This application package consists of the following documentation: one completed PCN form, three project area maps, and one photo log. Please also find the enclosed journal transfer documentation indicating that payment of the $240 application fee has been transferred from the account of the Division of Parks and Recreation (DPR) to the Division of Water Quality. The proposed project involves the emergency replacement of one broken canal gate in Bee Tree Canal, the replacement of an adjacent canal gate in Bee Tree Canal, and the replacement of one canal gate and culvert in Moccasin Canal. After installation, water control of the canal will be reestablished to maintain the lake level in accordance with the Lake Phelps Management Plan. However, impacts to jurisdictional waters are considered minimal due to the temporary nature of this work and the large hydrological influence of the approximately 16,600 acre Lake Phelps. DPR is concurrently submitting one copy of this permit application to Mr. Josh Pelletier of the USACE Washington Field Office to request a General Permit Verification under NWP 3. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Bee Tree and Moccasin Canals originate in the northeastern and north - central and portion of Phelps Lake respectively, and extend northeasterly from the Lake to the Scuppernong River approximately 7 miles downstream. The two existing canal gates within Bee Tree Canal are located within a wooded Swamp Forest west of the Bee Tree Overlook platform. The existing canal gate in Moccasin Canal is located within a wooded Swamp Forest north of the Moccasin Overlook platform. General land use in the vicinity of the project is primarily recreational within the Park boundaries. General land use beyond the Park boundaries is agricultural and rural residential. 3b. Explain the purpose of the proposed project: An emergency replacement of a broken canal water gate along Bee Tree Canal and replacement of two additional gates that aid in maintaining water levels within Lake Phelps. 3e. Describe the overall project in detail, including the type of equipment to be used: The proposed project involves the emergency replacement of one broken canal gate in Bee Tree Canal, the replacement of an adjacent canal gate in Bee Tree Canal, and the replacement of one canal gate in Moccasin Canal. The emergency replacement of the gate will involve: 1.) installing a temporary ditch plug ( -45 high x 8' wide x 3' long) approximately 225 feet upstream of the the existing water gate using material from an upland spoil pile containing material that was previously removed from the canal when an existing fish ladder was installed, 2.) dewatering the blocked portion of the canal, 3.) removing the existing water gate to obtain its correct specifications, 4.) installing a new water gate with the same dimensions as the broken gate, and 5.) removing the temporary canal plug. The existing 48" culvert will remain. The three existing canal gates to be replaced have the following dimensions: the part of the round gate that blocks water from entering the 48" culvert is 54" in diameter (including the mounting hardware and tracks). The height of the tracks on the gate is 72" above the round gate. The three proposed gate replacements should have approximately the same dimensions as the existing gates. The canal gate replacement adjacent to the broken canal gate in Bee Tree Canal will involve replacing the existing gate with another gate with the same dimensions as the adjacent broken gate. The gate replacement in Moccasin Canal will involve replacing an existing canal gate with a new canal gate of the same size, as well as replacing an existing culvert with a culvert 30' long and 48" in diameter. After installation, water control of the canal will be reestablished to moderate the lake level in accordance with the Lake Phelps Management Plan. After replacement of the canal gates and removal of the ditch plug, water control of the canals will be reestablished to moderate the lake level in accordance with the Lake Phelps Management Plan. Please prepare a fund transfer form in the amount of $240 payable to the NC Division of Water Quality to cover the administrative fee for the processing of this WQC request.
