APPROVAL OF MODIFIED DIFFUSE FLOW PLAN
Dear Mr. Goswick:
On May 22, 2012, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification and
Authorization Certificate per the Tar - Pamlico Rules to place fill within or otherwise impact 0.167 acre of
404 /Riparian Wetlands, 358 linear feet of stream, 24,756 square feet of Zone 1 of Tar - Pamlico riparian
buffer, 15,152 square feet of Zone 2 of Tar - Pamlico riparian buffer to construct the above named
project.
In order to meet Condition 5 (Diffuse Flow) of the Water Quality Certification, a diffuse flow plan was
approved in conjunction with the 401 Certification. A modified diffuse flow plan was received via email
on May 21, 2013 from your consultant, Stephanie Norris, PE, of Spaulding & Norris, PA.
The DWQ approves the revised diffuse flow plan to omit Level Spreader 10 as requested. Diffuse flow
requirements for the drainage area intended to be served by Level Spreader 10 will be met by
maximizing sheet flow and minimizing roadside ditches as described in your May 21, 2013 submittal. All
other aspects of the diffuse flow plan that was approved on May 22, 2012 shall be implemented in
accordance with the plan sheets dated July 20, 2013. In addition, the Level Spreader- Vegetated Filter
Strip Operation and Maintenance Agreement signed by Timothy Banes on July 20, 2010 must transfer
with the sale of the land or transfer of responsibility for the diffuse flow facilities.
