Hi Kevin, Unfortunately, since this is a different type of impact, it will need to be permitted. You have 2 options: 1. NCDOT can revise the proposed project for Bridge 75 and request authorization under NWP 12. To do this, NCDOT would be the permittee and would be responsible for compliance with the utility work. This would probably be the quickest way to go. You could do this by sending me an email with the plans and the impact amounts. You would need to make it clear in the email that NCDOT would be the permittee (again, for compliance). Then you would wait to hear back from me re approval. Since this project isn’t located in a trout watershed, there is no requirement to coordinate it with WRC. If you do it this way, please let me know if you would cut any trees, blast, or use other percussive activities (other than what was already noted for the Bridge PCN) in the action area – i.e., the impacted waters and immediate uplands that would be impacted for this pipeline. 2. The utility company can obtain a NWP 12 for this project. Please read https://saw- reg.usace.army.mil/NWP2021/NWP12.pdf to see if it would require notification (a PCN) or not. It doesn’t sound like it would, but I’m not 100%. Note that NWP 12 was recently reissued, so please review the information at the link. Notification requirements are on pages 2 and 3, and the regional conditions (which are different than those you’re used to seeing with NWPs 13 and 14) start on page 27. The regional conditions may impose additional notification requirements. Note that if this option is chosen, the utility company must contact the USACE county project manager (Brandee Boggs at brandee.c.boggs@usace.army.mil) as I can only process application when NCDOT is the applicant. I cannot think of anything else that DWR requires for the utility work. Temporary impacts and restoration as you describe should cover it. As part of this project, the gas company plans to relocate a gas line. The relocation will involve temporary dewater (approx. 10’) so that they can excavate and place the new gas line under the creek. I have plans for the gas line work (“P-215403…..” attached above), but more importantly, the replacement will occur within an area that has already been permitted for temporary impacts from dewatering (see page 5 on attached permit drawings, I show the gas line in relation to the existing/permitted temporary impacts). They will place the stream material back in place where it goes, so everything should look natural when done. They will also have to excavate the banks on both sides to install the line. We will have them replace the earthen material they remove back onto the line and stabilize with native seed mix and coir fiber. As such, do you need any additional information? It should only take a few hours to complete, and given the minimal impacts, I’m hoping this may be more info than you need (or want ????). But, let me know if anything is unclear or you need to discuss.
