Dear Mr, Roberts:
In response to your request for discharge permit received December 21, 2010, the Division of Water
Quality (the Division) hereby transmits this draft permit for your review and comment. Please review
this document to assure your understanding of the permit limits and monitoring conditions, and to
correct errors, if any.
Concurrent with this notification, the Division will solicit public comment on this draft by publishing a
notice in newspapers having circulation in the general Moore County area, as required by the NPDES
Program. Please provide your comments, if any, to me via email [joe.corporon@ncdenr.gov] or write to
my attention care of DENR / DWQ / NPDES Program no later than June 8, 2011.
The Division documents that you have added dechlorination to the subject WWTP per the Division's
Authorization to Construct dated February 5, 2008. We also received the Engineer's Certification form
on September 17 of that year. We understand that you have made no other significant changes to your
treatment system during the previous permit cycle.
Concerning Your Request to Permit Ion -Exchange (IE) Filter Backwash. The Division has included IE
filter backwash for treatment under your WWTP permit. We understand that you propose to continuously
feed an estimated 12,000 gallons per month to the existing WWTP flow, currently averaging about 0.113
MGD (5-year average 2006-2010), or about 10% of the current effluent. The Division has no objections,
and has updated your permit to include parameters and monitoring consistent with the 2007 statewide
WTP policy addressing ion -exchange technology. All added parameters are to be monitored Quarterly
[see permit sections A. (1.) and (2.)].
Warning. We note however the possibility that IE brine or other concentrations might disrupt existing
WWTP processes. Should the proposed IE discharges prove untreatable at the WWTP, the Division may
not otherwise permit an IE discharge to freshwaters of the state. Any remaining discharge alternative for
IE filter backwash will be limited to a non -discharge, or 100% wholly recyclable WTP system.

Other Changes to Your Previous Permit. Considering a relatively poor compliance record over the
previous permit cycle, the Division has increased your monitoring frequency for several parameters (TRC
and Fecal Coliform) from Weekly to 3/Week. For your convenience, we have sorted effluent parameters
by Monitoring Frequency, and have added parameter codes for easy compliance (see A. (1.) and (2.)].
Following the mandatory 30-day public comment period, the Division will review all pertinent comments
and take appropriate action prior to issuing your NPDES permit final. If you have questions concerning

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
AQUA North Carolina, Inc.
is hereby authorized to:
1 begin operating facilities to generate potable -water an6lated wastes [ion -exchange (IE) filter
backwash], and to continue to operate an existing 0.500114GD wastewater treatment system to
treat 100% domestic wastes utilizing:
• manual bar screen
• Aeromod Complete Mix aeration system-

• aerobic sludge digest
located at the Woodlake County; Club on NCSR 1001, east of Vass in Moore County, an
2. after receiving an Authorization to Construct (AtoC) permit from the Division of Water Quality's
(DWQ's) Construction Grants and Loans (CG&L), construct components necessary to upgrade the
wastewater treatment system to 1.00 MGD, and after submitting to DWQ an Engineer's
Certification form and receiving Authorization to Operate,
3. discharge from said treatment works via Outfall 001, a location specified on the attached map, into
Crane Creek [stream segment 18-23-16], a waterbody currently classified WS-III within sub -basin
03-06-14 of the Cape Fear River Basin.

A. (3.) ACUTE TOXICITY MONITORING ONLY - (QUARTERLY)
The Permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the
North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity
In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall
be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent
concentration at which there may be at no time significant acute mortality is 90% (defined as treatment
two in the procedure document). Effluent samples for self -monitoring purposes must be obtained
during representative effluent discharge below all waste treatment. The tests will be performed during
the months of February, May, August, and November.
The parameter code for Pimephales promelas is TGE6C. All toxicity testing results required as part of
this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it
was performed, using the appropriate parameter code. Additionally, DWQ Form AT-2 (original) is to
be sent to the following address:

Test data shall be complete and.accurate anc1-ie a 1l supporting chemical/physical measurements
performed in association with the toic�ty;tnc�dests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must bye measured and reported if chlorine is employed for
disinfection of the waste stream
Should there be no discharge of flatfrom the facility during any month, the Permittee will complete
the information located at the top of the aquatic toxicity (AT) test form indicating the facility name,
permit number, pipe number, county, and the month/year of the report with the notation of "No Flow"
in the comment area of the form. The report shall be submitted to the Environmental Sciences Section
at the address cited above.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may
be re -opened and modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently than required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT
Form submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following
the month of the initial monitoring.

Proposed Renewal Changes
• The Permittee proposes to add WTP ion -exchange (IE) filter backwash to the WWTP
influent; [IE flow —12,000 gal/month; WWTP effluent —0.113 MGD (actual average, 2006-
2010)], therefore IE —10% of WWTP effluent. The Division has therefore added 2007 WTP
Policy parameters of concern for IE technology, including metals and WET Testing at the
WWTP outfall — Quarterly monitoring of all added parameters to be conducted
concurrently with IE influent [see Section A. (1.)]
• Cover letter to warn Permittee that if future IE discharges (high brine) upset the WWTP
biomass, there is no discharge alternative for this technology, save reverting to a non -
discharge or wholly 100%-recycling potable WTP system. Proposed discharges of IE
backwash to freshwater streams may not be permitted under current statewide policy.
• Updated map for renewal; added parameter codes to Effluent Table, A. (1.).
• Poor compliance history prompted CO/FRO to increase monitoring frequency from Weekly
to 3/Week for TRC and Fecal.
BIMS Downloads and Review Results
• Compliance - DMR limit and monitoring violations; Twenty (20) NOVs issued (2008-
2010) for fecal coliform, TRC, BOD5, TP and pH - eight (8) violations for Fecal Coliform
proceeded to enforcement. FRO recommends increase monitoring frequencies [see memo
from Mark Brantley (FRO) to Maureen Scardina (CO/ROC), dated 14Feb2011].
• TOX data Summary — No data to date; added TOX for renewal per 2007 WTP policy [see
