An approximately 40.0 acre tract located east of US Hiahwav 15 and north of Herbert Henley Road in Oxford
North Carolina is proposed for development. An approximately 148,796 square feet retail center, with 36,400 square
feet of retail shops and three outparcels 1.4 acres each) are proposed. In order to~rovide the property with a water
source, connection to the existing Cit~of Oxford pump station is required. A sewer line (8" or 10") is also proposed
to be placed 10 feet from and parallel to, the proposed water line (8" PVC ape). A 30 foot corridor near the east side
of US Hi~y 15 will be required for the installation of the service lines. A 401 Certification under Nationwide

Permit No 12 and authorization for impacts to Tar-Pamlico Basin buffers are requested in order to complete the
r~otect.

Granville County, North Carolina. The water line (and sewer line) will run southward from the tract alongLthe east
side of US Highway 15 to the existing City, of Oxford pump station approximately 1,400 feet south of Herbert Henley
Road.

The Stormwater Management Plan is in review by the Citv of Oxford. It is our understanding that written
authorization for a Nationwide Permit No. 12 is not required from the USACE for the following reasons: 1 no
mechanized clearin~in wetlands is proposed 2) a section 10 permit is not required 3) the utility lines will extend less
than 500 feet in waters of the U.S. 4 the utility lines do not run parallel to the stream bed in a jurisdictional area 5)
less than 1/10 acre of impacts to waters of the U.S. is proposed 6) no permanent access roads are proposed. S&ME
has discussed the points listed above with Eric Alsmeyer with the USACE Raleigh Office and will provide a letter to
the USACE with submittal of the Express Review permit application.
