Storm drainage runoff outlet from the proposed 24 -inch RCP on the south side of the existing 60 inch CMP culvert can be achieved with a dissipater located partially within zone 2 but outside of zone 1 NRB. However, runoff outlet from the proposed 15 -inch RCP on the north side of the existing 60 inch CMP culvert will have all of its dissipater located within zone 1 for reasons already discussed. If we could achieve a way to avoid it at this location we would. The PCN will provide a detailed explanation about the 'no practical alternatives" for this proposed impact. However, your client will be required to avoid and minimize as well as pay mitigation for the impacts to the buffers. Aligning the pipe outlet further away from the stream on the upstream side "buck's" the natural grade. We cannot find a daylight point to discharge if we do this. I've attached a PDF file of the plan and one of the profile showing this challenge. In my professional opinion we have no practical alternative for either pipe outlet. When we met with Martin Richmond last week - the field reconnaissance seemed to suggest this to be the case. Please let me know if you want to discuss this further. Thank you. You are welcome to attend but it is not necessary. The snag we have is that when we performed our topographic /design survey originally, the area was impounded due to beaver activity. At some point following the initial survey, the beaver dam was removed enabling us to see what is going on with the stream channel through that area. We have re- surveyed the area but there appears to be more than one stream channel feature present. We cannot definitively make the call on the second feature without concurrence from the Corps. Also, two of our proposed storm drainage systems outlet directly into what would be Neuse Riparian Buffers. We'll rely upon DWQ to assist us with what would be allowable in this situation, and may need to make some adjustments to the outlet design depending upon the direction we receive from both US Army Corps and DWQ. We are unable to complete the PCN application or tie down the easements in this area until we receive a determination on what is jurisdictional and some guidance from DWQ. One item that we need assistance with from the Town is 'agent authorization.' We will need the owner of both Suggs' properties to sign off on a letter form indicating that we 8 have permission to both access the property and submit an application to U.S. Army Corps and DWQ for impacts to the environmental features on their property. I have prepared a draft letter (attached). Please review this and let me know if you have any questions. We will need to have this executed by the property owners and forwarded to the Corps in advance of our April 10th site visit. Also, note, it would need to be made clear with the Owners that a separate agreement(s) would be prepared for the Permanent Easements and Temporary Construction Easements. Periodic Corrective Action if Necessa If any erosion problems are observed in the wetland or buffer downslope of the roadway swale discharge points, then you shall immediately repair and correct the problem and prevent further damage and sediment discharge to the receiving wetland. Please be aware that these repairs may require you to obtain a 404 Permit from the Corps and a 401 Certification from the Division.
