Thank you for discussing this project with me today. Based on our conversation, the proposed ditch repair is not
currently needed as part of the project but is being considered since the contractors are on the site. The ditch is not
being upgraded due of any changes resulting from the currently permitted sites (1-5). So, if this is the case, I would
agree that the bank stabilization activity at Site 6 can be authorized under a separate NWP 13 (non-reporting) as long as
you meet all the NWP regional and general conditions.

We had to add a new permit site for bank stabilization to remove an existing concrete ditch that drains to the stream on
the R-5737 project. There will be 40’ of bank stabilization at the new permit site 6. Division Maintenance has requested
that we remove the existing concrete ditch and replace with a rip rap ditch, since the concrete ditches fail over time.
The rip rap ditch will tie into the stream, and the stream banks will be stabilized to the DOT ROW. Would you prefer
that we modify the existing permit (RGP 50), or could we do this under a non-reporting Nationwide 13? If we need to
modify the existing permit, do I need to utilize the ePCN or is this something we can accomplish via email?
Permit site six is sown on page 16 of 18 on the attached pdf.
For reference, the USACE permit number no. is SAW 2018-01123, and the DWR no. is 2020-1196
