DANIEL SMITH Director Dalton K Jones Diamond J Farms 688 Bethel Church Rd Mount Olive, NC 28365 Subject: Notice of Deficiency Diamond J Farms AWS310219 Duplin County NOV-2021-PC-0411 Dear Mr. Jones: NORTH CAROLINA Environmental Quality July 28, 2021 On June 24, 2021, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) noted during a compliance inspection a failure to have an analysis of the representative sample of the animal waste to be applied. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, a deficiency has been noted for failing to provide a waste analysis for the waste to be applied with your Certified Animal Waste Management Plan and the Swine Waste System General Permit No. AWG100000 that you are covered to operate under. Deficiency 1: Failure to provide an analysis of a representative sample of the animal waste to be applied, conducted in accordance with recommended laboratory sampling procedures as close to the time of application as practical and at least within sixty (60) days (before or after) of the date of application. Every reasonable effort shall be made to have the waste analyzed prior to the date of application and as close to the time of waste application as possible, per Condition III.5. of Swine Waste System General Permit No. AWG100000. Between August 12th, 2020 and August 23rd, 2020, 8 spraying events occurred with no valid waste analysis. The COVID amendment for waste analyses ended in June of 2020. On the previous years inspection, a note was made by the inspector to complete a waste analysis as soon as possible to cover the above mentioned spraying events. An analysis was never completed. You are required to take any necessary action to address the above violation. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed.
