DANIEL SMITH Director November 29, 2020 Troy Sloan Sloan Brothers 1705 S NC 111 Chinquapin, NC 28521 Subject: Notice of Violation Sloan Brother's NCA231655 Duplin County NOV-2020-PC-0499 Dear Mr. Sloan: On September 24, 2020 staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), performed the annual compliance evaluation and noted several violations. Multiple attempts were made to retrieve records from the owner. As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, multiple violations have been recorded in accordance with your Certified Animal Waste Management Plan and the Swine Waste System NPDES General Permit No. NCA200000 that you are covered to operate under. Violation 1: Failure to maintain and provide records in accordance with Condition IV.20 of the Swine Waste System NPDES General Permit No. NCA200000. Failure to provide a copy of the following: sludge survey, rainfall and freeboard records. During the inspection it was not apparent that waste has been applied or that any pumping had occurred. This is the second year that the facility has failed to provide records for the annual inspection. The permittee may apply for a zero animal permit to waive some of the reporting requirements. Violation 2: Failure to complete an annual report in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition IV.19 of the Swine Waste System General Permit No. NCA200000. Required Corrective Action for Violation 2: The permittee shall submit an annual certification to the Division's Central Office by March 1 of each year. You are required to take any necessary action to address the above violation. You are required to provide a written response to this Notice, including any additional information that you wish to provide related to this incident that you wish for the Division to consider, within 30 days of receipt of this letter. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed.
