Dear Mr. McIntyre:
I am responding to your request dated January 18, 2013 for modification to the existing
Department of the Army (DA) permit issued for the above referenced project on March 10, 2011.
The permit modification is proposed to change the monitoring report submittal date to May
31. The current submittal date, as required by Special Condition P (7) of the DA permit, is
December 31. The changes are being requested so that the planted vegetation can be quantified
and assessed for survival during the growing season just before the monitoring reports are due.
I have determined that the proposed project modification is minor and is not contrary to the
public interest and therefore, the DA permit is hereby modified. It is understood that all
conditions of the original permit and subsequent modifications remain applicable and that the
expiration date is unchanged.
Special condition P (7) is modified as follows:
1. Monitoring reports shall be submitted to the Corps by May 31 of each year. The
monitoring reports must be prepared in accordance with Regulatory Guidance Letter 08-
03 and must include maps, site photographs, vegetation monitoring results and hydrologic
monitoring results. The monitoring reports shall also include monitoring well data graphs
that clearly depict depth to groundwater, precipitation, monitoring and monitoring
well results.
