Skvarla, III Governor Acting Director Secretary June 16, 2013 Pivot Coastal Development, LLC Paul Slobodian 7401 Windward Drive New Bern, NC 28569 Subject: 401 Water Quality Certification 244 Baird Point Road DWQ Project # 2009 -1254 Beard Creek [NEU10, 21 -111; NSW; SC, Sw] Dear Mr. Slobodian: On June 5, 2013, Anthony Scarbraugh of the Division of Water Quality (DWQ) inspected a proposed construction of an access road at the subject site located at 244 Baird Point Road in Pamlico County. This project was inspected for compliance with the General Water Quality Certification (GC) #3705 with Additional Conditions granted on December 22, 2009 for the construction of the proposed access road at the subject property. The GC approved impacts of 0.007 acres of wetlands to complete your project as described in your application received by DWQ on November 23, 2009. The inspection revealed that the project has not yet been completed. If your 404 or CAMA - permit was not renewed before its expiration date, vour certification is no longer valid and you do not have authorization to proceed with your proposed impacts. However, if you renewed your 404 or CAMA Permit prior to the expiration, your Certification remains valid and you will be rescheduled for an inspection at a later date. This office would like to remind you that you are limited to the impacts proposed in your application and you must comply with all additional conditions regarding completing the certification of completion and compliance with GC #3705. As a reminder, if you change your project you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. This document can also be accessed through the DWQ Wetlands, Buffers, Stormwater Compliance and Permitting Unit website at http://portal.ncdenr.or.q/web/wq/swr)/ws/webscape. Violations of any condition set forth in the Certification and Additional Conditions may result in revocation of this Certification and may result in criminal and /or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to water as depicted in your application and as authorized by this, Certification shall expire upon the expiration of the 404 or CAMA Permit.
