Please find attached to this letter the following items: 1) A complete Pre-construction Notification (PCN) Application form 2) Jurisdictional determination letter including a vicinity, topographic, soils and jurisdictional features graphic 3) Project site plan showing proposed areas of impacts 4) Project site plan with detailed impact areas and culvert profile 5) Survey map of jurisdictional `waters of the US' 6) Photographs of on-site features 7) USACE General Permit Verification and Notification of Jurisdictional Determination from previous permit authorization The purpose of this letter is to inform you of this proposed project; however notification is not required because avoidance and minimization of impacts associated with this project have allowed impact quantities to remain below the notification threshold. Proposed impacts have been minimized to 95 linear feet of intermittent stream and 0.081 acre of vegetated wetland for the construction of two road crossings and other impacts associated with development. The owner/applicant of this property is Beazer Homes; however, ESP Associates, P.A. (ESP) is acting as the authorized agent for the project. ESP performed the natural resource investigations on the site on January 9, 2007, which included the identification and delineation of jurisdictional wetlands and streams and a search for potential habitat of threatened/endangered species. Beazer Homes ESP Project # QK10.700 Arbors at Mallard Creek/Glenmere June 25, 2007 Project Description The Mallard Creek/Glenmere site is being proposed for the development of townhomes and associated amenities and is comprised of 8 acres. The site is located west of Interstate 85, north of Mallard Creek Church Road and east of Senator Royall Drive in Mecklenburg County, North Carolina. The site is adjacent to residential development to the north and northeast, commercial development to the west and forested area to the east. Jurisdictional Impacts The proposed project design considers and incorporates the existing natural resource systems and avoids and/or minimizes impacts to jurisdictional waters where possible. Avoidance of impacts to jurisdictional areas was a central effort in the many considerations of residential development design. The roads, utility corridors, and other developmental aspects of the proposed proj ect were all planned after the jurisdictional areas were thoroughly investigated. Crossings of jurisdictional areas and associated impacts have been minimized and/or reduced as much as possible in order to stay within NW permit thresholds, while allowing for the financial viability of the project, accessibility within the site and potential future accessibility to adjacent parcels. Mitigation Impact quantities associated with this development are within NWP #29 thresholds of 0.5 acres of wetlands and 300 if of jurisdictional stream and also remain below the thresholds for NCDWQ written concurrence, which are 0.10 acre of wetlands and 150 if of jurisdictional stream. The 8-acre Mallard Creek/Glenmere development has been designed to avoid and minimize the impacts to `waters of the U. S.' as much as possible through a careful planning process. Proposed compensation consists of the avoidance of the majority of jurisdictional areas, minimization of impacts to the maximum extent possible, and preservation of riparian buffers along the remaining jurisdictional waters. These preservation areas will act as a natural filter for runoff associated with the development, compensate for any minimal water quality impacts to downstream waters, provide adequate wildlife habitat, and compliment and enhance the residential community. Describe the overall project in detail, including the type of equipment to be used: The proposed use for the property is the development of a high density residential community (apartment buildings/townhomes~ypical land development/construction equipment will be used, including mechanized excavation and ading equipment. 11. Explain the purpose of the proposed work: The proposed use for the property is the development of townhomes and associated amenities. The purpose of the work is to create access to other areas within the existing site and between adjoining_parcels. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action 1D Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. A jurisdictional determination was conducted by Mr. Tim Smith (dated Dec. 16, 2002 -Action ID 200330270). A General Permit Verification was issued Aug. 22, 2003 (Action ID 200331112 . The previous permit authorized impacts within the 39-acre parcel, which included the 8 acres we are proposing for this development. To date, no impacts have occurred within this 8-acre parcel. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future permits or additional impacts are expected with this project. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It maybe useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Impacts at Areas 1 & 5 are necessary to allow access to the site from Senator Royall Dr. and to other residential areas within the site. Impacts to Area 3 are necessary to allow future access to adjacent parcels and for the utilization of this area for development purposes, including a road crossing, lot/slope stabilization and ,grading activities associated with the installation of utility lines. Impacts to Area 2 are designed to aid in lot/slope stabilization. Crossings of jurisdictional areas and associated impacts have been minimized and/or reduced as much as possible in order to stay within NW permit thresholds, while allowing for the financial viability of the project, accessibility within the site and potential future accessibility to adjacent parcels. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Page 10 of 13 IX. X. Draft Technical Guide for Stream Work in North Carolina, available at http ://h2o. enr.state.nc.us/ncwetlands/strm gide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. The proposed project design considers and incorporates the existing_jurisdictional systems and avoids and/or minimizes impacts to these systems wherever possible. (ESP) is pleased to present a brief summary letter describing the on-site conditions and recommendations associated with the approximately 8-acre site (hereinafter referred to as the Site), located west of Interstate 85, north of Mallard Creek Church Road and east of Senator Royal Drive in Mecklenburg County, North Carolina (Figure 1). The Site is adjacent to residential development to the north and northeast, commercial development to the west and forested area to the east. The proposed use for the property is the development of townhomes and associated amenities. ESP visited the Site on January 9, 2007, and performed a general investigation of natural resource issues. The Site investigation included the identification and delineation of jurisdictional wetlands and streams and a search for potential habitat of threatened/endangered species. Jurisdictional boundaries were delineated and will be surveyed for an accurate representation of streams and wetlands on the Site. One top-of--bank of the stream will be flagged, and both streams and wetlands will be surveyed by an ESP licensed surveyor. Natural Resource Investigation Results Two vegetative communities were observed on the Site: mesic mixed hardwood forest and successional cutover. The mesic mixed hardwood forest is represented primarily on the wooded side slopes of the on- Site streams and is relatively undisturbed, with mature and variably-aged hardwoods. The successional cutover community is represented on the drier upper slopes and ridgetops of the Site and was likely a xeric mixed hardwood forest community before it was timbered within the past 5 years. According to the Soil Survey of Mecklenburg County, there are four soil series mapped on the Site: Cecil, Enon, Helena and Pacolet (Figure 2). All mapped soils are classified as upland soils. Waters of the United States Sections 404 and 401 of the Clean Water Act (CWA) regulate discharges into "waters of the United States." The United States Environmental Protection Agency (USEPA) is the principal administrative agency of the CWA; however, the United States Army Corps of Engineers (USAGE) has the responsibility for implementation, permitting, and enforcement of the provisions of the CWA related to dredging and placement of fill. Water bodies -including lakes, rivers, streams, and wetlands -are Natural Resources Site Investigation ESP Project QKI0.700 Proposed Mallard Creek Site January 15, 2007 identified as "waters of the United States" and are subject to jurisdictional consideration under the Section 404 program. Wetlands, defined in 33 CFR 328.3, are those areas that are inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. USACE and the North Carolina Division of Water Quality (NCDWQ) define a jurisdictional stream as a clearly defined channel that contains water for the majority of the year. These channels usually have some or all of the following characteristics: distinctive streambed and bank, aquatic life, defined riffle/pool sequence, and groundwater flow or discharge. Any action that proposes to place fill into these areas falls under the jurisdiction of the USACE under Section 404 of the CWA (33 USC 1344), and under the jurisdiction of the NCDWQ under Section 401 Surface Water and Wetland Standards and is defined in NC Administration Code 15A NCAC 02B .0100 & .0200. Based on ESP's assessment of on-Site conditions, two streams and three wetland areas were identified within the property boundaries during the field visit (Figure 3). Please note that wetland and stream locations and boundaries shown in the figure are approximations based on field observations and available GIS information. Additionally, an on-site consultation with a USACE and/or NCDWQ representative is recommended to verify any jurisdictional calls within these areas. Permitting The USACE issues Nationwide Permit #39 (utilized for industrial, commercial, and residential development) under Section 404 for projects impacting less than 0.5 acre of wetlands and/or less than 300 linear feet of stream classified as perennial or intermittent and important (aquatically significant). Placement of fill material within greater than 0.10 acre of wetlands or greater than 150 linear feet of stream requires a written Water Quality Certification from the NCDWQ. Placement of fill material within greater than 0.50 acre of wetlands or greater than 300 linear feet of stream requires an Individual Permit from the USACE, along with the Water Quality Certification from NCDWQ. Mitigation is usually required by NCDWQ for impacts exceeding 1.0 acre of wetlands and/or 150 linear feet of stream. The USACE may require mitigation for any impacts to wetlands and perennial or aquatically significant streams. The final design for the proposed project dictates the quantity of impacts to "waters of the United States." Therefore, permitting requirements can be determined once impact quantities have been finalized. Threatened and Endangered Species If a federal permit is required for the development of this Site, concurrence with the United States Fish and Wildlife Service (USFWS) and/or the North Carolina Wildlife Resource Commission (NCWRC) may be required if threatened/endangered species and/or potential habitat is discovered on-site. Currently, five species are listed as threatened or endangered for Mecklenburg County, NC: bald eagle (Haliaeetus leucocephalus), Carolina heelsplitter (Lasmigona decorata), Michaux's sumac (Rhus michauxii), Schweinitz's sunflower (Helianthus schweinitzii), and smooth coneflower (Echinacea laevigata). A brief inspection of the Site did not reveal any of these species or their conducive habitat. Therefore, the development of this Site is not expected to impact any of these species. Summary and Recommendations Jurisdictional areas ("waters of the United States") identified on the subject property include two streams and three wetland areas. Given the above permitting requirements, the location of jurisdictional waters on the subject property and the current Site plan, the professional recommendation of ESP Natural Resources staff is to minimize impacts to jurisdictional areas during the planning stage of the proposed development as much as possible in order to stay within the Nationwide Permit thresholds. If mitigation for impacts is Natural Resources Site Investigation ESP Project QK10.700 Proposed Mallard Creek Site January 15, 2007 required, the Ecosystem Enhancement Program (EEP) or other local mitigation banks may provide adequate mitigation for the project. It is our understanding that jurisdictional areas on the property were previously delineated and a permit was received for the proposed impacts to these areas. However, both the previous delineation and permit are outdated, and therefore, no longer valid. Based on the current site plan and the previous permitted impacts, it appears that Nationwide Permit #39 will be utilized for the proposed impacts and NCDWQ involvement is unlikely. If no changes to the Site plan occur, ESP will attempt to file for an extension of the existing outdated permit. However, if the USACE requests a re-submittal of the permit, then ESP will submit the documents necessary to obtain a new permit. Additionally, if changes to the quantity of proposed impacts do occur, it is likely that a new permit will be required. Based on agency comments in reference to the above mentioned permit scenario, it may be necessary to obtain a re-verification of the flagged jurisdictional areas from the USACE before undertaking any land- disturbing activities near these areas. If the verification is requested, ESP will forward a final survey depicting the surveyed jurisdictional areas to the USACE in Asheville, North Carolina for review and final jurisdictional determination. Afield verification meeting with the USACE and/or NCDWQ may be required. In addition, the permit process should be initiated as soon as possible in order to expedite the process for the proposed development. A permit cannot be prepared until the delineation is surveyed, verified by the USACE, and the proposed impacts are quantified. The time constraint for the Nationwide Permit process is approximately 45-60 days, depending on Site conditions and the collection of all materials necessary to complete the permit, including but not limited to the agent signature, necessary mapping, and licensed survey. This letter and the opinions included herein are based on our observations and information obtained during the investigation on the dates noted using the procedures described herein and our professional experience. If additional information becomes available, we request the opportunity to review the information, reassess the potential environmental concerns, and modify our conclusions and recommendations, if appropriate.
