Regulatory Specialist Mitigation Plan for River Oaks - Johnston County The following report is a synopsis of the proposed mitigation plan for the River Oaks project that is currently under review. Based on the overall amount of 404 wetlands (80-T'-/- acres) adjacent to 3000 + /- feet of Swift Creek, the owners are proposing onsite mitigation in lieu of payment into a wetlands /perennial stream bank. The plan will require an additional 65 foot buffer added to the 100 foot current buffer on Swift Creek to be placed into a recorded conservation easement as specified by AC of E's model easement. The remaining wetlands will be retained as a permanent open space tor the project as required through Johnston County Planning. if needed additional provisions can be added to the permanent open space to clarify all uses or restriction within these proposed features of the mitigation plan as derived from the 2005 approved JD by the Army Corps of Engineers. The conservation easement can be recorded one (1) month after permits are released for the crossing which will include the remaining open space area of 404 wetlands with an updated J. D. as was discussed. Our mitigation area provides a contiguous zone of high quality wetlands adjacent to Swift Creek that will significantly protect water quality and the stretch of Swift Creek. With these "high quality" wetlands and perennial stream identified and placed within a conservation easement and a permanent open space, the owners submit that the acreage as intrinsic value so that additional monetary compensation is not needed. The current crossing in review will complete the project and provide the necessary acreages of 404 Wetlands or perennial streams, Prepared by Neal Floyd for owners.
