Dear Mr. Tankard:
The commissioners of the Minzies Creek Sanitary District are now in receipt of the
June 29, 2016 letter entitled, "Notice of Violation & Intent to Assess Civil Penalty". Minzies
Creek does not deny that the violation occurs, but in discussion with ORC, Charles A Jones, Jr.
we believe the problem was caused by a number of factors that were outside the control of
Minzies Creek and that steps have been taken to rectify said situation.
First, the data attached hereto shows that there were higher than normal flows in the
month of February. This combined with the unusually cold temperatures for this period of
time caused the facility to have reduced treatment capability. The higher than normal flows
caused the activated sludge process to be "washed out" and the cooler than average
temperatures delayed the recovery and regrowth of the biomass.
Changes have been made to sampling locations and procedures to help obtain a more
representative result, as we do not believe that the results referenced reflect the day to day
operation of the plant.

It is no secret that the district is operating an older and outdated system, which is in
the process of being replaced. Minzies Creek is still moving forward with the plan to use
USDA grant funding and loans to modernize the entire sanitary district. As you are well
aware, this district is comprised of mostly low income, retired individuals and that we operate
on a very limited budget.
I would ask you to consider waiving any civil penalty in this scenario based upon the
meteorological factors which contributed to this violation, as well as the situation currently
confronting the district, more specifically the financial ability or lack thereof to pay such a
penalty. Furthermore, the district is making all efforts available to it to modernize the system
and meet all standards set by the State of North Carolina.
