On March 07, 2019, the Division of Fnergy, Mineral and I..alid Resources received your request to rescind
your coverage under NPDES Stormwater Permit NCG080784.
Based on our review of the facility on March 26, 2019 by our Washington Regional Office, your request
for rescission has been denied. Your request is denied due to remaining trash/illegal dumping and
previous spills to be abated on the site which are presenting potential stormwater impacts. A Copy of the
Inspection Report is attached for your records.
Once the potential stormwater impacts have been removed you may re -apply for a rescission. Your
Certificate of Coverage Number NCGO80'784 will remain in effect, and you must continue to comply with
your N.PI?ES stormwater permit,

Inspection Summary:

cleaned up as outlined/required during a 2013 rescission site inspection.
I met Matt Einsmann, PE, Republic Services Environmental Manager onsite. He and another Replubic representative stated
that the company was preparing to sell the property. I informaed that all trash/ illegal dumping, any previous spills, etc. were
to be properly abated, so that no known onsite problems were left behind for any potential buyers to acquire, or to be later
surprised by.
Mr. Einsmann said that he would recontact me for another visit, as soon as the site has been properly cleaned/prepped in
order to be placed on the sales market. Mr. Einsmann stated the site will be properly prepared such that the NPIJES SW
Permit can be rescinded.

On January 17, 2013, the Division of Energy, Mineral and Land Resources received your request to
rescind your coverage under Certificate of Coverage Number NCG080784.
Based on our review of your request and the recommendation of our Washington Regional Office, your
request for rescission has been denied. Your request was denied because there are industrial materials
remaining onsite, including containers of paint, oil, and other unknown substances, some of which are
leaking. These materials must be removed before a rescission can be granted. You may resubmit a
rescission request once the site has been cleared of the remaining materials.
Your Certificate of Coverage Number NCGO80784 will remain in effect, and you must continue to
comply with your NPDES stormwater permit. This includes developing and implementing a Stormwater
Pollution Prevention Plan and performing the required analytical and qualitative monitoring.

Republic Services is requesting that the referenced certificate for coverage under the
NPDES Stormwater General Permit be rescinded as the facility at the reference address
is no longer used by Republic Services in an industrial capacity. From a telephone
conversation that I had with Mr. Ken Pickle on January 2, 2013, I am sending this letter
with a brief description of the request. I have also attached a "Rescission Request
Form."
In February2011, Republic Services relocated. the hauling operation from the referenced
address to the East Carolina Landfill in Aulander, North Carolina. Currently, Republic
Services does not perform any industrial activity at the referenced address such that no
discharges of stormwater are contaminated by exposure to industrial activities or
materials. The landfill is provided coverage under NPDES Stormwater General Permit
NCG12000.
Our records indicate that the facility at the referenced address was previously provided
coverage under General Permit NCG080000 with two separate certificates of coverage

Quality rescinded NCG080875 following our request to combine the permit for the
hauling division with the permit for the landfill. At the time, I was unaware of the
second certificate of coverage and did not request that NCGO80784 be rescinded as well.

Inspected the GDS Plymouth — Republic Services site (NCG080784) on February 6, 2014. The condition of the site is
almost unchanged from the time of the original inspection which was performed on March 7, 2013. Some activities
have been done but nothing that affects the rescission request. There are still some exposed containers (closed 5
gallons containers with paint and what appears to be the hydraulic oil as well as couple of closed barrels with unknown
substances in them) Some of these containers are leaking the fluids. Some Paint containers are stored in small shed
next to the main building but shad is in such bad shape that it does not provide any protection from the elements.
At this time, my recommendation would be to deny the rescission request based on these findings. I'm attaching some
pictures that I took yesterday.

will try to go to Barnhill's New Bern asphalt plant (NCG160002) sometimes next week and I will let you know about
results.

Inspection Summary:
This inspection was performed on March 7, 2013 by Samir Dumpor and Scott Vinson of Washington Regional Office as a
part of Rescission request by the permitee. The owner claims that the site has been closed since February of 2011. Site
was closed, judging by condition for approximatelly 2 years, however there is a lot of trash of different kind that remanined
on site. At least 10 rusted containers were observed on site and several barrelis, some of them full, some of them empty
scattered around the site. Several different full containers, most likel paint were left in some of these rusted containers.
Containers are covered but rusted and open at one end, they do not provide suffccient non -exposure. Several piles of
trash were observed on site. Conclusion is that before we can rescind this permit, the site shpould be cleaned out.

In accordance with your application for a discharge permit received on October 11, 2006
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state — NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, Coastal Area Management Act or any other
federal or local governmental permit that may be required.
