Dear Mr. Conard:
This correspondence is with reference to the request you submitted on July 14, 2021, to modify State Permit No.
84-05, which authorized maintenance dredging within the marina basin and the addition of 16 slips creating a total
of 169 slips. This permit was modified on June 9, 2006 for the addition of 6 additional slips and again on October
29, 2015 and December 21, 2016 for the addition of jet docks and floating boat lifts within existing slips at the
marina. The marina currently accommodates up to 174 slips. State Permit No. 84-05 was last renewed on
February 27, 2020 under a Maintenance 5/Renewal. A Major Modification was issued on July 9, 2021 for bulkhead
replacement including coastal wetland fill, the permit and is due to expire on December 31, 2024.
The action proposed in your submittal consists of an increase in the 2 ft. step out authorized for new bulkhead
installation. The current request is to step out an additional 6° from the existing bulkhead in two sections,
measuring 80 liner ft. and 160 linear ft., to increase the structural integrity of the new wall. No Coastal Wetland
Areas would be affected, the request is for open water impacts only (see attached drawings).
Upon review of the information provided the Division of Coastal Management has determined that the proposed
actions continue to be consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State
Permit No. 84-05, as described in your request dated July 14, 2021. Please note this refinement does not alleviate
the need to obtain any other local, state or federal permits.

Good Morning,
As per our previous conversation yesterday, we would like to request a refinement to Major Modification #84-05 to
aliow for 30" of new bulkhead in front of existing deteriorated bulkhead in the (2) sections shown on the attached
drawing instead of the 24" currently permitted. The freeboard on the wall in these locations is apx 8'-10' high and will
require heavier pilings, walers and sheathing to accommodate the load being exerted according to the soil samples
conducted and the engineer's design. The additional 6" required will only have king piles installed every 7'. No backfill
will be installed in the additional 6" being requested. No coastal wetlands will be affected in these areas (as there is
none). The remaining portion of the bulkhead replacement where wetlands are present are minimal (5' and under) and
will not require king piles so the 24" permitted will suffice. Please let me know if you need anything further on our
end. As always, i appreciate your help in this matter.
