Any work related to ocean outfalls that require any type of work trestle and/or the use of sheet pile would require a modification of the permit. Work consisting of replacing parts (with no change in the existing footprint or lengthening of the structure), without the construction methodology that I previously stated, would be considered repair/maintenance. I assume no permit is required to replace collars and reset pipe joints if the work can be done without the aid of a steel sheet pile coffer dam utilizing an excavator operating from the beach as described below in my 21 May 2021 email. The three locations are shown on the attached map. One of the locations is mislabeled as “Martin Street” and should be labeled as “Kitty Hawk Kites Outfall no. 2”. It has now been determined that a steel sheet pile coffer dam and crane will be needed to make the aforementioned repairs due to erosion of the shoreline. Can you please confirm the permit requirements for proposed repairs if construction of a steel sheet pile coffer dam is required? There is an internal NCDOT maintenance staff meeting next week to discuss these repairs and permit information regarding these repairs will be helpful when discussing timelines etc. Thanks From: Trowell, Steve J Sent: Friday, May 21, 2021 2:17 PM To: Daisey, Greg <Greg.Daisey@ncdenr.gov> Cc: Barnes, Kyle W SAW <kyle.w.barnes@usace.army.mil>; Ward, Garcy <garcy.ward@ncdenr.gov>; Williams, Paul C <pcwilliams2@ncdot.gov>; Castello, Robert C <rccastello@ncdot.gov> Subject: Ocean Outfall Repairs at Curlew, Conch and Martin Streets Nags Head, Dare County Greg: This email is a follow up to our 13 May 2021 phone conversation concerning proposed repair of the exposed outfall pipe collars in the swash zone at three outfall locations in Nags Head: Curlew, Conch and Martin streets. Wave action in the swash zone has fatigued the stainless bolts holding the collars and pipe joints together which has resulted in some separation of the pipe joints and failure is imminent. The Town of Nags Head is concerned with drainage pipe function and the upcoming tropical storm season. Therefore, NCDOT maintenance staff proposes to repair the pipe collars and reset the pipe joint in the last ±40’ of the outfall pipe at each of the aforementioned ocean outfall locations in Nags Head. Maintenance forces plan to excavate on either side of the collar with an excavator to expose the bottom of the collar to access the damaged bolt. The collar and pipe joint will then be reset and bolted back together with a new bolt. This work will be completed at low tide. There will be no equipment or materials left on the beach at the completion of each day of work. There will not be any enlargement of the outfall structure nor any of it’s components other than the stainless steel bolt. The repair work is not expected to take more than two days per outfall. Equipment staging and access to the beach will be from the Conch Street public beach access. I have initiated consultation with the USFWS Gary Jordan reference the applicable protected species which I have copied you with that correspondence. Once I have his response I will ensure that you have a copy. Since this work will occur during sea turtle nesting season, NCDOT will conduct a turtle crawl survey within the project vicinity each morning prior to any work taking place, and a log will be generated. If any turtle crawl is observed, NCDOT will stop work and consult with the NCWRC prior to any further work taking place. Could you please respond to this email confirming that this work will be considered maintenance and will not take a permit from the NC Division of Coastal Management (DCM)?
