PNG Greensboro Reclamation Project

Dear Mr. Kalish :

On May 14, 2013 , the Division of Water Quality (Division) received your application dated May
10, 2013 , requesting a 401 Water Quality Certification and Buffer Authoriz ation from the
Division for your project. The Division has determined that your application is incomplete and
cannot be processed . The application is on -hold until all of the following information is
received :
1. To better assist the Division in their review, please provide a buffer/stream impact table
that denotes the previous nomenclatur e used for the streams during the field
verification/buffer calls.
2. On March 25, 3013, the Division issued a Notice of Violation for unauthorized impacts to
multiple locations within the proposed project. One area noted for unauthorized
impacts was stream JL2 parallel to White St. The Div ision is unable to determine that
this area has bee n addressed within the current authorization request /NOV r esolution
because of the renaming of features as noted in Item 1 above . Therefore we are unable
to adequately review the proposed resolution at this time . Please provide the
information listed in Item 1 above as well as clear details/plan sheet s f or this area.
3. Per a site visit conducted on June 13, 2013 with re presentatives of S&ME there are
additional streams to be impacted by this project in the vicinity of Sunnybrook Dr.,
Burlington. Please provide an updated stream and buffer impact map, as well as an
updated plan sheets that clear ly depict these impacts.

4. The buffer impact map for Stream 12 indicates mitigation is required . It is unclear to the
Division why mitigation is being proposed in this location. Please clarify and/or correct
the buffer impact table as necessary.

Pursuant to Title 15A NCAC 02 H .0502(e) and 15A NCAC 02B .0267 , the applicant shall furnish
all of the above requested information for the proper cons ideration of the application. If all of
the requested information is not received in writing within 30 calendar days of receipt of this
letter, the Division will be unable to approve the application and it will be returned. The return
of this project will necessitate reapplication to the Division for approval , including a complete
application package and the appropriate fee .
Please respond in writing within 30 calendar days of receipt of this letter b y sending t hree
copies of all of the above requested information to the Wetlands, Buffers , Stormwater –
Compliance and Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699 -
1650.

Ple ase be aware that you have no authorization under the Water Quality Certification Rules for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
