Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEN LR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this permit references DEMLR as the Division responsible for issuance of the
permit. .
The Wilmington Regional Office received a complete, modified State Stormwater Management Permit
Application for Schilsky Chiropractic Center on December 7, 2016. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater Regulations
set forth in Title 15A NCAC 2H.1000. We are forwarding modified Permit No. SW8 020502 dated
February 24, 2016, for the construction, operation and maintenance of the BMP's and built -upon area
associated with the subject project.
This permit shall be effective from the date of issuance until October 16,2016 and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the conditions listed in this
permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions,
certification of the BMP's, procedures for changing ownership, transferring the permit, and renewing the -Ar
permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to certify the BMP's, to transfer the permit, or to renew
the permit, will result in f dure compliance problems.
The following modifications are included and covered by this permit:
1. This permit originally approved 58,669 square feet of built -upon area for the First Citizen Bank
based on the information presented in Permit No. SW8 010522. However, it was later discovered
that Permit No. SW8 010522 was for a First Citizens Bank located several miles down the road.
The First Citizens Bank associated with this project was permitted under SW8 000937, which
allocated 60,755 square feet of built -upon area. This modification adds 2,086 square feet of built -
upon area to the of1she lot for the First Citizens Bank as well as corrects the permit number
associated with the Frist Citizens Bank project.
2. The modified permit does not.impose new or different terms, it merely restates some of the
previous terms to provide you with a better understanding of your obligations under the permit.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process
at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1) wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwaterrules') the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land
Resources (hereafter referred to as the Division or DEMLR) and considered a part of this
permit.
This permit shall be effective from the date of issuance until October 16, 2016 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.8 of this permit. The subdivision is permitted for four
outparcels and one offsite area (rirst.Citizens Bank). Each of the outparcels is limited
to a maximum amount of built -upon area as indicated in Section 11.14 (f) of this permit.
The offsite area (First Citizens Bank) is limited to a maximum of 60,755 square feet of
built -upon area.
3. Approved plans, calculations, supplement forms, operation and maintenance
agreements and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
4. The stormwater control measure has been designed to handle the runoff from 329,610
square feet of impervious area. The runoff from all built -upon area within the permitted
drainage area of this project must be directed into the permitted stormwater control
measure.
5. The drainage area will be limited to the amount of built -upon area indicated in Sections
1.4 and 1.8 of this permit, and per approved plans. This permit does not provide any
allocation of built -upon area for future development.

6. A vegetated filter strip is not required for this pond
as it has been designed for a 90%
total suspended solids removal efficiency.
7. Prior to the discharge of stormwater runoff from any lot into the approved stormwater
system, the permittee shall ensure that the owner
of the lot has obtained a separate
Offsite Stormwater Management Permit from the Division.

must be provided and maintained at the design condition.

II. SCHEDULE OF COMPLIANCE
No person or entity, including the permittee, -shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has
approved of the revised plan.
2. The permittee is responsible for verifying that the proposed built -upon area for the
entire lot does not exceed the maximum allowed by this permit. Once the lot transfer is
complete, the built -upon area may not be revised without approval from the Division,
and responsibility for meeting the built -upon area limit is transferred to the individual
property owner.
3. If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed built -upon
area. Any approvals given by the Board do not relieve the homeowner of the
responsibility to maintain compliance with the permitted BUA limit.

4. The Director may notify the permittee when the permitted site does not meet one or
more, of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
5. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
6. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The construction of any future BUA listed on the application.
7. The Director may determine that other revisions to the project should require a
modification to the permit.
8. All stormwater collection and treatment systems must be located in either public rights -
of -way, dedicated common areas or recorded easements. The final plats for the
project will be recorded showing all such rights -of -way, common areas and
easements, in accordance with the approved plans.
9. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately. If the stormwater system is used as an Erosion
Control device, it must be restored to design condition prior to operation as a
stormwater treatment device, and prior to occupancy of the facility.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
11. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at design
condition. The approved Operation and Maintenance Agreement is incorporated by
reference into this permit and must be followed in its entirety and maintenance must
occur at the scheduled intervals.
12. Records of maintenance activities must be kept and made available upon request to
authorized personnel of the Division. The records will indicate the date, activity, name
of person performing the work and what actions were taken.
13. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.

14. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 020502, as issued by the
Division of Energy, Mineral and Land Resources under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded without
the express written consent of the Division.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division.
f. The maximum built -upon area for the four outparcels and the offsite area is as
follows:

This allotted amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front lot
line and the edge of the pavement. Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking
areas, but does not include raised, open wood decking, or the water surface of
swimming pools.
g. Lots within CAMA's Area of Environmental Concern may be subject to a
reduction in their allowable built -upon area due to CAMA regulations.
h. All runoff from the the lot must drain into the permitted system. This may be
accomplished through providing roof drain gutters, which drain to the pond or
street, grading the lot to drain toward the street or directly into the pond, or
grading perimeter swales and directing them into the pond or street. Lots that
will naturally drain into the system are not required to provide these measures.
i. Built -upon area in excess of the permitted amount will require a permit
modification.
J. Each lot within the subdivision whose ownership is not retained by the
permittee, must submit a separate Offsite Stormwater Management Permit
application package'to the Division and receive a permit prior to any
construction on the lot.
15. A copy of the recorded deed restrictions must be submitted to the Division within 30
days of the date of recording the plat, and prior to selling lots. The recorded copy must
contain all of the statements above, the signature of the Permittee, the deed book
number and page, and the stamp/signature of the Register of Deeds.
16. Prior to transfer of the permit, the stormwater facilities will be inspected by Division
personnel. The project and the stormwater facility must be in substantial compliance
with all permit conditions. Any items not in substantial compliance must be repaired,
replaced or restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.

17. A' decorative spray fountain will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
C. The failing water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for the fountain's pump is based on the permanent
pool volume. The maximum pump power for a fountain in this pond is 1/4
horsepower.
18. Access to the stormwater facilities for inspection and maintenance shall be maintained
via appropriate recorded easements at all times.
III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division at least 60 days prior to any one or more of the
following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made subject to
the recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
2. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the. conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.
3. Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the Stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.
4. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
Additional or replacement stormwater management systems shall receive a permit
from the Division prior to. construction.
6. The permittee grants DEMLR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.

7. The permit issued shall continue in force and effect until modified, revoked, terminated
or renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
9. Unless specified elsewhere, permanent seeding requirements for the stormwater
control measure must follow the guidelines established in the North Carolina Erosion
and Sediment Control Planning and Design Manual.
10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules and regulations contained in Session Law 2006-246, Title
15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11. The permittee shall submit a permit renewal application request at least 180 days prior
to the expiration date of this permit. The renewal request must include the appropriate
application, documentation and the processing fee.

BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and

In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring

On December 15, 2000, the Wilmington Regional Office of the former Division of Water Quality
issued a high--density-wet-detention -pond-permit to Thomas-B. Morriss -VP --of First -Citizens Bank; -for
the subject project. It has come to the attention of the Division that on October 18, 2002, this
particular project was intended to be included as offsite drainage area in the Schilsky Office Park
permit (SW8 020502). This allowed the Bank's previously permitted wet pond to be filled in because
the runoff from the Bank's built -upon area would be treated in the Schilsky Office Park pond.
Due to a clerical error, the Bank's existing permit was not corrected at that time to reflect a change in
the regulated activity from high density wet detention to Offsite. This error was recently discovered
when a letter requesting that the permit be renewed was sent to the Bank. Further investigation
revealed that the permit application for the Schilsky Office Park referenced the wrong permit number
for the First Citizens Bank of SW8 010522.
The First Citizens Bank actually covered by the SW8 010522 permit is located several miles east of
your location at 302 Western Boulevard, near White Street. To further complicate matters, the SW8
010522 Bank permit allocated a maximum of 58,669 sf of Built -upon area (BUA), which is the
amount that was covered in the Schilsky permit as part of the permitted Offsite BUA treated in that
pond. However, the correct permit for the First Citizens Bank located at 2555 Western Boulevard is
SW8 000937. Unfortunately, the SW8 000937 permit allowed a maximum of 60,755 sf of BUA to be
constructed. Since the Schilsky permit only covered 58,669 square, the difference of 2,086 square feet
needs to be addressed. Please be advised that on December 7, 2015, the Division received a modified
permit application for Schilsky Office Park to account for that additional 2,086 square feet of BUA.
The original bank permittee, Mr. Thomas Morris, was advised of this situation in a June 12, 2015
letter sent by the Division, but he has not responded to date. The Division is concerned that either the
mailing address is no longer valid, or Mr. Morris has retired or moved on. In either case, the Division
would appreciate it if the Branch Manager could forward this letter to the appropriate person within
the First Citizens Bank hierarchy who has the authority to handle situations with government -required
permits. The Division is also requesting that the First Citizens Bank individual acknowledge these
events and authorize the Division to change the regulated activity for SW8 000937 to "Offsite" so
that the permit can be reissued. Please respond to this letter by February 15, 2016.

We would NOT require that the pond be redesigned under average depth. The source of this error is unknown, so it
would be unfair to penalize the permittee for that.

Success .... I think (see attached).
It appears possible to increase the total BUA associated with First Citizens to 60,755....... with adequate Surface Area and
Treatment volume in the existing pond.
BUT, bear in mind the original pond design was prior to the Average Depth Policy Change....... and is based on Max Depth
(6'). But, as that was the accepted design premise at the time ...... I presume it is acceptable to base this modification on
the same basis?
Also, I may need some additional help....

I want to try and get my hands on my original POND CALCULATIONS (I do not have them here, but perhaps Betty at John
Pierces office has a copy).
If, per chance, that design has enough "slack" (for lack of a better word.... perhaps "excess capacity" is a better words
choice....... the SIMPLY and QUICK thing to do MAY be so simply rework the Pond Calcs to take advantage of previously
unused design capacity. If you agree with that SIMPLE strategy.... then I will try and get my hands on the design

It was a mix-up in the permit number for the Bank. At the time Schilsky Office Park was permitted, the Bank already
existed and had its own pond. On our database, there are 2 First Citizens banks located on Western Boulevard.
Apparently, the permit associated with the Bank at the other end of Western Blvd. (SW8 010522) was incorrectly
identified as being the permit for the bank within the Schilsky Office Park, which had a BUA of 58,669 sf. Who made this
determination (Division or consultant) is not clear in the file. This incorrect existing BUA amount was simply drafted over
into the Schilsky permit as being Offsite.
However, when you look at the approved plans for SW8 010522 it is immediately clear that the Bank under that permit
is not located in the Schilsky Office Park. The correct permit number for the existing Bank in Schilsky Office Park is SW8
000937 which has 60,755 sf of permitted BUA associated with it. If you want to take a look at these files and the
approved plans, please set up a file review appointment through Cameron.
The only wriggle room I see is that perhaps the 60755 sf number includes the entrance road into the Office Park since it
was shown on the approved 000937 plan, and that the same entrance road may have been counted again as "street"
area or "existing" area in the 020502 permit. If you can confirm what the actual BUA amount is for the 000937 Bank,
using the approved 000937 plan, and excluding the entrance road, that would help.

Do you know the source of that 60,755 sf figure? While I don't think we (Crystal Coast Engineering) did the Storwmater
Plan for that site ..... the information in our files (and the ACAD based drawing files on the computer) indicate that BUA on
the First Citizens tract is only 58,669 sf.
Any insights you can provide is appreciated. As you know, attempting to RECONCILE BUA on these older
permits..... particularly when multiple property owners and engineers are involved ....... is terribly difficult (and
frustrating).

Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they
are modified. Please note that this letter references DEMLR as the Division responsible for
issuance of the permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any
development approval issued by the former Division, of Water Quality under,Article 21 of Chapter
143 of the General Statutes, which was current and valid at any point between January 1, 2008,
and December 31, 2010. The law extended the effective period of any stormwater permit that was
set to expire during this time frame to three (3) years from its current expiration date. On August 2,
2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four
(4) years extension. Accordingly, the subject permit shall now be effective from the date of
issuance until October 18, 2016. Please retain a copy of this letter with your permit.
Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be
submitted 180 days prior to the expiration date of the permit and must be accompanied by- a
processing fee, which is currently set at $505.00. Please note that you will need to complete and
submit a renewal application prior to April 18, 2016. If the property covered by the permit has
been/will be sold or legally transferred to another entity or if the project name or permit holder has
changed its name and/or mailing address, it is your responsibility as the permittee to submit a
completed and signed Name/Ownership change form to DEMLR at least 30 calendar days prior to
making the changes. Both the renewal application form and the permit transfer forms are available
on our website at: http://Portal.ncdenr.orn/web/ir/state-stormwater-forms docs.
Please note that the subject permit will also need to be corrected and modified. The 2002 permit

This letter is a follow-up to the letter the Division sent you dated June 16, 2016. The Division has
not received a response from you regarding the concerns outlined in that letter. Please note that
^er echedule of Compliance Condition II.14 of your permit, if the Director notifies you that the site
does not meet one or more of the minimum requirements of the permit, then you are required to
provide a written time schedule for modifying the site to meet the minimum requirements within the
time frame specified in the notice. You must provide a written time schedule for addressing the
permit compliance issues outlined in this letter by November 16. 2016. If you do not provide the
requested written time schedule by that date, then per NCGS 143-215, you may be assessed a
civil penalty of not more than $25,000 for failing to act in accordance with the terms, conditions or
requirements of the stormwater permit.
Furthermore, your failure to respond to the Division's letters could also be considered as
abandonment of -the permit, which may allow the Director of the Division of Energy, Mineral and
Land Resources to revoke the permit for just cause as set forth in NCAC 02H.1011. Revocation of
the permit will mean that the project is no longer covered by a valid stormwater permit and
therefore, the local government will not be able to issue any building permits until a new permit is
issued. Ifa new permit has to be issued, the existing wet ponds will need to be redesigned and
retro-fitted to meet current design standards.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 020502 to Randy M. Schilsky
and Schilsky Chiropractic Center for a High Density project on October 18, 2002, with a modification issued April 4, 2008. This
permit expires on October 18, 2012. Per 15A NCAC 21-1.1003(h) (the stormwater rules), applications for permit renewals shall be
submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at
$505.00. If this is still an active project please complete and submit the enclosed renewal application prior to April 18, 2012. If
this project has not been constructed and a permit is no longer needed, please submit a request to have the permit.rescinded. If
you have sold the project please provide the name, mailing address and phone number of the person or entity that is now
responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the
property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system,
a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to
certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with
your permit renewal request and processing fee. A copy of the certification form is enclosed for your convenience.
You should be aware that failure to provide the Designer's Certification and the operation of a-stormwater treatment facility
without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action
including the assessment of civil penalties of up to $10,000 per day.

Dear Ms. Hammers,
As indicated in your past inspection report, the following responses to deficiencies is
forwarded for your review.
1. Request that we completely collect and direct all storm water for the rear parking lot of
Chiropractic office on lot 2A as approved on storm water plans. As previously reviewed and
pictures forwarded the water had been redirected to the catch basin on the plan behind the
dumpster pad at the rear of the Schilsky Chiropractic office; however, you felt that the
redirection of the storm water was still allowing for seepage over the rip rap swale that was in
place. Since this point I have added significant amounts of small 57 stone to prevent storm water
seepage.
2. As it relates to deficiency item number two, you commented about the gravel parking
lot extension to the existing parking area that was not noted on the original storm water plan.
Please be reminded as per our discussion that this gravel parking lot is no longer owned by me
and I have no control over this property and any attempt to remove this gravel parking lot
extension could potentiate legal ramifications against me from the current land owner. I am
aware however, that he is currently preparing a site plan and storm water plan for the property
and will be clearing that property as soon as this storm water compliance concern is resolved. It
is my understanding then that you will accept his modification permit request and he will be able
to move forward with his site work which will ultimately remove the existing gravel parking lot
that is on his property.
3&4. In regards to restoring pond number one, which is located on lot four, back in to
compliance and good working order. This has taken place and all grades have been restored:
stabilization, matting, and seeding have been put in place. Repair of the berm between the
forbay and retention pond has occurred. Depths have been assessed and are within normal limits
and the pond has been put under contract with Coastal Retention Pond Services and Mr. Tim
Early to maintain the pond and keep it in good working order. This therefore also resolves item
four which requested that we create a schedule for inspection and on -going maintenance of the
storm water system. According to the signed operation and maintenance agreement enclosed,
Mr. Early has prepared that document and is currently active on maintaining the pond inspection
schedule.
Lastly, you had documented a concern related to the wetland area half -way through the
cul-de-sac being filled. I have submitted documentation from John Pierce to the US Army Corp
of Engineers which validates the approval to fill that wetland area back in 2004. All
documentation is attached. If I can be of any further assistance in this matter please do not

Monthly Maintenance Agreement
Coastal Retention Pond Services ( CRPS ) Agrees To Provide The Following Services To Fulfill
This Maintenance Agreement Between Schilsky Office Park POA 118 Cobia Ct Lot 5 Jacksonville
NC & CRPS
1. Inspect 1 - single fore bay storm water treatment facility at least monthly and after all 1.5" or major rain
events to ensure the proper operation of this treatment facilities and to fulfill your obligation to Local,
NC state and Federal government permit requirements.
2. Perform a fall cutting of the aquatic plants inside the water column to meet the required NC state
specifications. This includes cutting woody root vegetation from the edge of the slopes and water column
of this treatment facility. Provide trapping and eradication of any ongoing Nutria and Muskrat infestation.
3. Mow the embankment slopes vegetation (grass) once a month or as we deem necessary to meet the
required vegetation height set by NCDENR-DWQ. (This covers the vegetation inside the fence from
the water line to the top of the embankment slope and 4 feet away from the outside of the fence.)
4. Report and provide recommendations on any maintenance or repair items that Coastal Retention Pond
Service deems noncompliant and necessary for this storm water treatment system to operate as per the
approved design drawings and meet the accepted permitted agreement issued by NCDENR-DWQ.
5. A separate bill and contract will be presented for approval for any work performed by this firm which is
not addressed in this contact. Approval in writing shall be obtained from the financially responsible
person prior to any services being performed by this firm.
6. Treat and control aquatic vegetation and algae inside this treatment facilities. This could include the
use of dyes, herbicides, skimmers or algaecides to accomplish this. The financially responsible
person will notify this firm if the effluent from this treatment facility is being or will be used for
irrigation purposes.
7. Provide monthly maintenance and inspection reports to the financially responsible person
and/or management team. These reports will satisfy the monthly requirements placed on the financially
responsible person as per NCDENR DWQ permits. The client will have possession of these reports
and will be required to maintain a log book for this treatment facility to be available for
inspection upon request by enforcement officials. Coastal Retention Pond Service will keep in our
possession a copy of these reports on digital disc for the duration of this contract.
8. Report immediately to the responsible persons via physical contact or phone concerning any item or
issues that Coastal Retention Pond Service accesses as a potential liability or loss to the financial
stability of the Corporation by posing a threat to the environment or community adjacent to this
treatment facility. Coastal Retention Pond Service will be saved and held harmless if we do not detect
any liability.
9. To be available for consultation to meet with the financially responsible persons and the Local, State
and Federal enforcement officials.
10. Remove trash from the banks, water column surface, trash rack and the inlet and outlet structure of
this treatment facility. This does not include items such as flushing pipes, closed areas, catch basins or
sediment removal. This also does not include large amounts of debris due to natural disasters or illegal
dumping.
11. It is the responsibility of the financially responsible person to keep this facility accessible and free of
obstruction for tractors and all necessary equipment to perform the contractual duties. Failure of the
client to provide accessibility to this treatment facility does not negate the monthly contractual fees
due to Coastal Retention Pond Service. We will install a common Word accessible lock on the gate.
12. Coastal Retention Pond Service will perform such duties and make recommendations as to assure the
efficient operation of this treatment facility in accordance with the permitted requirements established
by NCDENR-DWQ.
The undersigned agrees to all conditions of this maintenance agreement and agrees to pay (CRPS) the
sum of 80.00 for the initial consultation (first month) and the sum of 80.00 per month for a
period of 11 months with a 10.00 late charge on any payment received later than 30 days after the invoice
date. The undersigned also agrees to provide any documentation to this firm i.e. ( plans, engineers
drawing, existing permits, and any other pertinent documents pertaining to the above BUT facility). This
