Less than 1/3 acre of buffers are proposed to be permanently impacted by the project. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. The Project will be phased so as to prevent large areas of land disturbance that could contribute to sediment runoff into the streams and wetlands. All construction will be conducted in accordance with NCDEQ standards. All temporary erosion control measures shall be maintained in proper working conditions throughout construction. Per the Soil and Environmental Consultants, PA, report, the U.S. Fish & Wildlife Service (USFWS) and N.C. Natural Heritage Program (NCNHP) online databases were queried to assess the status of listed species within one mile of the project area that could potentially be affected by the project. The USFWS wrote, "The species list generated pursuant to the information you provided identifies threatened, endangered, proposed and candidate species, as well as proposed and final designated critical habitat, that may occur within the boundary of your proposed project and/or may be affected by your proposed project." It should be noted of the species identified on the official species list, the NCNHP report did not identify any Federally threatened or endangered species within the project area or within one mile of the project area. S&EC determined that the proposed project is "not likely to adversely affect a portion of the federally listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Endangered Species Act (ESA)." The +/-59.439-acre tract is located at 506 Husketh Road, east of Youngsville, in Franklin County. The coordinates of 36.0335,-78.4365 generally correspond to the center of the Site. Protect Detail The proposed Project consists of the construction of a single-family residential development with associated driveways and utilities. The Project is proposed to be developed in two construction phases but impacts within Phase 2 are associated with utility construction and are proposed to be constructed during Phase 1. All proposed project impacts (i.e., all phases) are shown and addressed within this application. Access to the Site will be provided via Husketh Road along the southern border. No federally threatened or endangered species are listed to occur within 1.0 mile of the Project according to the NC Natural Heritage Program (NHP) Database (see attached report dated July 19, 2021). However, work conducted by Soil Environmental Consultants, PA (S&EC) determined that the proposed project is "not likely to adversely affect a portion of the federally listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Endangered Species Act (ESA)." There are nine historic properties located within 1.0 mile of the Site based on a query of the North Carolina State Historic Preservation Office (NCSHPO) database. Eight are listed as "Surveyed Only" and one is listed as "Study Area individual survey." Figure 4 depicts the locations of these properties in relation to the Site. Protect History The Site is primarily undeveloped and mostly wooded. Surrounding areas are a mix of residential development and rural areas with a mix of farmland and undeveloped wooded areas. S&EC performed a wetland and stream delineation in early 2021. A site meeting with S&EC staff and April Norton of USACE was held on April 8, 2021, Westra Subdivision Page 1 of 2 and confirmed in e-mail correspondence attached with this application. A riparian buffer determination site meeting with S&EC staff and Erin Deck of NCDWR was held on March 10, 2021, to confirm applicability of riparian buffers on the Site. The corresponding Buffer Determination Letter (RRO #21-045) is attached. The attached Figure 3 by S&EC indicates that Wetland W2, Wetland W3, and Stream SE are isolated, non - jurisdictional features. Project Impacts Total proposed temporary wetland impacts due to utility installation = 0.027 acre. No permanent impacts to jurisdictional wetlands are proposed. No impacts to jurisdictional streams are proposed. Proposed riparian buffer impacts will result from utility installation. Total temporary Zone 1 impacts = 1,602 sf and total permanent Zone 1 impacts = 66 sf. Total temporary Zone 2 impacts = 7,958 sf and total permanent Zone 2 impacts = 6 sf. All proposed buffer impacts are either "Deemed Allowable" or "Allowable Upon Authorization." Impacts to isolated, non -jurisdictional wetlands and streams are proposed. Permanent isolated wetland impacts total 0.17 acre due to lot fill (Sheet EX-1) and total 0.11 acre due to utility installation (Sheet EX-4). Permanent isolated stream impacts total 237 linear feet due to lot fill (Sheet EX-1). Avoidance and Minimization Impacts to streams, wetlands, and riparian buffers have been carefully considered to reduce permanent impacts to the maximum extent practicable. This project has been designed to meet purpose and need while avoiding and minimizing impacts to onsite natural resources to the greatest extent practicable. There are 9.89 acres of jurisdictional onsite wetlands, of which only 0.027 acres are proposed to be temporarily impacted. No jurisdictional stream impacts are proposed. Less than 1/3 acre of buffers are proposed to be permanently impacted by the project. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to provide additional protection from runoff. All construction will be conducted in accordance with NCDEQ standards. All temporary erosion control measures shall be maintained in proper working conditions throughout construction. All temporarily impacted features will be restored and stabilized with native vegetation. Mitigation Proposed wetland impacts are below current mitigable thresholds.
