Gary:

There is a fourth outfall pipe in need of repair in Nags Head, outfall no. 3. The type of repair is
exactly like the repair described in my May 21, 2021 letter to you and subject of your concurrence
letter dated May 24, 2021. Should I draft another letter requesting concurrence for “may affect, not
likely to adversely affect” for sea turtles and shorebirds to repair outfall no. 3? This repair work is
proposed to be undertaken sometime in September once the Corps NWP 7 is obtained. Thanks for
your time responding.
