Skvada, III Secretary The Division of Water Quality (DWQ), along with David Brown of the US Army Corps of Engineers and David McHenry of the NC Wildlife Resources Commission performed a site visit at this property on May 29, 2013. Additionally, a preliminary review of a 401 Water Quality Certification application submitted for the above referenced property has been performed. Additional information will be required in order to complete the review process. Please provide the following information so that we may continue to review your project. Additional Information Requested: Application Item B. 3. d. references the relocation of the "original house" away from the UT to Walnut Creek. The onsite review of the application and property revealed the construction of a new home, partially upon the old house footprint. Please clarify the purpose of this project with regards to the new home construction and the bridge abutments along Walnut Creek. 2. The site visit confirmed that the bridge abutments constructed along Walnut Creek are within the ordinary high water mark and this fill would be regulated by the Division of Water Quality. The Impact table on page 4 of 10 needs to be modified to include the stream length impacted by the construction of these abutments. 3. Application Item D. 1. Refers to steps takien to avoid or minimize impacts to waters. During the site visit, it was observed that the previously constructed bridge remains in place, and appears to be serviceable. Please provide a narrative that discusses all proposed uses of this property, and the need for the replacement of an existing, apparently serviceable, structure. Please provide your response in writing to the addresses below prior to June 24, 2013. Four copies of the required information should be provided to the Wetlands, Buffers, Stormwater Compliance and Permitting Unit at: Ms. Karen Higgins WBSCP Unit , 1650 Mail Service Center Raleigh, NC 27699 -1650 and a single copy to the Asheville Regional Office at: Kevin Barnett Surface Water Protection Section 2090 US HWY 70 Swannanoa, NC 28778 If we do not hear from you by the deadline, we will assume that you no longer want to pursue this project and we will consider the project withdrawn. This letter only addresses the preliminary application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
