On December 5, 2014 the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG060107, In accordance with your request,
Certificate of Coverage Number NCG060107 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

of NCDENR DWM Hazardous Waste Section and EPA Region 4. In support of this work, a 90-day-RCRA stora-ge area was established
in the event that hazardous waste was generated during the excavation. The excavation was completed in September 2014 and the
90-day area closed. Thus industrial activities have ceased,

In response to your renewal application for continued coverage under stormwater General Permit NCG060000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG060000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part 111, Section E). Also, please note that Tier 3 Actions in Part it of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.orp/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the stormwater Permitting Unit's website with the new General Permit. Please visit
http://portal.ncdenr.org/web/wq/ws/suLpdessw (click on 'General Permits' tab) to review that information
for your specific General Permit carefully.

Some of the changes include:
Part ll:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
+ Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section 0: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Boundary Change Associated with Footprint Reduction Activities
Dear Mr. Pickle:
This correspondence is provided to update you in regard to changes to GlaxoSmilhKline's South
Campus facility located at Cornwallis Road in Research Triangle Park, and the subject.
Stormwater permit. Per my June 22, 2012 email and as James Wellons of Hart & Hickman
discussed with you last week, GlaxoSmithKline (GSK) was issued the subject stormwater permit
due to the South Campus' status as a RCRA Treatment, Storage, or Disposal (TSD) facility, as
two hazardous waste storage pads were operated at the site. Both pads were const.ructerf with
roofs, one wall and associated louvers on the remaining three sides to deflect precipitation; and
internal trench drains that did not discharge from the pads but, rather, were emptied of any
accumulated fluids upon occurrence, with containerization and disposal of the fluids based on
waste characteristics.
GSK's South Carrtpus, aS it existed when the subject permit was issued, is shown in attached
Figure ROOCDV001_A. Property boundaries are shown in blue. The South Campus included
the North Complex, at 3029 East Cornwallis Road, where the two hazardous waste storage pads
were located (north of Cornwallis Road, as shown in attached figure STM-01); and the Main and
South Complexes, located at 3030 East Cornwallis Road (south of Cornwallis Road, as shown in
attached figures STM-02 and STM-03, respectively.)

On June 18, 2012, GSK sold the Main and South Complexes to a new owner/operator. Thus
these properties are no longer part of GSK's South Complex, which is now comprised solely of
the North Complex, at 3029 East Cornwallis Road. Figure STM-01 accurately reflects the
revised extent of GSK's South Campus, which is now limited to the North Complex property at
3029 East Cornwallis Road, and the related stormwater outfalls which were identified at this site.
Activities at the South Campus have changed greatly as well. GSK vacated the South Campus in
2011 and all pharmaceuticals -related activities ceased. Demolition of building structures on the
Q North Complex was initiated in early 2012. In 2012 GSK completed closure of the two
\ hazardous waste storage pads located at the North Complex, and submitted a regU ' - . - 9 W�

Impact of GlaxoSmithKline Footprint Reduction Activities
NCDENR Division of Waste Management to remove the site's TSD status. The storage pads
have been partially dismantled and are scheduled for demolition in 2012 as well.
However, GSK retains responsibility for remediation of soil and groundwater contamination at
the North Complex which was caused by a previous property owner. Remediation activities are
ongoing and, at least for the next year, GSK plans to maintain a 90-day RCRA storage area as
necessary to manage excavated soils. At this storage area, it is anticipated that remediation-
derived wastes (e.g., excavated soils) will be temporarily staged in closed containers, atop
secondary containment pallets; or in covered roll -off containers; until information sufficient to
support off -site disposal is available and such disposal is approved by the disposal facility.
Much of this information has been obtained in advance of the actual excavation, with the intent
of obtaining disposal facility approvals in advance of the actual excavation, where feasible, and
then loading excavated soils directly into vehicles for transport to the disposal facility, with no
onsite storage. However, as a precaution GSK will maintain the 90-day storage area for potential
,.;1 storage of regulated wastes, should this be needed. Thus, although. GSK's Status as a TSD has
changed, it appears that GSK still needs to maintain the subject permit until the 90-day RCRA
storage area is no longer needed.
Please let me know if you have any questions or concerns, or if GSK needs to take additional
action in support of regulatory compliance. As Mr. Wellons communicated, we did not receive a
renewal package for the subject permit, but I requested one via email on Friday, June 22, 2012,
and I anticipate its completion and submittal in the near future, following receipt of the package.

Thanks very much for your assistance to Hart & Hickman in regard to GSK's stormwater questions. Per your discussion
with James Wellons, I'm requesting receipt of a stormwater renewal application package for the subject permit. This
application can be sent to my attention at the address below, or if available electronically, can be provided to my email
address.
The subject permit was issued for GSK's South Campus, located at 3030 and 3029 East Cornwallis Road; this includes the
North Complex, located at 3029 East Cornwallis Road; and the Elion-Hitchings and South Complexes, located at 3030
East Cornwallis Road. Our South Campus has been the focus of footprint reduction activities at GSK's Research Triangle
Park campuses. In 2011, all staff were relocated from the South Campus to other GSK RTP locations. On June 18`', 2012,
the Elion-Hitchings and South Complexes, located at 3030 East Cornwallis Road, were sold to a new owner/operator. At
the North Complex (i.e., 3029 East Cornwallis Road), building structures have been undergoing demolition since early
2012. This includes closure of two RCRA-regulated waste storage pads which were the sole industrial activity at the site.
However, GSK is responsible for remediation of soil and groundwater contamination at the North Complex which was
caused by a previous property owner; our remediation activities are ongoing and, at least for the next year, we will
maintain a 90-day RCRA storage area as necessary to manage excavated soils. Thus, we anticipate a continued need to
maintain the subject stormwater permit.
Per your discussion with James, I'll provide a more detailed letter in the next several days that delineates the areas of
the South Campus which have been sold (i.e., the Elion-Hitchings and South Complexes), and the portion which remains
(i.e., the North Complex). Our SWPPP will be updated accordingly.

On 6/10/201 1, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG060107. In accordance with your request, Certificate of Coverage
Number NCG060107 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Dear Mr. Patterson:
During a recent stormwater inspection by Mr. Mack Wiggins of DWQ we were unable to locate a copy
of correspondence requesting that our South Campus outfall 001 be given representative status with
regard to stormwater quality and sampling requirements. GlaxoSmithKline is in the process of closing
our South Campus; staff have been relocated from the properties, which are for sale; and we are
finalizing plans for demolition of some of the existing structures. I believe that we may have temporarily
mis-filed correspondence that requested/approved outfall 001 as representative of during recent staff
and documentation relocations. We expect to cease operations at the South Campus sometime in 2012,
and will contact the DWQ Stormwater Permitting Unit in advance to request rescission of our permit,
when we can better identify the appropriate time for this.
In order to ensure that we are consistent and compliant with DWQ requirements, I'm requesting DWQ
approval to consider outfall 001 as our representative outfall for the South Campus. This is the only
outfall that could potentially receive impact from industrial activities at the South campus, as it is
topographically downgradient of hazardous waste storage facilities, which represent the only industrial
activities at the South Campus. These storage facilities are constructed and operated to minimize the
potential for such a release, and none have occurred. The remaining South Campus outfalls are not
associated with any industrial activities.

In accordance with your application for discharge permit received on September 28, 1992, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
