In reply to the NOI dated June 16, 2021, regarding non -compliances for the month of November
2020 I would like to offer the following response.
The biological non -compliances were directly related to an unusual or abnormal circumstance
caused by heavy rains in which both the treatment and hydraulic capacity of the facility were
momentarily exceeded and in neither instance was the non-compliance caused by lack of
proper operation, mechanical or maintenance failure. Both the 5 Day Bypass Report along with
the accompanying flow chart were submitted within the appropriate time frame in relation to
the event and when the flow subsided the facility returned to operation within permitted
guidelines.
The missed NH3 sample occurred when a phosphorous sample was inadvertently discarded
prior to the NH3 test being run. Since that occurred we have changed our sampling policy to
include picking up individual samples for each individual test so there will always be a back-up
available to prevent a similar occurrence.
Hopefully this will help explain the non -compliances and exhibit our pro -active stance and
effort to keep all interested parties notified of events that may have public impact in a timely
manner as well as help mitigate any monetary penalties associated with the non -compliances.
