts, a boathouse and floating docks to provide mooring for eight (8) vessels. The applicant proposes to modify the existing pier by installing a floating dock adjacent to the existing "T- head ". The proposed floating dock measuring approximately 10 feet wide by 20 feet long would be connected via and access ramp measuring approximately 4 feet wide by 18 feet long. The access ramp would be located near the center of the existing "T- head" and would extend in a westerly direction down to the proposed floating dock, which would be oriented parallel to the shoreline. As proposed the floating dock would extend beyond the existing "T- head" approximately 28 feet and would provide temporary dockage. The application states that the water depth at this location ranges from approximately — 4.75' to approximately —6.5' at Normal Low Water (NLW). The applicant is also proposing to construct two (2) additional access piers with slips to the east and west of the existing pier. An additional pier is proposed approximately 112 feet west of the existing community pier. The proposed pier to the west would originate at the high ground of the common property and extend approximately 128 feet towards the AIWW. The pier would terminate at a fixed finger pier oriented parallel to the shoreline measuring approximately 4 feet wide by 46 feet long. The applicant is proposing to install four (4) boatlifts within the slip areas created by the finger pier. The proposed boatlifts would each measure approximately 13 feet wide by 13 feet long. The applicant is proposing to construct a cover over the lift proposed in the most south westerly slip. The proposed boathouse would measure approximately 14 feet wide by 24 feet long. A proposed access ramp, measuring approximately 4 feet wide by 18 feet long, would be located near the center of the proposed finger pier. The access ramp would extend to a proposed floating dock measuring approximately 10 feet long by 20 feet wide. The proposed floating dock would also be oriented parallel to the shoreline. As proposed, the floating dock would extend beyond the proposed finger pier approximately 28 feet and would provide temporary dockage. The applicant has stated that he proposed slips and floating dock would be located in waters with depths ranging from -2 to -3 feet at Normal Low Water (NLW). As proposed, the outboard end of the docking facility would be located approximately 5 feet from the federal channel setback and would provide mooring for four (4) vessels. The proposed docking facility would be located approximately 230 feet from the adjacent riparian property line to the west. The applicant is proposing to construct a third access pier to the east of the existing pier which would be located approximately 111 feet east of the existing community pier. The proposed pier to the east would originate at the high ground of the common property and extend approximately 118 feet towards the AIWW. The fixed pier would terminate at a finger pier oriented parallel to the shoreline measuring approximately 4 feet wide by 46 feet long. The applicant is proposing to install four (4) boatlifts within the slip areas created by the finger pier. The proposed boatlifts would each measure approximately 13 feet wide by 13 feet long. A proposed access ramp, measuring approximately 4 feet wide by 18 feet long, would be located near the center of the proposed finger pier. The access ramp would extend to a proposed floating dock measuring approximately 10 feet long by 20 feet wide. The proposed floating dock would also be oriented parallel to the shoreline. The proposed docking facility would be located approximately 25 feet from the adjacent riparian property line to the east. The width of the AIWW in this location is approximately 460 feet. 11. ANTICIPATED IMPACTS: The applicant proposal to modify the existing pier and construct two (2) additional piers with boatlifts, a boathouse and floating docks to provide mooring for (8) vessels would incorporate an additional 3,093 square feet of Estuarine Waters and Pubic Trust Area and would shade approximately 870 square feet of Coastal Wetlands. As proposed, the outboard side of the proposed floating docks would provide temporary dockage for the loading and unloading passengers. There is the potential for morring along the outboard side of the floating dock which could result in three (3) additional slips for a total of eleven (11). The proposed additional piers and modifications would not encroach into the adjacent 15' Riparian Corridor Setback Area nor the 80' USACE Federal Channel Setback. Minor increases in turbidity should be expected during construction. The proposed floating dock addition would extend an average of approximately 92 feet into the waterbody, which measures approximately 460 feet across. As proposed, the piers would conform to the 1/4 width rule. Submitted by: Holley Snider Date: 6/18/2013 Office: Wilmington Scope of Project The purpose of the project is to facilitate allowances for docking facilities as articulated in the property deeds of the owners of the property at The Beach at Brick Landing waterfront development. The deeds stipulate the ability to build slips in accordance with state and federal laws. The waterfront community consists of fifteen lots of which eight docking slip will be built is needed to represent the lots. The owners would like to reduce the environmental and aesthetic impact on the area by minimizing the amount of structures. There would be a total of three piers located separately on the property as to allow for sufficient depth of water at designated slip sites. One pier already exists and two more would be constructed and placed as shown on submitted drawings. The existing pier (pier #2 on drawings) will have a gangway and floating dock built at the end of the existing pier as shown on drawings. The two new stationary piers would be built from above NHW on the property and extend approx.150 -163 ft. into the AIWW. Stationary fingers would be built perpendicular to respective main pier walkways and each finger would account for 2 slips with one boat lift prescribed per finger (as shown on drawing) and one floating dock would be built per pier located adjacent to the waterward end of the pier to be used as the single floating structure per pier. The piers will provide mooring for the property owners of The Beach at Brick Landing. The size of the tract is approx. 3.03 acres and 576 lineal ft. of frontage on the AIWW. All permits, delineations, and surveys deemed necessary for this project will be acquired.
