Stormwater Permit No. SW6210502
James Farm — Phase 2

Dear Mr. Nobles:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on May 3, 2021. A review of that
information has determined that the application is not complete. The following information is
nceded to continue the stormwater review:
1. There does not appear to be a public airport located within 5 miles of the project area
(Section II, 5). If you believe that there is, please provide the name of the public airport.

2. Please include the contact information for the local jurisdiction for building permits
(Section III, 4). Information added
3. Per the provided USGS topographic map, there appears to be surface waters located
within the project area (Gully Branch). Please account for these surface waters in the
project density calculation (Section IV, 6-8), identify the surface area of the surface water
in the main set of plans (Section VI, 8h), and show the required vegetated setbacks
(Section VI, 8p) in the main set of plans. Areas updated as noted
4. Part of the 65.82-acre property area is already covered under a prior permit (SW6190103)
and therefore cannot also be covered under this permit. Please take one of the following
actions:
a. Permit this current phase (Phase 2) as a modification to the original permit
(SW6190103). Section II, 1 & 2 would need to be revised and a designer
certification provided (If it has not already been provided I.

b. Change the project area (Section IV, 4 & "Total Drainage Area" in Section IV,
10) for this submission so that Phase I is not included, recalculating the percent
impervious area as needed.
5. Please provide the original, signed & notarized deed restriction document (available at
the following link: https:Hdeg.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-pro rg am/post-construction-1) (Section VI, 2)
6. Please dimension the entire extent of this project area with bearings and distances
(Section VI, 8i) Phase 2 Boundary bearings and distances added
7. Per 15A NCAC 02H .1003(2)(c)(i), the side slopes of the vegetated conveyances must be
3:1 or flatter (Unless you are providing engineering calculations and an on -site soil
investigation to show stability). Per the calculations, vegetated conveyances 1-6 are
shown to have side slopes of 2-1 (0.5 ft/ft). Please revise. Updated on plans
The swale detail on plan sheet C-04 indicates that ditches 1 & 2 have side slopes of 3:1
and a 2 ft bottom width. Per the calculations, only ditches 7 & 8 have these dimensions.
Please either revise this detail to apply to all proposed ditches or revise the note on this
sheet and reference the roadside ditch detail on sheet C-08 (Please also revise the
roadside ditch detail on sheet C-08 to avoid the 2:1 slope in accordance with earlier
comment). Detail on C-04 should read 7&8. The detail on sheet C-08 has been updated as well.
9. The velocity in Swale 6 (6.02 fps) exceeds the allowable velocity (5.0 fps) and could
result in erosion. Please revise. Swale 6 widened to lower velocity
10. The ditch information shown on sheet C-04A does not appear to contain the information
for Swale 8. Swale 8 added
11. The ditch information shown on sheet C-04A shows the BUA within the drainage area to
Swale 4 as 4,043 sf (0.09 ac) whereas the calculations show 0.13 ac. The ditch
information also shows the BUA within the drainage area to Swale 7 as 22,965 sf (0.53
ac) whereas the calculations show 0.55 ac. Please revise as needed 4:0.13 is correct. 7:0.55
is correct
12. Please show the drainage easements for the proposed vegetated conveyances in the main
set of plans. Easements shown on plans
13. While not required, it is recommended to reduce the velocities of vegetated conveyances
entering wetlands to no more than 2.0 feet per second to help protect the wetlands.
14. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents.

Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to July 3, 2021, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee. Please reference the State assigned project
number SW6210502 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
