The documentation has been corrected. The attached information shows that SW8 070211 has been fixed. We received
that transfer application, and so I will get that processed. I do see that that one expires in June, and so it will need to be
renewed. The other one, SW8 020502, is the one that needs to be fixed as you discussed with Connor.

Good morning Kelly,
Thankyou for taking my call this AM. As per our discussion this email is drafted to update everyone on what we are
doing to get this repaired and compliant as fast as possible. First I will state that the property( lot 5 pond) has been
under management of a third party entity called Stormwater Solutions for quite some time and they are onsite every
month providing maintenance and sending reports etc. They have nevernotified me of these items nor sent pics or made
mention of the matters of non compliance or damage to the pond that are currently of concern. Until I received your
letter on Dec 20th 2020 while on vacation, I had no idea of this non compliance. I live out of state, however drove up
immediately upon returning from vacation and walked the site and understand the concerns and the necessity to
resolve quickly. Not sure how these items were missed by the company engaged but that's another matter. To update
you, I Have hired a contractor to repair the matters you pointed out and they are starting onsite this week. We had to
get a couple of bids and get this approved by the office Park owners association and because it involves a special
assessment takes a few days. Contractor says he is onsite this week. As it relates to the renewal of the permit, I was not
aware that it had an expiration and am appreciative that you pointed this out and will get this resolved as soon as the
pond is repaired and back in compliance. This should be within a couple of weeks. I understand that must be the case
before I can submit for renewal. Thirdly as it relates to the transfer application, The property was conveyed to the office
park association in 2007 and at that time It was my understanding that all documents were filed appropriately by council
however I have no way of tracking that down from 14 years ago so we are moving forward this week with completing a
new transfer application . I recall this was done when the property was conveyed 14 years ago and can't speak to why it
has never come up but we have accessed your link and are in process. I will keep you updated weekly.

Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this
letter references DEMLR as the Division responsible for issuance of the permit.
Notice of Non -Compliant Inspection:
On December 8, 2020, the Wilmington Regional Office of the DEMLR conducted an inspection of the subject
project, which is located off of Dolphin Drive in Jacksonville, Onslow County. It is currently operating under
Stormwater Management Permit Number SW8 070211 originally issued to Schilsky Office Park, LLC most
recently on June 14, 2007. Please find a copy of the completed form entitled "Compliance Inspection Report"
attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached
inspection report, the following deficiencies must be resolved:
1. Pictures: The nroiect is in substantial non-compliance. Please see the enclosed pictures.
2. O&M Agreement: The project must be maintained per the enclosed O&M Agreement
3. Deed Restrictions: Please submit the recorded deed restrictions per Permit Section H (12).
Request for Permit Transfer:
This file review and research of the tax records revealed that the ownership of the property covered by this permit
has changed and is now owned by Schilsky Office Park Owners' Association, Inc. Please note that per Section H
(4) of the permit SW8 07211, the permittee must notify the Division of any owner name changes, project name
changes, mailing address changes and ownership changes and must receive approval from the Division to transfer
the permit.
Per 15A NCAC 02H.1045 and G.S. 143-214.7 there are three options (listed below) that are available for
transferring a state stormwater permit to the new owner. The options selected may be applicable to the transfer of
the subject permit:
❑ 1. Upon the request of the current and proposed permittee, where both the current and proposed
permittee sign the transfer application.
❑ 2. Upon the request of the current permittee to the HOA or POA, where only the current permittee signs
Pie transfer application. Specific submittal requirements are listed in G.S.143-214.7(c2).
❑ 3. upon the request of a successor owner of the property on which the permitted activity is occurring or
will occur. Specific submittal requirements are listed in G.S.143-214.7(c5).

Thanks for the tip on this. Lot 10 does have a stormwater permit, attached. The inspector, Connor Musial, reports that
the site is under construction and needs to be stabilized. (I suppose that is why you all were out there.) As for the
stormwater master permit, it is a mess! The attached letter will be mailed today letting them know that they need to
get it fixed.

FYI, please see page 5 of the "deficient" attachment. This photo is looking into the outlet pipe at the discharge side, and
as you can see from the plan it is adjacent to wetlands. Connor reports that the other pond (which isn't part of Schilsky
Office Park) has a similar outlet issue. I haven't looked into which site that is yet.

They do NOT have a soil and erosion control permit nor a NCGO1 to my knowledge, or at least the City of Jacksonville
did not issue one,
Did the State?
Did they submit for a stormwater permit modification for the additional parking?
This is the Schilski area and there are two State/DEQ ponds.
They are done with the parking lot except the landscaping.
Should I do anything?

Dear Mrs. Lewis,
We are in receipt of your Request for Additional Information of December 4, 2009 for
the referenced project. We provide the following information to allow you to continue
the stormwater review (item numbers correspond to that of your Letter):
1. As you know, the pond required significant maintenance work before I was
comfortable issuing the Designers Certification. That work is now complete. I
re -inspected the pond yesterday, and based upon that inspection, have issued
the Designers Certification (attached).
2. We revised the Stormwater Plan for Schilsky Office Park (copy attached) to
better depict the drainage path from Lot 10 to the pond. That swale was also
"re -shaped" and seeded/mulched in conjunction with the pond maintenance
work.
3. Initialed the offsite supplement as requested.
We are hopeful that this response addresses all concerns and that the permit can be
issued in the near future. Should you have questions or additional concerns, please
feel free to contact me.

1. SW8 020502, Lot 2-A, SE corner of Dolphin Dr and Marlin Dr., parking lot runoff is not routed to stormwater
pond. The SE side of parking lot drains to wetlands and not the pond. Reroute stormwater runoff to
permitted catch basin nearby. Located just north of east end of Tarpon Trail.
3.SW8 070211, master plan, swale on south side of property is overflowing and not routed to pond. The top of
berm located adjacent to lot 6 is higher than the Swale bank and runoff is bypassing the pond. Lower top of
berm and maintain swale bank.

Please submit pictures to demonstrate that the maintenance performed on the ponds, that you mentioned in your
memo, corrected the items identified in my attached inspection [pg 2] in January. There was a lot of erosion on the
ponds, and stormwater was bypassing the systems on lot 2A parking and the swale on the south side of lot 6.
Please verify the items are corrected so that the application for LOT 10 can proceed. Please submit pictures of the
maintenance work done and these items corrected.

Ms. Lewis,
Pond sits in partial shade and was pretty solid several days ago when I visited. I was able to get through the ice
yesterday. Pond does NOT have adequate depth, at least in the forebay (only area I checked) and there are also
some erosion issues along the north slope that must b? fixed before I am comfortable certifying it.
am contacting the Owner and original contractor today in hopes of getting these items addressed ASAP.
Hopefully, when I return from my "buniness trip" next week, all will be complete and I will reinspect (hopefully it will
be warmer too).

If I was you, I wouldn't even waste my time doing a "compliance inspection" at this time. As I stated above, there
are 'issues". I would wait for a couple weeks. I will let you know when restoration./maintenance work is complete.

You have got to be kidding me, Dave. I can't believe that the ice on the pond is so thick you
can't easily break through it. It can't be more than a 16t" of an inch thick, and if you can't bust
through that, well .... we're not in Buffalo. It'll be 50 degrees next week. The longer you delay in
sending us the certification, the longer that permit for Lot 11 doesn't get issued.
The Division does not have the necessary surveying equipment to measure pond depth or verify
areas or elevations. That's part of the engineer's responsibility to check when the pond is
certified. Our requirement to inspect the offsite pond system is an internal mandate as part of
the permit review process. Our compliance inspection is not part of your certification process.
You do your thing and we'll do ours.

The following items were found in the common plan during inspection:
1. SW8 020502, Lot 2-A, SE corner of Dolphin Dr and Marlin Dr., parking lot runoff
is .not routed to stormwater pond. The SE side of parking lot drains to wetlands
and not the pond. Reroute stormwater runoff to permitted catch basin nearby.
Located just north of east end of Tarpon Trail.
2. SW8 070937, Lot 11, Neurophysciatric, corner of Tarpon Trail, swale is
completely rocked. Ok since high density.
3. SW8 070211, master plan, swale on south side of property is overflowing and not
routed to pond. The top of berm located adjacent to lot 6 is higher than the swale
bank and runoff is bypassing the pond. Lower top of berm and maintain swale
bank.
4. SW8 070211, master plan, swale on south side of property is overgrown with
cattails, etc... Maintain vegetated swale.
5. SW8 070211, master plan, pond side slopes are eroding and not vegetated.
Maintain pond.
6. SW8 070211, master plan, pond outlet is not covered with maximum 6"
openings. The grating on large outlet is open underneath. Ok per permitted
plans.
7. SW8 070211, master plan, pond outlet is not accessible to verify draw down.
8. SW8 070211 Chalky Office Park — the Deed Restrictions recorded lot BUA for
SW8 060506 that is filed in SW8 070211. DR document Article VIII(E), recorded
last on 9/26/06. The values are correct for SW8 070211. Please submit
recorded deed restrictions amended with the correct permit no. SW8 070211.
9. SW8 020502, Lot 1, north side at east end of Dolphin Drive. Wetland has been
partially filled down to halfway through the cul-de-sac. Notified 401(Joanne).
10. SW8 020502, between Lot 1 [First Citizens] and Lot 1-A [Dental office], the road
has gravel as stormwater drain. Maintain system so that sediment, gravel, or
debris does not enter the stormwater system and prevent full capacity.
11. SW8 020502, master plan, pond is overgrown with cattails and vegetated shelf is
not maintained. Maintain pond.
12. SW8 020502, master plan, pond is not accessible — no embankment. Pond is
fenced in. Cannot estimate depth. Request PE certification.
13. SW8 020502, master plan, pond outlet is not accessible, but the large riprap on
the outlet appears to have no negative impact to wetlands on outlet from a
distance view.
14. SW8 020502, master plan, observed metal debris along slope and in wetlands.
Maintain stormwater system and remove debris.
15. SW8 020502, master plan, sediment in street along Dolphin Drive heading
toward stormwater system. Lot 2 grading in progress. Curb inlet back washed
and sediment is leaving lot. Maintain system so that sediment, gravel, or debris
does not enter the stormwater system and prevent full capacity.

On June 14, 2007, the Division of Water Quality issued a Stormwater Management Permit to
you for the subject project. Per the terms and conditions of the permit, and Stormwater
Regulation 15A NCAC 2H.10080), which stipulates the following:
"Upon completion of construction, the designer for the type of Stormwater system
installed must certify that the system was inspected during construction, was
constructed in substantial conformity with plans and specifications approved by
the Division and complies with the requirements of this Section prior to issuance
of the certificate of occupancy."
As of this date, our records indicate the required designer's certification has not been received.
An offsite application has been received from the owner of Lot 10. The permit for Lot 10 cannot
be issued until the certification for the pond is submitted. Additionally, an inspection of the
facility will be conducted next week to determine the.status of compliance.
Please be reminded that operation of the stormwater system prior to submission of the required
certification is a violation of NCAC 2H.10080) in accordance with NCGS 143-215.6.
Construction is considered complete at the time the project is occupied by an owner or tenant
for its intended use. Please submit the required certification by January 4, 2010. Failure to
submit the certification is considered a violation of the permit, and is subject to enforcement
action, per NCGS 143-215.6A.
