As per our discussion this email is drafted to update everyone on what we are doing to get this repaired and compliant as fast as possible. First I will state that the property( lot 5 pond) has been under management of a third party entity called Stormwater Solutions for quite some time and they are onsite every month providing maintenance and sending reports etc. They have nevernotified me of these items nor sent pics or made mention of the matters of non compliance or damage to the pond that are currently of concern. Until I received your letter on Dec 20th 2020 while on vacation, I had no idea of this non compliance. I live out of state, however drove up immediately upon returning from vacation and walked the site and understand the concerns and the necessity to resolve quickly. Not sure how these items were missed by the company engaged but that's another matter. To update you, I Have hired a contractor to repair the matters you pointed out and they are starting onsite this week. We had to get a couple of bids and get this approved by the office Park owners association and because it involves a special assessment takes a few days. Contractor says he is onsite this week. As it relates to the renewal of the permit, I was not aware that it had an expiration and am appreciative that you pointed this out and will get this resolved as soon as the pond is repaired and back in compliance. This should be within a couple of weeks. I understand that must be the case before I can submit for renewal. Thirdly as it relates to the transfer application, The property was conveyed to the office park association in 2007 and at that time It was my understanding that all documents were filed appropriately by council however I have no way of tracking that down from 14 years ago so we are moving forward this week with completing a new transfer application . I recall this was done when the property was conveyed 14 years ago and can't speak to why it has never come up but we have accessed your link and are in process. I will keep you updated weekly. All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. Notice of Non -Compliant Inspection: On December 8, 2020, the Wilmington Regional Office of the DEMLR conducted an inspection of the subject project, which is located off of Dolphin Drive in Jacksonville, Onslow County. It is currently operating under Stormwater Management Permit Number SW8 070211 originally issued to Schilsky Office Park, LLC most recently on June 14, 2007. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Pictures: The nroiect is in substantial non-compliance. Please see the enclosed pictures. 2. O&M Agreement: The project must be maintained per the enclosed O&M Agreement 3. Deed Restrictions: Please submit the recorded deed restrictions per Permit Section H (12). Request for Permit Transfer: This file review and research of the tax records revealed that the ownership of the property covered by this permit has changed and is now owned by Schilsky Office Park Owners' Association, Inc. Please note that per Section H (4) of the permit SW8 07211, the permittee must notify the Division of any owner name changes, project name changes, mailing address changes and ownership changes and must receive approval from the Division to transfer the permit. Per 15A NCAC 02H.1045 and G.S. 143-214.7 there are three options (listed below) that are available for transferring a state stormwater permit to the new owner. The options selected may be applicable to the transfer of the subject permit: ❑ 1. Upon the request of the current and proposed permittee, where both the current and proposed permittee sign the transfer application. ❑ 2. Upon the request of the current permittee to the HOA or POA, where only the current permittee signs Pie transfer application. Specific submittal requirements are listed in G.S.143-214.7(c2). ❑ 3. upon the request of a successor owner of the property on which the permitted activity is occurring or will occur. Lot 10 does have a stormwater permit, attached. The inspector, Connor Musial, reports that the site is under construction and needs to be stabilized. (I suppose that is why you all were out there.) As for the stormwater master permit, it is a mess! The attached letter will be mailed today letting them know that they need to get it fixed. Holley, FYI, please see page 5 of the "deficient" attachment. This photo is looking into the outlet pipe at the discharge side, and as you can see from the plan it is adjacent to wetlands. Connor reports that the other pond (which isn't part of Schilsky Office Park) has a similar outlet issue. I haven't looked into which site that is yet. We revised the Stormwater Plan for Schilsky Office Park (copy attached) to better depict the drainage path from Lot 10 to the pond. That swale was also "re -shaped" and seeded/mulched in conjunction with the pond maintenance work. 3. Initialed the offsite supplement as requested. I was able to get through the ice yesterday. Pond does NOT have adequate depth, at least in the forebay (only area I checked) and there are also some erosion issues along the north slope that must b? fixed before I am comfortable certifying it. am contacting the Owner and original contractor today in hopes of getting these items addressed ASAP. Hopefully, when I return from my "buniness trip" next week, all will be complete and I will reinspect (hopefully it will be warmer too). Ms. Naugle If I was you, I wouldn't even waste my time doing a "compliance inspection" at this time. As I stated above, there are 'issues". I would wait for a couple weeks. I can't believe that the ice on the pond is so thick you can't easily break through it. It can't be more than a 16t" of an inch thick, and if you can't bust through that, well .... we're not in Buffalo. It'll be 50 degrees next week. The longer you delay in sending us the certification, the longer that permit for Lot 11 doesn't get issued. The Division does not have the necessary surveying equipment to measure pond depth or verify areas or elevations. That's part of the engineer's responsibility to check when the pond is certified. Our requirement to inspect the offsite pond system is an internal mandate as part of the permit review process. Our compliance inspection is not part of your certification process. Per the terms and conditions of the permit, and Stormwater Regulation 15A NCAC 2H.10080), which stipulates the following: "Upon completion of construction, the designer for the type of Stormwater system installed must certify that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by the Division and complies with the requirements of this Section prior to issuance of the certificate of occupancy." As of this date, our records indicate the required designer's certification has not been received. An offsite application has been received from the owner of Lot 10. The permit for Lot 10 cannot be issued until the certification for the pond is submitted.
