Dear Dr. Schilsky:
On April 9, 2021, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project, located along Dolphin Street in Jacksonville in Onslow County to
determine the status of compliance with the State Stormwater Management Permit Number SW8 020502 issued
on July 2, 2018. DEMLR file review and site inspection revealedthat the project will be compliant once the
required deed restrictions are submitted.
Please be reminded that it is your responsibility as the permittee of record to submit a completed and signed
Permit Transfer Application Form to the Division of Energy, Mineral and Land Resources 30-60 calendar days
prior to making any of the below listed changes. This form is available on our website at:
a- An ownership change including the sale or conveyance Df the permitted project area in whole or in part.
This does not include the conveyance of subdivided residential lots to individuals which are made
subject to a recorded declaration of covenants and restrictions which contain the statements required by
the stormwater permit;
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association,
subject to the requirements of Session Law 2011-256;
c. Foreclosure proceedings;
d. Filing for Bankruptcy;
e. Dissolution of the partnership, corporate entity or LLC.
f. A name change of the owner / permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
Please be advised that, as the permittee, you are required to comply with the terms, conditions and limitations of
the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7, including the operation and maintenance of the permitted stormwater system.

Failure to provide the requested information, or to respond to this letter with a plan of action, including a timeline
to resolve the identified deficiencies, by April 19, 2021, are considered violations of the permit. If the requested
information is not submitted to this office by the due date, then DEMLR staff will re -inspect the site and may
issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance with the
provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set
forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day.

The documentation has been corrected. The attached information shows that SW8 070211 has been fixed. We received
that transfer application, and so I will get that processed. I do see that that one expires in June, and so it will need to be
renewed. The other one, SW8 020502, is the one that needs to be fixed as you discussed with Connor.

Dear Dr. Schilsky:
On February 3, 2021, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project, located along Dolphin Street in Jacksonville in Onslow County to
determine the status of compliance with the State Stormwater Management Permit Number SW8 020502 issued
on July 2, 2018. DEMLR file review and site inspection revealed that the site is not in compliance with the terms
and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report"
attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. There is a potentially broken pipe causing a sink hole draining to the pond.
2. Sediment needs to be cleaned out of the pond.
3. The pond is sloughing at the entrance.
4. The slopes are eroding.
5. The outlet pipe is causing severe erosion.
6. The recorded deed restrictions are needed for the file.

Comment: The deficiencies identified during the 02/07/2018 inspection appear to have been corrected. However,
soils lacking vegetation are present on the NW bank of the detention pond opposite the outlet structure
and have the potential to become erosive. These areas should be monitiored and repaired as
necessary. The height of terminal end of the outlet structure appears to have the potential to cause
erosion and should be monitored A routine inspection will be conducted in approximately 9 -12 months
to ensure compliance with the operation and maintenance conditions of the permit.

Dear All Parties:
On January 18, 2018 the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) accepted a State Stormwater Transfer Application for SW8 070121. The package
also included an application to modify SW8 070121 which will be formally accepted for review once the
Transfer has been completed. In support of the permit transfer, the Division inspected both SW8 020502
and SW8 070121 on February 7, 2018. A letter requesting additional information was mailed on March
13, 2018, and a response was received on March 26, 2018. The following items are needed. Please
respond by May 2, 2018.
1. SW8 020502, Schilsky Chiropractic Center:
a. Maintenance Needed:
i. 3/13 (DEMLR): Please maintain the pond per the enclosed O&M Agreement.
(This agreement begins on Page 2 of the Wet Pond Supplement.) The side slopes
of the pond lack vegetative cover necessary to prevent erosion and rills are
present of the western'side slopes of the pond. The outlet pipe placement has
resulted in a large scour hole, extremely erosive slopes and potential sediment
damage to the adjacent wetlands. The presence of rills and scour hole at the
outlet pipe appear to be the result of lack of maintenance.
ii. 3/23 (Engineer): Dr. Schilsky has contacted his contracted pond maintenance
firm to address the noted deficiencies we will notify your office when that work
is complete.
iii. 4/18 (DEMLR): Once the work is complete, please submit photos for the file.

b. Minor Modification & Certification:
i. 3/13 (DEMLR): An inlet pipe not shown on the approved plan was observed
depositing into the forebay of the pond. Please apply for a minor modification to
show the additional inlet pipe on the plan. (If the upcoming modification for SW8
070121 will impact the SW8 020502 plans, then please include those
modifications as well.) The certification from August 15, 2013 is still valid for
the current configuration. Please submit a partial certification showing that the
new inlet pipe is installed to match the upcoming minor modification.
ii. 3/23 (Engineer): The HDPE pipe to which you refer is "dormant" (not presently
in use). We can only speculate that it was installed by the contractor to possibly
facilitate serving the vacant lots across the street when/if they ever develop. If
necessary, we can certainly modify the permit now as requested, however from
our perspective, it makes more sense to wait until those lots are developed, as
additional Permit Modifications would be necessary at that time. Please consider
and advise.'
iii. 4/18 (DEMLR): If the pipe is not in use, is not currently needed, and you do not
want to modify the permit now, then I recommend that you plug the pipe. If it is
ever needed, then they can modify the permit to add it to the plans, and unplug it
at that time.
Master Table. The master table has been updated to clarify differences in lot numbers
that are discussed in the next section of the letter. (It also clarifies some other items that I
found during the review that are unrelated to the issue at hand, but will simplify things
for you as you develop tracts in the future). Please review this table, and provide
feedback if necessary. I will issue a permit correction to your permit, SW8 020502,
concurrently with the offsite permit in review, SW8 070502. You do not need to apply
for the correction or take any other action.
2. SW8 070121, Lot 1A of Schilsky Chiropractic Center:
a. 3/13 (DEMLR) & 3/23 (Engineer): After discussions with your engineer, I understand
that the plans for the master permit, SW8 020502, show Lot 1A as covering the area
occupied by what is legally two lots, Lot lA and Lot 1B. He reports that both lots are
under common ownership and there is no intent to convey either lot to a third party. The
intent of the SW8 070121 modification is to drain 43,746sf of impervious area to SW8
020502 (which is the maximum amount allocated to this lot by that permit), and 7,875sf
to an onsite stormwater wetland for a total of 51,621 sf of impervious area on the lot.
b. Deeds: The 2008 deed for "Lot lA", a 2.04ac lot has been submitted (BK3005/PG707-
708). Since this lot has since been subdivided into two lots, Lot lA and Lot 1B, please
submit the two deeds showing that Covert Operations of Jacksonville, LLC owns both
lots. (This entity is the incomingpermittee for the permit transfer)

c. Deed Restrictions: Deed restrictions for a 2.04ac "Lot 1A" (which is now Lots IA and
1B) are recorded in BK3043/PG426-428 allowing 43,746sf of impervious area total.
i. Deed restrictions are required for master"permits (such as SW8 020502) to limit
impervious area for subdivided lots prior to the master permittee selling lots to
third parties. This ensures that the water draining from all of the lots in the
subdivision will "fit" in the pond once the subdivision is built -out. When a third
party buys a lot from the master permittee, deed restrictions should already be in
place. Then, the new owner of the lot gets their own. "offsite" permit (such as
SW8 070121) to drain their water "offsite" to the master permittee's pond. The
offsite permit then becomes the vehicle by which DEMLR regulates activity on
the specific lot. Since I understand the two lots are already owned by the entity
that will become the offsite permittee per the pending transfer, and that entity has
applied for an offsite permit which will restrict the lot's impervious area to
51,62Isf there is no need to deed restrict the lot to either 43,746 or 51,621 sf.
(Please note that if either lot is eventually sold, the permit does not transfer with
the land. You would have to transfer this permit to the new owner, and the new
owner would have to comply with the maximum impervious area under this
permit.)
ii. Please be advised that there is an impervious restriction recorded in case that
complicates any other aspects of your development.
d. Certification: The current permit is required to have been built in substantial
conformance with the permit (see page 7 of the permit for the certification checklist). I
do not see that this form has been submitted. Technically, a certification is a requirement
for a permit transfer because permits must be in compliance to transfer and it has to be
certified to be in compliance. However, since you have a pending modification for the
project it does not make sense to certify the project in its current state and then shortly
thereafter modify the permit causing it to have to be certified again. I recommend
submitting a signed statement from the incoming permittee, Covert Operations of
Jacksonville, LLC, attesting that they understand that they are accepting a permit transfer
for a project that has not been certified and that they understand they will be responsible
for certifying the project once it has been transferred to their name and constructed in
configuration permitted under the upcoming modification.
e. Drainage Area Line [.1042(2), .1042(2)(g)(iv), .1042(3)(b), and .1050(1) to support
.1042(2)(a)(iv)]: Please provide 2 copies of a signed, sealed, and dated drainage area
map supporting the identified drainage areas and associated built -upon areas presented in
the application documents.
f. Natural Features [.1042(2)(g)(iii)]: Please provide the boundaries of all surface waters,
wetlands, regulatory flood zones, protected vegetated setbacks, and protected riparian
buffers, or a note on the plans that none exist.
g. 10yr Peak Flow [per .1003(5)]: Will the project discharge at the 10yr peak? If so, please
demonstrate that this storm event will not cause erosion downslope of the stormwater
outlet discharge point.
h. Project Name: The transfer application lists the project name as "Lot lA Randy Schilsky
& wife Suezen Division — Dr. Shanie Covert." Is this the intended project name?

On January 21, 2011, Angela Hammers of the Wilmington Regional Office of the
Division of Water Quality (DWQ) inspected Schilsky Chiropractic Center in Onslow
County to determine compliance with Stormwater Management Permit Number SW8
020502 issued on April 4, 2008. DWQ file review and site inspection revealed that the
site is compliant with the terms and conditions of this permit. Please find a copy of the
completed form entitled"Compliance Inspection Report" attached to this letter.
Please be advised that you are required to comply with the terms, conditions and
limitations of your Stormwater Management Permit under Title 15A North Carolina
Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including
operation and maintenance of your permitted stormwater system.
If the project has changed name, ownership or mailing address, a formal change of
name/ownership form must be submitted to DWQ within 30 calendar days detailing the
change. Please provide the name, mailing address and phone number of the person or
entity that is now responsible for this permit.

On November 23, 2010, Angela Hammers of the Wilmington Regional Office of the Division of
Water Quality (DWQ) inspected the Schilsky Chiropractic Center in Onslow County to determine
compliance with Stormwater Management Permit Number SW8 020502 issued on October 18,
2002 and modified on April 4, 2008. DWQ file review and site inspection revealed that the site
is not compliant with the terms and conditions of this permit. Please find a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter, which
summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Completely collect and direct all stormwater from rear parking lot of Chiropractic Office
(Lot 2-A) to Pond No. 1 as approved on stormwater plan.
2. Address the addition of the gravel parking lot extension by permit modification/revision
or remove per the approved stormwater plan.
3. Perform maintenance of Pond No. 1 to bring the pond into compliance and in good
working order.
4. Create a schedule for inspection and on -going maintenance of the stormwater system
according to the signed Operation &Maintenance Agreement (enclosed).
NOTE:
Lot 1 located at the north side of Dolphin Drive appears to have wetland area filled down to
halfway through the cul-de-sac.
Please inform this Office in writing before January 4, 2011, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the
assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by January 4, 2011 then DWQ staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.

Inspection Summary:
The following items were found in the " common plan " during inspection:
1. SW8 020502, Lot 2-A, SE corner of Dolphin Dr and Marlin Dr., parking lot runoff is not routed to stormwater pond.
The SE side of parking lot drains to wetlands and not the pond. Reroute stormwater runoff to permitted catch basin
nearby. Located just north of east end of Tarpon Trail.
2. SW8 070937, Lot 11, Neurophysciatric, corner of Tarpon Trail, swale is completely rocked. Ok since high density.
3. SW8 070211, master plan, swale on south side of property is overflowing and not routed to pond. The top of berm
located adjacent to lot 6 is higher than the swale bank and runoff is bypassing the pond. Lower top of berm and maintain
swale bank.
4. SW8 070211, master plan, swale on south side of property is overgrown with cattails, etc... Maintain vegetated swale.
5. SW8 070211, master plan, pond side slopes are eroding and not vegetated. Maintain pond.
6. SW8 070211, master plan, pond outlet is not covered with maximum 6" openings. The grating on large outlet is'/
open underneath. Ok per permitted plans.
7. SW8 070211, master plan, pond outlet is not accessible to verify draw down.
8. SW8 070211 Chalky Office Park —the Deed Restrictions recorded lot BUA for SW8 060506 that is filed in SW8
070211. DR document Article VIII(E), recorded last on 9/26/06. The values are correct for SW8 070211. Please submit
recorded deed restrictions amended with the correct permit no. SW8 070211.
9. SW8 020502, Lot 1, north side at east end of Dolphin Drive. Wetland has been partially filled down to halfway
through the cul-de-sac. Notified 401(Joanne).
10. SW8 020502, between Lot 1 [First Citizens] and Lot 1-A [Dental office], the road has gravel as stormwater drain.
Maintain system so that sediment, gravel, or debris does not enter the stormwater system and prevent full capacity.
11. SW8 020502, master plan, pond is overgrown with cattails and vegetated shelf is not maintained. Maintain pond.
12. SW8 020502, master plan, pond is not accessible — no embankment. Pond is fenced in. Cannot estimate depth.
Request PE certification.
13. SW8 020502, master plan, pond outlet is not accessible, but the large riprap on the outlet appears to have no
negative impact to wetlands on outlet from a distance view.
14. SW8 020502, master plan, observed metal debris along slope and in wetlands. Maintain stormwater system and
remove debris.
15. SW8 020502, master plan, sediment in street along Dolphin Drive heading toward stormwater system. Lot 2
grading in progress. Curb inlet back washed and sediment is leaving lot. Maintain system so that sediment, gravel, or
debris does not enter the stormwater system and prevent full capacity.
