Hope you are well. As usual, | have some questions regarding the permit modification request on this one. Not too
involved, but I need some clarification. My questions are:
1. Site 1: My notes from the hydraulics meeting in August 2008 didn't indicate any jurisdictional streams, only
wetland impacts. |f the stream is jurisdictional, |sit intermittent? The stream impact ishz Patterson Creek
(pen*ooie|) which was not included in hydraulics meeting drawings. The impact in for bank stabilization and
associated temporary impacts from proposed 24" pipe installation. For some reason this issue was overlooked
during August 2008 meeting.
2. Site 2: The ditch which outfalls to Patterson Creek looks like it ties into the stream bank. The hydraulic plans
didn't show the PDEextending this far originally. | expressed some concerns during the meeting about the
discharge from the ditch and bank erosion. | don't see any detail for the tie into the stream and whether it
would be considered impact. The ditch actually ties into the existing channel (perennial) prior to Patterson
Creek.
Site 4: Looks like there are 3 impact sites (for riprap\at this site. One of the sites was not included inthe
hydraulics meeting. Does the 44 feet of impact account for the Mprapot all 3 impact sites? Yea.
Also, on Permit Drawing Sheet 18 of 41, it appears that the impact goes across Buffalo Creek. Can you please
explain what it going nnat this site? The impact from the ditch ie only hn the North stream bank of Big Buffalo
Creek. The impact is due tn bank stabilization of the North bank b) prevent erosion. Can the outta||beadjusted
so that it doesn't enter the stream at a 90 degree angle and prevent possible bank destabilization? Since the
ditch (approximately 2' deep) is coming into a large creek (from top) with stream banks approxmately 1O` high, the
riprap along the creek bank will be steep. The water coming into the ripnapm/iU need to come straight into the
ripn]p and not atun angle from the ripnap. |f the ditch is at angle from ripmapin the current situation, then more
erosion will occur along the stream bank.
4. Site 5: Is this stream perennial or intermittent? Perennial.
Site 6: |s this main tributary 8YxD'RCRC\ perennial orintermittent? Perennial. Is the smaller tributary, which
will be directed into the 36" pipe, jurisdictional? It is a jurisdictional intermittent stream. That question was
asked during the hydraulics meeting and I be I ieve DOT was going to further eva I uate. b shows a"temporary
surface water impact" on the plans which would lead metnbelieve itiyjurisdictional. |f so, isit intermittent or
perennial, and have the impacts been accounted for? It is intermittent and the impacts have been accounted for.
No mitigation will bm required for this stream.
6. Site 7: |s the ditch at the inlet end tying into the new culvert nr the stream? | cannot tell anything from the
"Detail Cu|vert#3°. The ditch is h/|nQ into the stream just upstream of proposed culvert.
7. Site 9: A new wetland has been included on the north side. This won't be impacted, conect7 Correct. Have
all impacts within the TIDE been accounted for? Yes. Is the stream perennial or intermittent? Perennial.
