Subject: EXEMPTION from Stormwater Management Permit Regulations
NCSR 2166 Riddle Road
Buncombe County
Dear Mr. Bryan:
The Asheville Regional Office of the Division of Water Quality received your Stormwater Management
Permit Application for the widening of NCSR 2166 Riddle Road in Buncombe County on January 10, 2013.
Based on our review of the submitted project details you do not appear to be proposing a development activity at
this location that would be subject to the stormwater requirements as provided for in Title 15A NCAC 02H .1000.
Because the classification of the unnamed tributary to Ivy Creek is WSII; HQW, these activities are subject to
Title 15A NCAC 02B .0104. Based on the application review, the proposed activities listed below, meet the
requirements of the Title 15A NCAC 02B .0104.
1. Sheet flow on grass shoulders along the roadway.
2. Grassed roadway ditches.
This exemption applies only to the State Stormwater Management Permit for the currently proposed
activity. If at any time in the future, development of any part of this site is planned, as defined in 15A NCAC
02H .1000, or if the proposed activities differ in any manner from what is shown on the plans on file with the
Division, you must submit the project for review of the applicability to the stormwater management rules. If you
