Reason for Visit: Routine
Inspection Summary:
This inspection was as a result of a phone complaint stating that the operation was causing nasty discharges from the site
during rain events.
I first went to the property which filed the complaint and the ditch was dry and without obvious signs of a complication.
I visited the facility and walked the perimeter fence without signs of an obvious complication. Actually I was impressed that
the operation had an onsite perimeter ditch system which contained many tad poles and other healthy stream critters. For
this to have been the facility's first inspection, the operation was orderly, with very little litter or displaced automotive parts
near or in the perimeter ditches.
Based on this inspection of the site, I do not expect that the operation contributed, as reported. The offsite shallow swell
located to the rear of the address reported is located outside the operations exterior fence and without obvious connection
to the operations internal ditch system. Also the invert of the operations internal ditch system is approximately 2 feet
below the shallow swale of the address as reported.

Dear Mr. Mast:
On. September 23, 2015, the Washington Regional Office of the Division of Energy, Mineral, and Land Resources
received a stormwater redevelopment exclusion request for the proposed project, located off New Hope Road, at the end
of Boat Ramp Road, Perquimans County within Hertford, -NC. Staff review of the plans and supporting documents has
determined that the project proposes activities that are excluded from State Stormwater permitting requirements as set
forth in Section 2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules under Title 15A
NCAC 2H .1000, as amended.
Therefore, the Division of Energy, Mineral, and Land Resources is hereby providing confirmation that the subject project
is excluded from State Stormwater permitting requirements under the following conditions: 1) The project must be
constructed as shown on the plans submitted to this Office; 2) The project, proposes a decrease in impervious area of 820
square feet; and 3) The proposed stormwater control, provides equal or better protection of surface waters than the
existing stormwater control.
Under Section .1003(b) of the stormwater rules, the entire common plan of development must be permitted. Therefore,
any future development or changes to the proposed development, including but not limited to, the locations of the built -
upon area and construction of additional built -upon area, may require approval or a Stormwater Management permit
application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any
construction on the site prior to receipt of the required approval or permit will constitute a violation of Title 15A NCAC
2H.1000 and Session Law 2008-211, and may result in the initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals,
which may be required by Federal, State, or local government agencies, rule or law. If you have any questions, or need

Please find attached are our comments. Site visit showed the owner dewatering without a permit. A NOV/NOI will be
sent to the applicant for the illegal activity. Applicant has applied for a NCG520000 permit. However, storm water
from around the mine site and the haul roads would be exiting the site through adjacent ditches. Mine owner should
and is required to apply fora NCG020000 permit to cover the storm water and wastewater discharges. If you should
have any questions, please contact me.

The Washington Regional Office received a copy of your CAMA Major application for the bulkhead and
fmger pier replacement project at the property located at 25 Pier Pointe, Craven County, NC on
September 22, 2015. Staff review of the plans and specifications has determined that the project, as
proposed, consists of activities that will not pose surface water quality threats from stormwater runoff
since no new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing
water quality threats from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this
letter that your project will not require a State Stormwater management permit at this time.
The stormwater rules require the Division to permit the common plan of development, therefore,
any future development on the property, regardless of whether a SEC plan or CAMA Major
permit is also required, will require a Stormwater Management Permit application and permit
issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any
construction on the subject site, prior to receipt of the required permit, will constitute a violation of
15A NCAC 2H.1000 and may result in appropriate enforcement actions by this Office.
Please keep in mind that this determination does not affect your legal requirements to obtain other permits
which may be required by the Division of Water Resources, the Division of Land Resources, Coastal
Area Management Act or any other Federal, State or Local Government.
