Atlas Environmental is submitting the enclosed package on behalf of Trinity Capital, Mr.
Travis Caldwell, for approval of a Nationwide Permit 39 application. There is 4,538
linear feet of stream (CH 100, CH 200, CH 300, CH 400, CH 500, and CH 600) on site.
There is 2.726 acre of wetlands (WL 4000, WL 4100, and WL 4200) within the project
boundary. Lastly there is 0.845 acre of open water (Pond 1) on site. CH 400 drains
through Pond 1.
The enclosed permit application request is for 528 linear feet of stream (498 linear feet
of permanent impact and 30 linear feet of temporary impact) impacts in order to
facilitate construction of an industrial distribution / warehouse logistics center, truck
courts, employee parking, road access around the building, and one storm water SCM.
Permanent impacts to intermittent streams CH 200 and CH 300 of 109 linear feet and
118 linear feet respectively are requested. Permanent impacts to perennial stream CH
200 of 271 linear feet and temporary impacts to perennial stream CH 200 of 30 linear
feet are also requested. This area is very attractive for industrial development due to
the existing development already present in the vicinity as well as its close proximity to
interstate 1-85. The project is visible from the interstate.
All streams on site are unnamed tributaries to Bessemer Branch which is classified as a
"C" water by the North Carolina Division of Water Resources. The Corps issued a
preliminary jurisdictional determination on April 8, 2021. A copy of the Jurisdictional
Determination is included in this package. The Corps (Ms. Kathy Janiczak and Mrs.
Amanda Jones) conducted site visits in 2020 and 2021. NC DWR (Mr. Alan Johnson)
conducted site visits in 2020 and 2021.

The largest and highest quality stream (CH 100) has been avoided. The lower reach of
CH 200 has been avoided. A retaining wall will be constructed, and a culvert headwall
will be used to minimize stream impacts to greatest extent possible. This retaining wall
is adding significant project costs. Below is a summary table to the impacts.

The planned industrial distribution / warehouse building logistics park is being
constructed with features and flexibility to attract a wide array of tenants that are
interested in occupying this product type in this location. The building will have specific
design features to meet the demand expectations of tenants interested in this location
and ultimately attract high quality tenants that will lease the space over the long term. A
variety of businesses across multiple industries will be able to utilize this development in
this location depending on their warehouse space needs. Business activities among
these tenants may include freight forwarding, third party logistics, food/beverage
distribution, light assembly / manufacturing, wholesalers, etc. Businesses that benefit
from logistical efficiencies associated with proximity to population centers, intermodal
hubs, and interstate highways will be especially interested in this development due to its
location to the Charlotte urban core, Interstates 77, 85 and 485, and Charlotte -Douglas
International Airport/Intermodal.
The proposed industrial use of the property is consistent with the City of Gastonia's
adopted land use plan. Users of such buildings often require anywhere from 100,000
square feet to 2.5 million square feet. While the property's location has certain logistical
advantages for industrial warehouse users, these tenants will require competitive
market rents to operate out of these proposed facilities. Rental rates are directly related
to the cost of the land and improvements, much of which is fixed regardless of the size
of the building being developed. These fixed costs, which this development also will
incur, include the land itself, utility infrastructure improvements, offsite roadway
improvements, legal and financing costs, marketing, construction costs, etc. As these
fixed costs are spread over a smaller building, the required rental rates increase to the
point that they are above -market, thus making the investment financially unfeasible.
Furthermore, as building sizes decrease, economies of scale for the physical
improvements are lost. Factoring in the economies of scale, the entire

development costs increase by 30%-35%, driving market rents higher than tenants are
willing to pay and making the development financially unviable.
Mitigation is proposed at a .5:1 ratio due to the very low quality of intermittent feature
CH 200 and at a 1:1 ratio due to the low quality of intermittent feature CH 300.
Intermittent stream CH 200 is a straightened reach at the toe of a very steep fill slope
and is lined with rip rap. Intermittent stream CH 300 is at the toe of another fill slope
and contains debris from erosion from the fill slope. Mitigation for the perennial stream
impact is proposed at a 1.5:1 ratio due to the medium quality of this feature. This
stream has significant sediment loads due to areas of failing banks. There is trash
including tires, bricks, metal, concrete, and other debris scattered throughout the entire
reach of CH 200. Enclosed is a copy of the DMS approval letter for stream credits.

CH 100 which is the largest and highest quality stream on site has been avoided completely. CH 100 is 780 linear feet in
length. The lower reach of CH 200 (1,826 linear feet) has been avoided. No wetland are proposed.

An expensive retaining wall and culvert head wall will be used at the downstream end of the impacts to avoid additional

1. The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general
permit, and the permit applicant has not requested an AJD for the activity, the permit
applicant is hereby made aware that: (1) the permit applicant has elected to seek a permit
authorization based on a PJD, which does not make an official determination of
jurisdictional aquatic resources; (2) the applicant has the option to request an AJD before
accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an AJD could possibly result in less compensatory mitigation being
required or different special conditions; (3) the applicant has the right to request an
individual permit rather than accepting the terms and conditions of the NWP or other
general permit authorization; (4) the applicant can accept a permit authorization and
thereby agree to comply with all the terms and conditions of that permit, including
whatever mitigation requirements the Corps has determined to be necessary; (5)
undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6)
accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking
any activity in reliance on any form of Corps permit authorization based on a PJD
constitutes agreement that all aquatic resources in the review area affected in any way by
that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction
in any administrative orjudicial compliance or enforcement action, or in any administrative
appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD or
a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered
individual permit (and all terms and conditions contained therein), or individual permit
denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an
administrative appeal, it becomes appropriate to make an official determination whether
geographic jurisdiction exists over aquatic resources in the review area, or to provide an
official delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation

The U.S. Fish and Wildlife Service (Service) has reviewed the information provided in your
correspondence dated April 30, 2020, received May 7, 2020. We submit the following
comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as
amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321
et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C.
1531-1543) (Act).
Project Description
According to the information provided, the Applicant is seeking a Nationwide Permit through
US Army Corps of Engineers. The proposed project would entail the construction of commercial
buildings potentially including a warehouse, office or retail space with associated parking,
utilities and storm water treatment. Preliminary site design is currently in development, and plans
were not provided in your correspondence. The site consists of 80 acres with isolated mixed
hardwood forest, forest edges, transitional habitats and cleared lands. The project area was
previously utilized as a rock quarry mine and surrounding land use is predominantly developed
for commercial use.
Federally Listed Endangered and Threatened Species
Service records indicate that suitable summer roosting habitat may be present in the project area
for the federally threatened northern long-eared bat (Myotis septentrionalis). However, the fmal
4(d) rule for this species (effective as of February 16, 2016), exempts incidental take associated
with activities that occur greater than 0.25 miles from a known hibernation site, and greater than
150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31).
Based on the information provided, the project (which may or may not require tree clearing)
would occur at a location where any incidental take that may result from associated activities is
exempt under the 4(d) rule. Although not required, we encourage the Applicant to avoid any
associated tree clearing activities during this animal's maternity roosting season from May
15 — August 15.
Based on negative survey results conducted during optimal survey windows for the federally
endangered Schweinitz's sunflower (Helianthus schweinitzii), and federally threatened dwarf -
flowered heartleaf (Hexastylis naniflora), we have no concerns for these species and we require
no further information at this time. Please be aware that obligations under section 7 of the
Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this
identified action that may affect listed species or critical habitat in a manner not previously
considered, (2) this action is subsequently modified in a manner that was not considered in this
review, or (3) a new species is listed or critical habitat is determined that may be affected by the
identified action.
Service records indicate occurrences of a bald eagle (Haliaeetus leucocephalus) nesting site
within the vicinity of the project area. The bald eagle has been removed from the federal list of
endangered and threatened species due to its recovery. However, this species is afforded legal
protection by the Bald and Golden Eagle Protection Act (16 U.S.C. 668-668d) and the Migratory
Bird Treaty Act (16 U.S.C. 703-712). The Bald and Golden Eagle Protection Act, enacted in
1940, and amended several times, prohibits anyone without a permit issued by the Secretary of
the Interior from "taking" bald eagles, including their parts, nests, or eggs. "Take" includes
pursue, shoot, shoot at, poison, wound, kill, capture, trap, collect, molest or disturb (16 U.S.C.
668c; 50 CFR 22.3). "Disturb" means "To agitate or bother a bald or golden eagle to the degree
that interferes with or interrupts normal breeding, feeding, or sheltering habits, causing injury,
death, or nest abandonment." In addition to immediate impacts, these definitions also cover
impacts that result from human -induced alterations initiated around a previously used nest site
during a time when eagles are not present if, upon an eagle's return, such alterations agitate or
bother the eagle to a degree that interferes with or interrupts normal breeding, feeding, or
sheltering habits and causes injury, death, or nest abandonment.
If any active nests are located within a half mile of the project site, we request that work at the
site be restricted from mid -January through July in order to prevent adverse impacts to the bald
eagle. This will prevent disturbance of the eagles from the egg -laying period until the young
fledge, which encompasses their most vulnerable times.
Erosion and Sediment Control
Measures to control sediment and erosion should be installed before any ground -disturbing
activities occur. Grading and backfilling should be minimized, and existing native vegetation
should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas
should be revegetated with native vegetation as soon as the project is completed. Ground
disturbance should be limited to what will be stabilized quickly, preferably by the end of the
workday. Natural fiber matting (coir) should be used for erosion control as synthetic
netting can trap animals and persist in the environment beyond its intended purpose.
Low Impact Development
The Service is concerned about the potential stormwater-mediated impacts to streams and
wetlands onsite. Where detention ponds are used, storm -water outlets should drain through a
vegetated area prior to reaching any natural stream or wetland area. Detention structures should
be designed to allow for the slow discharge of storm water, attenuating the potential adverse

effects of storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges.
Since the purpose of storm -water -control is to protect streams and wetlands, no
storm -water -control measures or best management practices should be installed within any
stream (perennial or intermittent) or wetland.
We recommend that consideration be given to the use of pervious materials (i.e., pervious
concrete, interlocking/open paving blocks, etc.) for the construction of roads, driveways,
sidewalks, etc. Pervious surfaces minimize changes to the hydrology of the watershed and can
be used to facilitate groundwater recharge. Pervious materials are also less likely to absorb and
store heat and allow the cooler soil below to cool the pavement. Additionally, pervious concrete
requires less maintenance and is less susceptible to freeze/thaw cracking due to large voids
within the concrete.
Pollinators
Pollinators such as most bees, some birds, bats, or other insects including moths and butterflies,
play a crucial role in flowering plant reproduction and in the production of most fruits and
vegetables. Many wild pollinators are declining as a result of disease and habitat loss. The rusty -
patched bumble bee (Bombus affinis) historically occurred in the project vicinity. Although not
required, we encourage your client to consider the recommendations below to benefit pollinators.
Moreover, the creation and maintenance of pollinator habitats in the proposed greenway area
may increase the value of the project for the community, and help reduce the spread of invasive
exotic plants:
1. Sow native seed mixes in disturbed areas or in designated pollinator areas with plants
that bloom throughout the entire growing season.
2. Taller growing pollinator plant species should be planted around the periphery of the
site and anywhere on the site where mowing can be restricted during the summer
months. Taller plants, left un-mowed during the summer, would provide benefits to
pollinators, habitat to ground nesting/feeding birds, and cover for small mammals.
3. Low growing/groundcover native species should be planted in areas that need to be
maintained. This would provide benefits to pollinators while also minimizing the
amount of maintenance such as mowing and herbicide treatment. Milk weed species
are an important host plant for monarch butterflies.
4. Avoid mowing of flowering plants. Designated pollinator areas show be mow only
50% of the plant height, but no lower than 8 inches.
5. Avoid mowing outside the active season for rusty -patched bumble bee and other
pollinators (April 15 — October 15).
6. Leave slash piles, mulch piles, or loose dirt piles along woodland edges. These areas
provide nesting habitats and/or nest materials for some pollinators.
7. Avoid the use of pesticides and specifically neonicotinoids.
8. Additional information regarding plant species, seed mixes, and pollinator
habitat requirements can be provided upon request.
