PROJECT SUMMARY: The applicant proposes to construct a community marina into the Cape Fear River and a timber access bridge to accommodate a 48 -Lot residential subdivision. REDUS NC Land, LLC Watermark Landing Page Two 9. PROJECT DESCRIPTION: The project site is located at 8400 River Road, adjacent to the Cape Fear River, in New Hanover County. To locate the property of interest from the Wilmington Regional Office (WiRO) travel south approximately 9.0 miles on College Road South. Turn right (west) onto Sanders Road and continue traveling west approximately 0.9 miles until the road terminates at River Road. Turn left onto River Road and travel south approximately 3.5 miles until you reach the property of interest which will be located on the right, located directly across from The Cape Subdivision. The entire property is approximately 32.94 acres in size, however, only approximately 10.0 acres is highground. There is approximately 1,904 linear feet of shoreline along the Cape Fear River. Roughly two - thirds of the site is comprised of both Section "404" and Coastal Wetlands. High ground vegetation at the site consists of Live Oak, Laurel Oak, Magnolia, Pine, Maple, Cedar and Sweet Gum. Understory vegetation consists of Red Cedar, Wax Myrtle and Marsh Elder (Baccharis). The upland portions of the property are bordered by either "404" or Coastal Wetlands, which include: Smooth Cordgrass (Spartina alterniora), Black Needle Rush (Juncos roemarianus), Salt Meadow Grass (Spartina patens), Giant Cordgrass fSpartina cynosuroides) and Narrow Leaf Cat -tails (Typha sp.). The previous property owner (Watermark New Hanover, LP) obtained State Permit No. 64 -08 on June 30, 2008 through the Express Permit Program, which authorized the development of a 48 -Lot residential subdivision including infrastructure, amenities, utilities, elevated boardwalks, retaining wall and a kayak launching facility into a canal located on the southern end of the project site. The previous authorization included the filling of approximately 8,276 sq. ft. of Section "404" wetlands for the construction of the road crossing and associated culverts. The U.S. Army Corp of Engineers ( USACE), on 02/28/2007, approved this fill activity under Nationwide Permit 14 (Action ID #2001 -1253 -065). In addition to the Nationwide Permit 14, the previous property owner obtained CAMA Minor Permit No. 07 -063 through the New Hanover County Inspections Department, which was issued on 10/03/2007. This permit authorized the construction of a timber access bridge, measuring approximately 134 feet in length by 26 feet in width, which crosses both Section "404" and Coastal Wetlands. Detailed drawings and descriptions of the proposed bridge were included in the application for State Permit No. 64 -08 as well. The approved vehicular bridge, once constructed, would provide access to the far western peninsula along the Cape Fear River. To date, the site is currently undeveloped, with the exception of some of the authorized retaining walls, rough grading and some sub - surface utilities. State Permit No. 64 -08 was recently transferred on February 22, 2013 to the applicant ( REDUS NC Land, LLC) and is due to expire on December 31, 2016, which was subject to extension by Session Law 2009 -406, and as amended by Session Law 2010 -177, the Permit Extension Act (See Sheets 1 and 2 of 7 and Project Narrative). The previous property owner submitted an Essential Fish Habitat Assessment (EFH), Submerged Aquatic Vegetation (SAV), Shellfish and hydrographic surveys to be included in an Environmental Assessment to satisfy the State Environmental Policy Act (SEPA) process in October of 2011 for a community marina; however, it appears at the time the previous owner did not complete the SEPA process and did not receive a Finding of No Significant Impact (FONSI) (See EFH and SAV and Shellfish Surveys). It should be noted that the acting agents for this application held a scoping meeting at the WiRO on November 5, 2012 and at the USACE Wilmington District Office to discuss this proposal with the interested review agencies. The Wilmington -New Hanover County 2006 Land Use Update Plan classifies the area as Conservation. The waters of the Cape Fear River are classified SC, by the Division of Water Quality. The area IS designated as a Primary Nursery Area (PNA), by the Division of Marine Fisheries and is CLOSED to the harvest of shellfish. REDUS NC Land, LLC Watermark Landing Page Three PROPOSED PROJECT: The applicant proposes to construct a community marina into the Cape Fear River and a timber access bridge to accommodate a 48 -Lot residential subdivision. The application does not include modifications to the authorized upland development, elevated boardwalk and the kayak launching facility under State Permit No. 64 -08, aforementioned. The applicant proposes to modify State Permit No. 64 -08 to allow for an open water marina and a timber bridge for vehicular use, which would serve the previously authorized upland development. The marina would be located along the central portion of the project site at the location of an authorized elevated boardwalk and platform. An access pier would extend from this location towards the west into the Cape Fear River, measuring approximately 60 feet in length by 6 feet in width. An access ramp would then lead from the access pier onto a main floating dock, measuring approximately 213 feet in length by 8 feet in width, which would run parallel to the shoreline. As proposed, handrails would be placed on the landward side of the main floating dock to prevent possible dockage (See Sheets 4 and 5 of 7). Two (2) floating dock spines would extend waterward from this main floating dock, each measuring approximately 176 feet in length by 8 feet in width, which would run perpendicular to the shoreline and channel of the river. As proposed, 24 floating finger piers, each measuring approximately 35 feet in length by 3 feet in width would extend from these dock spines, six (6) on each side. The finger piers would be spaced approximately 25 feet apart with two (2) tie pilings between each finger pier. These slips would accommodate approximately 48 designated vessels averaging 35 feet in length. The application states that a pump -out facility would be located on the waterward end of the northern floating dock spine (See Sheets 4 and 5 of 7). The application states the open water marina would be located within water depths ranging from approximately -4.14 feet to 4.25 feet at mean low water (MLW) based on NGVD29 Datum. It should be noted that the proposed marina would be located east of the Cape Fear River shipping channel and would be subject to frequent wave wash from passing vessels. The application also states that the applicant is currently in the process of submitting an application for a Special Use Permit through the New Hanover County Planning and Inspections Department for the community marina (See Sheets 2 through 7 of 7 and Project Narrative). The application also proposes to construct the timber bridge, which was originally authorized to the previous owner under a CAMA Minor Permit through New Hanover County, aforementioned. As stated, the bridge would provide vehicular access to the peninsula on the western end of the project site at the proposed location of the community marina. The bridge would span over an area of Coastal and Section "404" wetlands, measuring approximately 134 feet in length by 26 feet in width and elevated approximately 3 feet above the marsh substrate (See Sheets S1 through S4 and Project Narrative). 10. ANTICIPATED IlVIPACTS: The proposed marina docking system would incorporate approximately 8,048 sq. ft. of Estuarine Waters and Public Trust Areas. Approximately 3,628 sq. ft. Smooth Cordgrass and Black Needle Rush would be impacted due to shading as a result of the construction of the timber bridge for vehicular access. The timber bridge would also impact approximately 900 sq. ft. of highground. The structures would not encroach into the adjacent 15 feet riparian corridor setback requirement. The proposed open water marina would extend approximately 256 feet into a waterbody measuring approximately 5,291 feet across. The proposed structures would not exceed the 1/4 distance and would not encroach into the USACE navigation channel setback. The application states the open water marina would be located within water depths ranging from approximately - 4.14 feet to -4.25 feet at MLW based on NGVD29 Datum. Minor turbidity increases may be expected during the construction process. Due to the proximity of the Cape Fear River shipping channel, boats utilizing the docking facility will be subject to frequent wave wash from passing vessels. Submitted by: Robb L. Mairs Date: June 3, 2013 Office: Wilmington CAMA Major Narrative Watermark Landing Marina June 3, 2013 The Watermark Landing Marina is proposed as an amenity in support of the previously approved upland residential development comprised of 48 single family lots. CAMA permits issued for these upland improvements include a CAMA Minor Permit for a Vehicular bridge, #07 -063, issued 10/3/07, with an expiration date of 12/30/14 *, and a CAMA Major Permit for the upland development,, #64-008, issued on 02/22/13 with an expiration date of 12/31/16. It should be noted that the CAMA Minor Permit for the vehicular bridge is resubmitted within this permit submittal to consolidate the permits into one name. The vehicular bridge design remains the same. These respective permits provide access to the proposed marina location. ( *Expiration dates comply with the HB permit extension act.) During the previous design phase for this marina a SEPA document was required. Thus several required site reconnaissance efforts have been conducted including the following: - Hydrographic Survey - EFH Assessment - SAV Survey - Shellfish Survey - Coastal Marsh Survey - 404 Wetlands Survey All of the above documents have been provided with the CAMA Major permit modification to enable a comprehensive project understanding. The community marina is located over open water and no dredging will be required. An elevated fixed boardwalk will extend to a floating dock area. No Coastal marsh or 404 wetland impacts will occur. The marina area is in compliance with the SF public trust waters occupy limitations. A fish cleaning station will be provided at one location on the 8' wide dock approach area. Water supply and electricity will be provided to each boat slip. A pump out station will be provided at the north pier terminus. The PNA boundary is 1000 feet north of the proposed marina. Stormwater and Erosion Control permits will not be required for the marina. A Special Use Permit will be required by New Hanover County and the applicant is in the process of pursing. Communication with the county suggests this effort could take 2 — 3 months. A regulatory interagency scoping meeting was held on Nov. 5, 2012. A copy of the meeting attendees is attached. Lastly a regulatory scoping meeting was held with the USACE on Dec. 13, 2012 as they were unable to attend the regulatory interagency scoping meeting.
