The project is located at the intersection of Centerview Drive and Jones Franklin Road in Raleigh, Wake County, North Carolina. We are requesting review for our proposed impacts under the designation of "allowable" under the table of uses within the Neuse River Basin Protection and Maintenance of Existing Riparian Buffers (15A NCAC 02B .0233). A Neuse River buffer determination was issued by Mr. Eric Kulz, Raleigh Regional Office of NCDWQ, on July 5, 2006 for the project site (attached). A jurisdictional determination was made during an on-site field meeting conducted on June 6, 2006 by Mr. Monte Matthews of the USACE. A signed Wetland Delineation Map is forthcoming by the USACE; however, attached is a survey of the field confirmed jurisdictional determination. The proposed project consists of amulti-family apartment complex and constitutes the remaining acreage of the Centerview Office Park development. The proposed residential development lies entirely within a City Focus Area as designated by the City's Comprehensive Plan containing 378 apartment Research Triangle Park, rtc i units and associated parking and stormwater management facilities. McADAMS COMPANY, INC. Ms. Cyndi Karoli Centerview January 17, 2007 Page 2 PROPOSED NEUSE STREAM BUFFER IMAPCTS: (see attached "Stream Buffer Impact Maps"). The entire site was designed to minimize impacts to aquatic resources, while utilizing the remaining undeveloped acreage of the Centerview Office Park development. There are a total of 0.22- acre of stream buffer impacts for the project site, in which the uses are deemed allowable in the table of uses for the Neuse River Basin Protection and Maintenance of Existing Riparian Buffers. The site was also designed to limit concentrated flows into the stream buffers. BUFFER IMPACT SHEET 1: There is an existing sanitary sewer easement located on the eastern side of the stream and a sanitary sewer that intersects at a man-hole within zone 1 of the buffer, on this eastern side of the stream. The north to south sewer line easement is currently maintained, however we are proposing to maintain the existing sewer easement which ties in to the main line from the east. We are proposing to utilize a 20 linear foot construction easement and maintain a 20 linear foot easement on the east-west sewer line for maintenance, totaling 0.03 acres of buffer impact. This is an allowable use within the table of uses and does not require mitigation. New temporary buffer disturbance of 0.01 acre is proposed within the currently maintained easement in order to tie into the existing man-hole. BUFFER IMPACT SHEET 2: An upgrade of an existing BMP structure is proposed on the northeast quadrant of the site to provide for stormwater management. There is an existing dry pond bed and dam structure once used as a sediment basin. A stormwater management pond is proposed for this area, and was deemed a logical location due to the limited new land disturbance needed and existing drainage patterns to this area. A majority of these impacts (0.16 acre) are associated with construction impacts for access and the placement of silt fence site stabilization, as illustrated on sheet 2. A majority of the berm for the pond is located outside of zone 2 at this reach of the stream. The main outfall pipe used to treat the 2 and 10-yr storm events is located outside of zone 2, and is being level spread at 0.47 ft/sec at peak flow. The overflow discharge pipe is partially located within zone 1 of the buffer (0.02 acre) and will only outlet over a dissipater pad during peak flows when the water levels are at or near this outlet source. Any buffer area not impacted by the stormwater management facility will be stabilized and re-vegetated. If applicable, discuss construction techniques to be followed during construction to reduce impacts PROPOSED NEUSE STREAM BUFFER IMAPCTS: (see attached "Stream Buffer Imvact Mans"l. The entire site was designed to minimize impacts to aquatic resources while utilizing the remaining_undeveloped acreage of the Centerview Office Park development There are a total of 0 22-acre of stream buffer impacts for the~roject site, in which the uses are deemed allowable in the table of uses for the Neuse River Basin Protection and Maintenance of Existing Riparian Buffers. The site was also designed to limit concentrated flows into the stream buffers. BUFFER IMPACT SHEET 1: There is an existin sg anitary sewer easement located on the eastern side of the stream and a sanitary sewer that intersects at a man-hole within zone 1 of the buffer, on this Page 9 of 13 eastern side of the stream. The north to south sewer line easement is currently maintained, however we are proposing to maintain the existing sewer easement which ties in to the main line from the east. We are proposing to utilize a 20 linear foot construction easement and maintain a 20 linear foot easement on the east-west sewer line for maintenance totaling, 0 03 acres of buffer impact. This is an allowable use within the table of uses and does not require mitigation. New temporary buffer disturbance of 0.01 acre is proposed within the currentlymaintained easement in order to tie into the existing man-hole. BUFFER IMPACT SHEET 2: An upgrade of an existing BMP structure is proposed on the northeast quadrant of the site to provide for stormwater management. There is an existing dr~pond bed and dam structure once used as a sediment basin. A stormwater mana eg ment~ond is proposed for this area, and was deemed a logical location due to the limited new land disturbance needed and existin dg raina~e patterns to this area A majority of these impacts (0 16 acre) are associated with construction impacts for access and the placement of silt fence site stabilization as illustrated on sheet 2. A majority of the berm for thepond is located outside of zone 2 at this reach of the stream. The main outfall pipe used to treat the 2 and 10-yr storm events is located outside of zone 2, and is bein lg evel spread at 0.47 ft/sec at peak flow. The overflow discharge pipe is partially located within zone 1 of the buffer (0.02 acre) and will only outlet over a dissipater pad during_peak flows when the water levels are at or near this outlet source. Any buffer area not impacted by the stormwater management facility will be stabilized and re- vegetated. The remainingjurisdictional streams and stream buffers will remain in tact., with no additional impacts anticipated. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o. enr.state. nc. us/ncwetlands/stnngide.html.
