Dunn, Coastal Coordinator Habitat Conservation Division DATE: August 6, 2021 SUBJECT: CAMA Dredge/Fill Permit Application for Charles Alien, Brunswick County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 1002 North Shore Drive W. in Sunset Beach, NC along Blane Creek. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-I28), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et The applicant proposes to construct a 38' by 6' access pier into Blane Creek that ties into an existing 20' by 4' access. The waterward end of the pier would be a 12' by 12' gazebo with a 12' by 4' open platform. A 20' b 8' floating dock (Slip # 1) would be located waterward the gazebo, approximately 10' waterward NLW. A 13' by 13' boatlift (Slip #2) would be west of the floating dock. Waterdepths in the vicinity range from 0' NLW to -0.9' NLW. Blane Creek at this location is classified SA by the Environmental Management Commission and are designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the permit application and concerns stated by NCDMF. The project area is designated a PNA. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. Slips located in water depths less than -2' NLW may cause chronic sediment disturbance from the ingress / egress of vessels and from floating structures that rest on the bottom substrate during low water events. The thick organic material can cause significant turbidity when disturbed. If the existing floating structure without stops was not present, our comments may have leaned toward no allowance of a floating dock. We also support the statement by NCDMF with regard to the boat lift and how its presence will lead to chronic disturbance from vessel use and therefore should be reproved from project design or designed in a manner to have it in deeper water depths. An in - water construction moratorium from April 1— September 30 would further protect aquatic resources. We appreciate the opportunity to review and comment on this permit application.
