SUBJECT: Complaint Investigation Oil in
Stormwater Drain
1010 Framingham Lane, Indian Trail
Incident # 202101518
Union County
On June 17, 2021, this Office received a complaint of motor oil being discharged into a
stormwater drop inlet on 1010 Farmingham Lane (Tax Parcel # 07117588). The stormwater
drop inlet flows to an unnamed tributary of Price Mill Creek. The complaint was investigated by
Roberto Scheller of this Office on June 18, 2021. At time of the site investigation the enclosed
photo was taken of the affected area.
Please be advised that the unlawful discharge of oil into the stormwater collection
system and the water of the State is a violation of the Hazardous Substances Control Act
in accordance with North Carolina General Statute (NCGS) 143-215.83, that states that in
shall be unlawful, except as otherwise provided in this Part, for any person to discharge,
or cause to be discharged, oil or other hazardous substances into or upon any waters,
tidal flats, beaches, or lands within this State, or into any sewer, surface water drain or
other waters that drain into waters of this State, regardless of the fault of the person
having control over the oil or other hazardous substances, or regardless of whether the
discharge was the result of intentional or negligent conduct, accident or other cause.
Please also note that civil penalties may be assessed pursuant to NCGS 143-215.6 A
(a)(1), which provides that a civil penalty of not more than twenty-five thousand dollars
($25,000) per violation per day may be assessed against a person who violates any
classifications, standards, limitations, or management practice established pursuant to
NCGS 143.215, 143-214.1 and 143-2314.2.
It is therefore necessary to stop the practice of parking over the stormwater drop inlet and
allowing oil to drip into the stormwater inlet. The leaking vehicle should be repaired and leaking
oil from the vehicle collected with absorbent materials and disposed of properly. Failure to
comply may result in a notice of violation and civil penalties.
