WHEREAS, L&L Concrete, LLC, applicant, submitted an application for a Special Use Permit for a Heavy
Industrial use to accommodate the future development and operation of a concrete plant at 0 Airport Boulevard,
located on International Drive; and
WHEREAS, the property that is subject to the proposed Special Use Permit is identified by Wake County PIN
o75611533.3 and a portion of that Wake County PIN o756215529 legally described on Exhbit A attached hereto;
and I
WHEREAS, the subject property, in its entirety is depicted on Exhibit B attached hereto; and

WHEREAS, the Planning and Zoning Board held a public comment session on December 12, 2019 on the
requested Special Use Permit; and
WHEREAS, at the December 12, 2o19 Planning and Zoning Board meeting, by a vote of 5-0, the Board
forwarded a recommendation of approval on the aforementioned Special Use Permit; and
WHEREAS, Town Council was presented with the Planning and Zoning Board's recommendation at the
January 2S,, 2020 Council meeting; and
WHEREAS, the Town Council held a public hearing on January 28, 202o and February 11, 2020 on the
requested Special Use Permit; and
WHERE, the public hearing was duly advertised in accordance with all requirements of law; and
WHEREAS, based on the evidence and testimony presented at the December 12, 2019 Planning and Zoning
Board pubic meeting and comment session and the January 28, 202o and February 11, 202o Town Council
public hearl'i11gs, the Morrisville Town Council hereby makes the following findings of fact for the request:
I
FINDINGS
1. The subject property is located on International Drive at the address o Airport Boulevard. The property
is I:ot 8 in the Airtech Park subdivision and is approximately 6.21 acres.
2. The subject property is classified as Industrial in the Town's Comprehensive Plan.
3. The subject property is identified by Wake County PIN o75611533o and a portion of Wake County PIN
o7G6215529 and is depicted on Exhibit B attached hereto.
4. The property is zoned Industrial Management.

5. Based on the evidence and testimony received, the Council finds that:
A. The proposed development will not materially endanger the public health or safetv.
The proposed development will not endanger the public health and safety as it is in a location suitable
for industrial uses and is at least half a mile from the nearest residential property. The subject
property and adjoining properties are zoned Industrial Management and have similar industrial uses.
To the south of the property is a John Deere training center and to the north of the property there is
a cable installation company and a construction company. The proposed concrete plant will abide by
a Safety Compliance Program that will ensure the safety of employees and other citizens who live or
work in close proximity to the proposed use. The Safety Compliance Program addresses matters such
as safety and health training, first aid procedures and establishes a safety committee to oversee

ientation of the Program. In addition, there is EMS and Fire Department locations that are
1.5 and 1.7 miles to the property.
B.
The proposed development of a concrete plant will comply with all regulations and standards that
apply to the Industrial Management zoning district and the use of Heavy Industrial through the
proposed site plan and the future site plan and construction plan review process. The proposed
'concrete plant will comply with the Town of Morrisville's stormwater requirements related to
nitrogen loading, phosphorus loading and runoff control volume. The proposed development will
have a bioretention pond and a wet pond to reduce nitrogen and phosphorus loading and reduce post
;development runoff rates to pre -development rates.
C.
The testimony and written appraisal opinion of J. Thomas Hester, MAI, CCIM, with the firm Hester
.& Company established that the addition f n industrial p yo ause to an area with other industrial uses will
'not interfere with the use of the adjoining properties and therefore, will not substantially injure the
value of adjoining property.
D. Thepronosed develovment will be in harmonv with the intensity, scale. and character of develooment
existing or planned in the surrounding area.
The proposed development of a concrete plant will be in harmony with the intensity, scale and
-character of existing development in the area, which includes the following uses in close proximity:
truck terminals, commercial garage, warehouses, concrete plant and vacant parcels with Industrial
Management zoning. Specifically, to the south of the property along International Drive, there are
two additional concrete plants. Locating these types of high intensity industrial uses in a defined
industrial area aids in reducing negative impacts to surrounding properties and the Town.
E. The proposed development will not cause undue traffic congestion or create a traffic hazard.
The testimony and written traffic impact analysis by Santec Consulting Services, Inc., established that
xhe proposed use will have minimal impact on the operations of the surrounding intersections and
states that no additional roadway improvements are necessary to mitigate traffic related to the
proposed concrete plant.
F. The proposed development will not generate needs for transportation water_suDoly. sewage disposal.
The proposed development will not generate the needs for transportation, water supply, sewage
disposal, fire and police protection that cannot be adequately handled by the available infrastructure
and facilities as determined through the expert testimony from transportation and civil engineers. In
addition, the development will also include the improvement of International Drive in front of the
property.
G. The proposed development will be consistent with the Comprehensive Plan.
The proposed development is consistent with the Future Land Use Map of the Comprehensive Plan
which designates this property for industrial use. The requested Special Use Permit to allow a Heavy
Industrial use of a concrete plan will help meet the infrastructure demands of the growing Morrisville
area.
CONCLUSIONS
Based on the foregoing Findings, the Town Council of the Town of Morrisville concludes that the applicant has
met the requirements for approval of a Special Use Permit.
NOW, THEREFORE, BE IT RESOLVED THAT THE MORRISVILLE TOWN COUNCIL hereby approves
the application for a Special Use Permit for a Heavy Industrial use to accommodate the future development of a

o756215529 subject to the following conditions:
1. The proposed development shall be operated and developed in substantial conformance with the
evidence and testimony presented at the January 28, 202o and February 11, 202o Town Council public
hearings, including the preliminary site plan attached hereto as Exhibit C.
2. Per Section 8.6.5 of the Unified Development Ordinance, the improvement of International Drive along
the property's street frontage is required. Any portion of the roadway that is determined infeasible to
construct will require a Payment -in -Lieu that the applicant shall provide to the Town prior to approval
of the Construction Drawings.
3. The applicant shall provide a Payment -in -Lieu in the amount of $7,26o.11 for an intersection
improvement for the Southport Drive/Chapel Hill Road intersection that, at a minimum, maintains the
202o no -build level of delay for the westbound approach. The Payment -in -Lieu shall be paid to the Town
prior to approval of the Construction Drawings.
4. The,applicant will facilitate the annexation of the portion of the property (Wake County PIN o756215529)
that is not currently within corporate limits prior to approval of the Site Plan.

5. As shown on the preliminary site plan, the cross access drive to the western neighboring property (Wake
County PIN o756111224) shall be required to be constructed as an emergency access only.
