4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The project area has been used for an auto salvage yard and landfill in the past and is a Brownfield site. Successional mixed hardwood/pine has grown up on approximately one-half of
the project area. The remaining areas have herbaceous vegetation and some remaining bare areas. Land use in the vicinity of the project consists of industrial, commercial, single-
family residences and multi -family developments. Figure 1 depicts the location of the project area on the US Geological Survey (USGS) Charlotte East, NC 7.5-minute quadrangle
topographic map. Figure 2 show the location of the project area on the Web Soil Survey map. Figure 3 depicts the subject property on an aerial photograph of the area.

The purpose of the project is to construct a multi -family development to serve the current and future residents of Charlotte.

The project is a 5-story, multi -family residential development With approximately 300 units. The development consists of some retail space, necessary infrastructure, and residential
amenities including a parking garage, stormwater control measures, pool courtyard area, and an open space area to be developed by others. The attached Impact Coordination Map
depicts the proposed project and impacts to jurisdictional and non -jurisdictional areas. As part of the project, W. Tremont Avenue must be widening, which Will impact a perennial stream
channel that begins at a culvert under the road. A non -jurisdictional and DWR isolated wetland will be filled (0.08 ac) to create open space to be used for outdoor recreation. This
impact is covered by the State General Permit for Impacts to Isolated and Other Non-404 Jurisdictional Wetlands and Surface Waters (Permit Number IWGP100000).

Temporary impacts to the stream downstream of the riprap are necessary for construction access. Pre -construction contours will be restored after the
installation of the culvert extension and riprap.

Because widening of W. Tremont Avenue is required, impact to the stream is unavoidable. This stream is deeply incised with actively eroding banks.
The proposed riprap dissipator will dissipate the energy from this wasting stormwater discharge. Impact to the remaining stream will be avoided except
for riprap on the streambank below the stormwater outlet to protect it against future erosion.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The riprap dissipator Will be buried in the streambed to maintain the stream channel dimensions. A Sediment and Erosion Control Plan for the project
will be developed and approved by the City of Charlotte and the project will comply with the supplementary NPDES Construction Stormwater Permit
(NCG010000).

it is our understanding from previous projects that stream and wetland mitigation is required for any amount of impact in the Charlotte watershed. The
attached NCSAM assessment indicates the stream is of low quality. Therefore, we propose stream mitigation at a 1.5:1 ratio, which is doubled to
account for mitigation that is only available in the expanded service area, for a total of 51 stream credits required.

This project is subject to the City of Charlottes's Post Construction Stormwater Ordinance (PCSO). The project is located in a Distressed Business District within the City of Charlotte.
This project is meeting the requirements of the ordinance by providing volume reduction in the one year storm, and flowrate reduction (detention) in the two-year, ten-year, and 25-year
storm events. These reductions are comparing the post -project to pre -project volumes and flow rates computed on the site, and should prevent future flooding and degradation of the
receiving channel by controlling velocities in the channel during these design storm events.
The existing property has a variety of existing gravel and old paved surfaces, as the site was a previous junk yard for vehicles. There are no stormwater controls present on site to
control the existing impervious surface. The proposed storm water controls ignore the existing impervious surfaces on -site, and analyze the stormwater from a 50 % open, 50 % wooded
baseline (pre -development) condition. This results in the computed pre -project target flowrate (and velocity) being less than the actual pre -project flowrate (and velocity). That said, the
runoff from the proposed condition should be improved over the existing conditions. Point of analysis results are listed on the impact map.

McAdams used USFWS IPaC Information for Planning and Consultation Tool to obtain the attached official species list. The attached May Affect
Verification letter from USFWS indicates the project is consistent with activities analyzed in the PBO. The project area contains suitable habitat for
Michau)es sumac, smooth coneflower, and Schweinitits sunflower. A survey will be completed as soon as smooth coneflower and Schweinitits
sunflower are observable closer to the optimal survey windowfor these species and within the windowfor Michaux's sumac. The perennial stream
channel is of low quality and not suitable habitat for Carolina heelsplitter. A complete protected species assessment will be prepared and submitted to
USFWS after the plant surveys are completed.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing
to accept payment for compensatory mitigation for impacts associated with the above referenced project
as indicated in the table below. Please note that this decision does not assure that participation in the
DMS in -lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for
project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if
payment to the DMS will be approved. You must also comply with all other state, federal or local
government permits, regulations or authorizations associated with the proposed activity including G.S. §
143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance
will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives
a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid
by an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of
mitigation required and assigned to DMS for this impact is determined by permitting agencies and may
exceed the impact amounts shown below.
