Based on the forthcoming AJD from you for the wetlands that were determined to be non-404 areas, it is now apparent that the NWP 39 originally requested will not be needed. The only 404-regulated wetland impact is for the SW pond berm so we are requesting that a NWP 18 be used instead of a 39. The remaining non-404 impacts comprise 4750 sf and are below the threshold of the State's temporary rule and should be considered "deemed" permitted by DWR. I look forward to receiving the AJD from you soon and thank you for your assistance.
