HomeMy WebLinkAbout20210690 Ver 1_072221_PCNResponseDoc_20210722F=-- u r•F—=" ERE" G 'Yl July 22nd, 2021 Dear Oak Solar - Phase A PCN Reviewing Entities, On April 05th, 2021, A Pre -Filing Meeting Request was submitted to the Division of Water Resources (DWR) with the intention of reviewing the Oak Solar - Phase A project components prior to Pre -Construction Notification (PCN) submittal, in accordance with 40 C.F.R. Section 121.4(a). DWR ID#20210690 was issued at this time. On May 11th, 2021, the PCN for the Oak Solar - Phase A project was submitted with the intention of seeking coverage under Nationwide Permit 14 for necessary linear transportation projects. On June 7th, 2021, SunEnergyl, LLC (Developer) received comments from USACE representative Anthony Scarbraugh requesting more information prior to issuing confirmation of coverage. On July 6th, 2021, SunEnergyl, LLC received comments from Stephanie Goss from DWR also requesting additional information and reiterating the need to address USACE 06/07/2021 inquiries prior issuance of coverage. Please find the below inquiries restated as they were received, as well as responses to those comments. In addition, please find the exhibits with the requested information incorporated. (USACE PCN Comment 1) - Permits for work within waters and/or wetlands are available only if the proposed work is the least environmentally damaging, practicable alternative. Accordingly, we must evaluate the steps you have taken to avoid and minimize impacts to determine permit eligibility. As such, please provide detailed figures for the proposed impacts to jurisdictional waters and/or wetland that that clearly depict for each of the proposed crossing locations along with justification as to why each crossing would be needed for proposed development of the solar project. Please amend the PCN application to include any changes any proposed changes to the originally submitted impact table. (SE1 response to USACE Comment 1) - Anthony, please find the attached PCN exhibits further detailing the culverts and crossing named as Future Culvert #2-6. As was noted in the original PCN submittal, "The project was designed to completely avoid wetland impacts. All racking, laydown yards, trailers, etc were designed with the intention to completely avoid the subject features. Temporary crossings to appropriately reach all areas of the project were designed, but the need for permanent, safe, stable crossings has been noted." To further elaborate, it is always SEVs intention to avoid and minimize impacts to Jurisdictional features. Our solar array racking has been placed with a generous buffer to avoid impact to identified wetlands. If viewing the project design as a whole, you will see Si�I��IV �F�CY1 environmentally sensitive areas on site have been given the proper protections to prevent unnecessary impacts from development. The wetland features on site are such that large swathes of upland areas on the parcel are completely segmented, requiring permanent crossings to safely access portions of the project area. Future culvert #2-6 have all been placed in locations that will have the least detriment to Waters of the US. Alternative methods, such as temporary crossings for construction were explored. It is our belief that the continued safety of our construction and operation/maintenance crews, as well as the preservation to the banks of jurisdictional features would require some form of permanent crossings in the areas shown as Future culvert #2-6. (USACE PCN Comment 2) - After determining if the proposed activity is the least environmentally damaging, practicable alternative, the Corps follows the mitigation types in this order: avoidance, minimization, and compensatory mitigation. Avoidance means avoiding an aquatic resource altogether by selecting the least damaging construction type, spatial location, etc. Minimization means managing the severity of the impact on aquatic resources at the site through, for example, project design. Lastly, compensatory mitigation is required after avoidance and minimization measures have been applied for wetland losses that exceed 1/10 acre. Applicants must first check to see if a private bank is available, but if not, in -lieu (DMS) is the next option. A 2:1 requirement would be necessary to maintain consistency with our program. Please find the letter of credit availability for Future Culvert #4, 5 and 6 impacts which exceed the 0.1-acre limit and require compensatory mitigation at a ratio of 2:1. With a total impact area of 0.480 ac to 401/404 features for the three required culverts, the Riparian credits in the Chowan River Basin required are 0.960.
